ada is an ongoing process. it does not end, regardless of the age of the building, until the barriers are removed. as far as the permit goes, the department of justice does not issue permits. all they are is an enforcement agency. they hear complaints. casp certification -- maybe susan can address that. regina? >> susan. the casp inspector is well- positioned. i just wanted to be clear that you made it sound like the ada will never be met, but that is not the case. if you have been able to bring your business up to code compliance, usually a casp inspector will be able to tell you what that involves. then you are really well protected from any lawsuits. you have met your obligation under the ada. the ada does change, but it is not very often. it has taken 18 years for there to be new regulations issued under the ada. most of those applied to recreational facilities. unless your private business is a recreational facility, most changes will not apply to you. i do not want to make compliance sound like it is this

but it's still not satisfied ada the way it has written. i do not know if i should say more than that because i am not really an ada expert, nor do a play one on television. let me get into -- i will say one more thing about that. this particular store owner also seemed to think he was grandfathered in because his building was the way it was. it was built probably in the late twenties. he assumed that because he has never taken out and the building inspection permits to do any work in his store that he was safe. i tried to point out to him that he was not. this apparently is a common misconception. what often happens is that people come in for building permits and think that just because they pulled out a building permit that somehow that protect them from the ada. the ada is basically a federal civil-rights law. it has been in place since 1992. it prohibits exclusion to persons with disabilities from everyday activities. a private business is considered to be public accommodation. in contrast, the california building codes states there is

there's the state stuff, there's the ada compliance, and the ada uses something called readily achievable and we'll talk a little bit about what readily achievable means. in your handouts today you will find these defined much more closely. if you have an employee who requires some accommodation for their physical disability, you are required under federal law to provide some accommodation for their needs and this andout today, which is available at the building department, call us at 558-6205 and we'll send you a copy of this -- can include everything from your work station to your tty telephone. two more things i want to define. one is temporary usage. someone says, oh, no, i'm just selling hot dogs off a stand so i don't have to comply. >> i have heard that occasionally. >> people say that. they have to comply? yeah, they have to make reasonable efforts, they have to meet standards for disabled access even for temporary uses. if people put up a tent they have to provide access for temporary use if it's open to the public, like little portapotties that are of a sufficient size and path

an update on ada presentations. the working solutions was very interested in receiving information to figure out what they are doing. they are one of the very first mirrors involving loan fund -- mayors involving loan funds. how can they better prepare their businesses that are receiving loans from them about this particular issue? we have the 1-page information sheet and the tax credit deduction information in several languages including english and the supplemental information going out to restaurants. there was a supplemental mailing doing some quick highlights of what the ada is. be concerned. and contact our office. and what we're able to assist them with. that went out in six languages. that helped with the renewal for the food industry. today, i just received an e-mail from the department of justice that they are revising the requirements for ada that goes into effect. there are new regulations that will be dealing with public accommodations including stores, restaurants, shopping malls, sporting arenas, doct

we fully fund our ata program -- ada program. it is a critical feature of all of the programs we do, as it is mandated by the federal government. whenever we touch a building, typically, we are making significant ada improvements, and that goes with parks and other things. we are still differing $694 million. there are various other improvements at, such as the library, the branch library improvement program, in some of the others. the next slide gives you a sense of where we are with respect to where we are and what we are deferring in the pay as you go situation. you can see it is a little difficult to see because of the scale. this is still outside of the 10- year capital plan. this is assuming we are going to grow our cash commitment by 10% per year. real inflation, 5% for growth. it is a catch up. even at that level of investment, you can see the sort of dark black line that is going up rather dramatically. that is the backlog that we need for our pay-as-you-go program. this line is what would be going up if we were able to
