abby phillip at the white house. good morning, abby. >> good morning christina and dave. we are down to the wire on the supreme court pick right now with the president hoping to zero in on a decision today or tomorrow. that's set off a frantic lobbying effort by people outside and inside the white house to make their views of the candidates known. two of the main forces we are hearing about are beat cavanaugh and amy coney barrett. there are concerns about both of these candidates on the conservative side. kavanaugh we have been hearing about a lot. he has backers in the white house but some people are concerned maybe he's not conservative enough. concerns about a decision he made on the affordable care act has been brought up. and we know coney barrett is intrigued by the prospect of appointing a conservative woman to the supreme court. while she is viewed as conservative, outsiders believe she has far fewer opinions to her name and all of this is being taken in by this president who has you know likes to take in opinions from his friends and allies. white house aides be

so we saw in abby's piece he's already been asked about that. when he says that he believes it is binding precedent and that he would follow it fully and faithfully, should that give them comfort? >> not in the slightest. that is a very different setting than the one he will be in shortly. when he was a nominee to the court of appeals, he had no right, indeed he had the obligation to follow supreme court precedent. circuit court judges can't overturn supreme court precedence. so the fact that he said it's binding precedent on me, a lower court judge, of course that's true. there's nothing -- there's no other way to answer that question. the question of whether a supreme court justice can overturn a supreme court precedent is a completely different one. supreme court justices with some regularity, they did it just a few weeks ago, can overturn old precedence. so the fact that he committed to it as a lower court judge has no bearing on whether he will honor it as a supreme court justice. in fact, if you listen to his answer carefully there he's sp

call or go on line today. >>> we are back with the political and legal experts and abby, i wanted toou first on this senate intelligence committee report finding that russia did meddle in the election that putin orchestrating much of this and that they have found new reasons to be concerned heading towards the midterm elections. what are your takeaways on this report? >> on the eve of a week, you know, maybe a week before this meeting that president trump will have with vladimir putin, it's really important that this is coming out because the president continues to doubt the conclusion of the intelligence community. interestingly it seems that a lot of his senior aides even while they privately will acknowledge that these conclusions are true, publicly they just don't want to talk about it because they know that it gets the president upset. but that's problematic because russia did this, according to the intelligence community. they're going to do it again in an election that's just months away and the president doesn't agree and when he is pressed on it, when his back is against the

abby phillip with the latest. abby, thank you. joining me, cnn legal analyst laura coates. as we look at all of this there has been pushback in terms of what the president is talking about, sarah sanders making it clear the president is not asking these potential nominees how they feel act specific decisions. he's not asked them how they feel about roe v. wade, according to the white house. . what would he be asking them? >> he would likely ask them about their views on a principle called stare decisis, whether or not you believe precedent established through court opinions should be or could be overturned and would allow the public to have confidence in judicial decisions but it's not unheard of that he would haven't asked this question. just a few years ago when gorsuch, the ninth confirmed supreme court justice was asked whether the president of the united states asked him about whether he would reverse roe v. wade he now infamously said "i would have walked out of the room. it's not what justices are supposed to do." so i'm not surprised by the lack of questions but i w

abby, one would expect the reaction of the white house to be something along the lines of the russian election interference is unacceptable, we'll bring this up with president putin, it can't be allowed to happen again, thank you to mueller and to rosenstein for bringing this to the attention of the public. what did the white house say today? >> reporter: well, that's right, jake. you would expect the white house to say something along those lines. but it was notable for as much as it didn't say, especially about the indictments and about the allegation that the russian military or officers within it were involved in this attack on america. the white house spokeswoman, lindsey aware thawalters, relea statement that paraphrased what rod rosenstein said, specifically that the allegation doesn't implicate americans. she says there was no allegation in the indictments that americans knew they were corresponding with russians, no allegation that any american citizen committed a crime and no allegation of conspiracy, a change to the vote count or an affect to the election. but she does say,

abby phillip is at the white house with more. for a lot of people, i think waking up this monday morning, abby, they think where did this come from? >> reporter: yeah, and it's never exactly the greatest thing to wake up to an all caps tweet, seeming to threaten military action against iran. but that's exactly what millions of americans woke up to this morning. the rhetoric from president trump seemed to invoke the fire and fury rhetoric we heard from him when it came to north korea. and all of that was in response to president rouhani of iran issuing his own threat to the united states. rouhani said, mr. trump, don't play with the lion's tail. this would only lead to regret. america should know that peace with iran is the mother of all peace. and war with iran is the mother of all wars. but the question is, what prompted president trump to make this threat overnight. is this some kind of distraction from a week of otherwise bad headlines on the foreign policy front, or is the president really on the verge or the brink of war? we
