in particular, i think it is the view of many and academia that the first amendment at some level is at cross purposes with trying to make law schools hospitable and friendly and make the law school experience entirely comfortable for everyone. i don't know what other people's first year of law school's like. i had a number of professors who did not make it comfortable. they are the professors i remember the best and remember most fondly because they helped make us all better lawyers. so i think this is something that is dangerous, and it would be dangerous enough if it was limited to the discussion of abstract ideas. but it has become personalized to judges and justices to the point where you see the debacle at stanford law school. where a member of the fifth court of appeals comes all the way out to palo alto to give a speech and is not allowed to give a speech. he can't get that speech out because of the level of protest and refusal to respect his right to engage in a dialogue. it's perfectly appropriate to ask hard questions if you agree -- or disagree with a judge's opinion but

it should not be just left to academia, even though academia did a great job during the pandemic into answering many questions. the second thing i want to say is -- that was under the heading of evidence-based policy of public health. but we also need to talk, not just about evidence when we are talking about evidence-based policy, but also value and reasoning. we have heard about evidence-based policy and follow the science. often times, they are invoked just to put a stamp or justification on a policy. sometimes one may be to be doing no more than saying, there is some evidence and data that might be relevant to this partake of the problem. but data only becomes evidence when we use it to support a conclusion in the context of an argument we are making. it often depends on what evidence that we need. i suggested this for a precautionary reasoning or planning for reasonable worst-case scenario. we might just need modeling results or might just need evidence to make certain that outcomes possible. this may be the best way to do in early conditions about certainty. on the other hand, i
