that is done when you have your permit abated. if it keeps going and there is no action after the order of abatement, we can refer to the city attorney, and we do on a regular basis. we have committee hearings meeting bimonthly. is there a list of repeated violators, given certain categories, there are owners of buildings looking to selling their buildings. there is a continued maintenance and care and the district inspectors would be aware of that. >> this particular case has an antiquated boilers system. when it was brought to my attention, we have one person who specializes in boilers. he brought back some pictures and issued a notice of violation. there was a lot of asbestos and we told him to clear that out. he identified certain things that had to be updated on the system and we expect they will probably get a new system in there. >> can i talk about responding to these complaints and how the owners fix them quickly? you talked about having outside contractors go in there and fix -- >> of the code allows us to do it. >> is t

>> order of abatement? we have gone through the abatement process, notice of violation, or we sent a letter out, no action. we gave a reasonable amount of time and then a second notice of violation. then we set up what is called a director's hearing. what i find for a lot of these owners, they do not show up. sometimes, they are elderly, sometimes they are out of town. we send a letter to where the tax bill is sent, and oftentimes they do not pick up their mail. commissioner mar: if the second part is a registered paid, and there is an oa next to other things, is that another violation? >> from a previous year. commissioner hechanova: any more questions? thank you. >> is there any public comment on item 3? >> good morning, commissioners. my name is nancy. i live next door to a vacant building that was vacant for 28 months. it was vacated november 2008 before the ordinance went into affect. it was finally registered in may 2010. the owners return to a property in march 2011. i want to give you some backgroun

as you know, the city of san francisco has had a major graffiti abatement process for many years. an inordinate amount of money was being spent by the department of public works to remove the graffiti. we're talking about in the order of anywhere between 16 million and $20 million per year was going on for this. ed reskin and i came up with an alternative, more preventive way to address this problem, instead of just responding all the time to what graffiti vandals were doing. so we developed a joint project, which dpw awarded to west $20 millious $20 million per year ta component where young people in the early grades are taught the difference between creating in the public space with permission and creating in the public space without. what are the consequences of that for a neighborhood? there are 15 schools, public schools in the city that participate in this program. we then have the one that you just referred to, supervisor chiu, is a city called street smart. they're weak partner with private property owners who, as you know, if their private property is graffitied and they

objections to reports of assessment costs submitted by the director of public works for inspection and/or abatement of

that's something that has to be dealt with separately and i've been calling for a complete tax abatements for income tax abatement for individuals thirty and below and the reason why is these individuals incidentally they would still have their social security withholdings up and paying into the system without being a burden upon the system but these individuals could stimulate their local economies additionally without the fear of taxation and such these young men and women who are graduating school or perhaps did not take the college or graduate path can go out and start businesses and really make their own communities blossom so it's an ideal situation is they've got a task well when you endeavor to start a business you have a great deal of taxation there's a payment actually if you know i've started having a business that is a that in and every single time you lose money for the first year or two you pay no taxes. well that's something else entirely like oh that's how you start a business roll with holdings are those are aware of how you start a business but there are expenses immedia

- a bidding -- abating graffiti. those are the areas we have worked really hard to preserve services where we can. we only cut front line services after we have cut materials, supplies, managers, admen support, vehicles, workers' comp costs, which we do everything we can to preserve those for online services, but we are down to a point where it is getting more difficult to preserve those. a final note -- one of those services at risk are the maintenance of street trees. we're getting to the point where all we will really be able to do is respond to emergencies. one of the things we are contemplating is relinquishing responsibility of city- maintained street trees to the property owners, which is the case in most parts of the city, but in some parts of the city, some streets the city maintains the trees, and most parts, the property owner maintains. so it is not fair or equitable. it is not sustainable. that is one solution that we are looking at. i look forward to your comments, and fax, all, for coming out tonight.

there were some delays in receiving the division of safety approval for the abatement stability assessment. now that we have that, we should be able to move forward with our temperamental documents. i hope that we will be able to reach that milestone this upcoming quarter. on the regional side, we actually had a large number of milestones. we actually have 13. we achieved 12 of them. actually, 11. we missed the lauren livermore milestone. the delay was due to the fact that the -- was issued late but more importantly, the wet weather conditions we encountered prevented us to move as quickly as we would have liked to. we are dealing with a key different headings to. tunneling operation started in late april. this was very exciting. this was taken yesterday. we will do all the work under the bay for 5 miles. this will be followed by a year -- a gear which will spend about 600 feet. on march 30th, we had an event to commemorate the start of construction on four different projects on the upper peninsula. we were pleased to have some of our regional partners as well as elected officials. this sh

we have a long and complicated abatement process. if somebody doesn't do something we make you do it. it's much easier to solve problems. there is another landlord responsibility about disabled access. under the fair housing law of the united states. a landlord is obligated. i don't know the exact words, to allow a tenant to make reasonable modifications to their residential unit including entry and exit to satisfy their needs for accommendation for their physical disability. they must do that. so and that ends when the tenancy ends the tenant has the responsibility to restore it to the way it used to be. done at the expense of the tenant. the landlord has to allow them to make those changes. see this done in san francisco where someone says i need to get my wheel chair in my building and i want a lift on the front of the building. the landlord says i don't want a lift. sorry, you are required by the law to let them make it accessible for them. do it properly with permits and remove it when they are through. i appreciate you coming,

the graffiti abatement into the tree trimming, we are most dependent on the general fund. our approach, you have learned from many of my colleagues. we have cut accountants, and back office clerical staff, we have focused on safety. live been reducing costs that have been increasing significantly. the costs are going down. we have also been focusing on education and making sure that property owners understand their responsibility in terms of the maintenance of the right of way. as you have heard also from our colleagues and community partnerships, supporting the street parking program for the cleanup events really engaging with the community. this is the legacy from, merely to really leverage our resources of the community. even with all of that focused on those kind of cuts, we have 100 fewer people on the streets doing that maintenance work than we had just three years ago. and we will continue to be strange in that area. a couple of things we're looking at for the upcoming years, one of them is the proposed capital plan that was approved by the board last month. the gen
