they think elliott abrams shaped this entire policy. he wouldn't have been able to do this unless secretary of state george schultz said yes, i approve of what you're doing. abrams believed that reagan had said we have to get rid of noriega. he was frustrated that the goal had been set for the pentagon was blocking all resources or policies that would lead to the fulfillment of the goal. admiral you, the chairman of the joint chiefs of staff, led the charge on the other side. you also see the difference in weight. joint chiefs of staff against a secretary of state that was not as talented. part of the problem was george schultz was travelling a lot in this time. so after the interagency meetings, he didn't have the strong voice of the secretary of state behind him. admiral you thought this was a fool's mission. he said in one meeting he said to the president, do you want to risk the lives of american soldiers from peoria illinois from the dictator when the panamanian people themselves aren't willing to risk their lives to get rid of him

clearly he's concerned about this throughout and so is abrams as well.he problem is one of political decisions made about limiting the war. that johnson, i think rightfully so is concerned about this war escalating into something larger than it should be. johnson throughout his time as president is deeply, deeply concerned about this war exploding into something more than a limited war he's certainly looking back on the american experience in korea and how the chinese were involved when macarthur overstepped a bit. i think that's on johnson's mind when he makes the decision to limit american combat operations inside south vietnam. with that decision, though, is the continuing concern about splice and external reinforcement of the southern insurgency. >> thank you. thank you very much for a great talk and very illuminating on some points. i have a couple maybe devil advocate points. sort of looking at some of the things you said tonight. three things. first, you know, coming from a corporate background, the fact that you said 70% or 80% of the officer cor

let me mention, before we talk about lochner, there is another famous homes dissent, in abrams, where he starts to talk about the need to allow people to speak and how the first amendment protects them from government regulation unless there is clear and present danger. because it turns out that the best test of an idea's truth is its ability to be accepted by the marketplace. when they look at cases, these guys slice the salami very thin. the burden of proof in a defamation case is a matter of constitutional interpretation. when you have a statute that says it is inappropriate to imprison some kind of a war hero, what the supreme court will do is strike it down because of its own empirical estimation of how effective it is as a constitutional matter. my objection to those cases is not that they do the scrutiny but that they do not do it right. why don't they do it right? because they do not have the theory. for the classical liberal, the theory is that we know what counts as a standard wrong. we can set the ends and we can choose the means to minimize error. the ends are force, fraud
