cornell bernard abc seven news. >> on to developing news now. investigators say they have cracked a cold case murder in the south bay from nearly 40 years ago. today, san jose police and the santa clara county da's office announced charges against joseph abeyta for the 1987 murder of this man, jesus ybarra. ybarra was found strangled with a power cord in his apartment on nordale avenue in san jose. evidence shows the two men knew each other. no suspects were identified at the time the case went cold. officials say dna evidence tested this year linked abeyta to ybarra's body and the crime scene. >> we were able to use crime lab technology through the santa clara district attorney's office to really lock down dna as proof that the suspect was there was present in that apartment and was was one responsible for the murder. >> abate is already in jail for an unrelated crime. >> a judge is delaying his decision on whether to dismiss charges against three alameda police officers in the 2021 death of mario gonzalez. the judge says he will issue a writte
