the ada won't protect them.we come back, i want to continue to talk a little bit about that and also about some access issues. we'll be right back. [music] it's really important to coordinate care especially, for anybody, but especially for people with disabilities because they may have some physical health issues going on that, either medications that they're taking because of the disability or- or as a consequence of the disability, that may have implications for what kind of treatment that they would get from behavioral health needs. frankly, there's also, i think, some pretty good evidence that with a longstanding disability, especially if you're not getting the services you need to live a fulfilling life, then you're going to have some depression, anxiety, some other kinds of behavioral health issues and that may lead to substance abuse and other things. so the relationship between the disability and, frankly, the community's acceptance of that and the community's willingness to help a person with disabilit

we call all of these laws ada, but really ada is one aspect of the federal laws. there are five or six statutes, depending on the specifics of the case. there are a series of overlapping laws, all of which require essentially the same thing. did different measures of damages and other things. the lawyers will sue you on these various labels. they all really say the same thing. the purpose of that letter is to establish damages. the first thing to do when you get that letter is to have your place it inspected. if you have done so, let the person know that you have had the place inspected. that makes the case go away. certainly, it lessens the likelihood you were going to be sued. if you need more time, talk to the tenants or talk to the person suing you, sending you the letter. get some additional time. they do not have elyria. what you need to do is find out what your rights are, and if you need to make repairs or remediations, do it because you are going to have to do it sometime during the course of litigation if there is a problem with access to your premises,

they should also be following the party's in the ada -- the priorities in the ada. your task report should also be giving you some constructive solutions. they should be tailoring it to your very specific circumstances. [inaudible] also, you want to make sure that your task inspector has a relationship with an attorney. it could be beneficial to have that legal expertise readily at hand. the task inspector may have learned some useful information. it is also helpful if your task inspector knows the contractor because the contractor can provide you with a construction bid for what is going to take. so i want to leave you with some closing thoughts. one of them, as mentioned at the beginning -- be proactive. do not wait for the letter. get the inspection now. the second is keep really good records. [inaudible] they had actually been doing work over the years. they have been removing barriers. but because they were not keeping good files documenting the reasons why they widened a door or replace the hardware or remodel the bathroom, tracking exactly how much money they

there's the state stuff, there's the ada compliance, and the ada uses something called readily achievablend we'll talk a little bit about what readily achievable means. in your handouts today you will find these defined much more closely. if you have an employee who requires some accommodation for their physical disability, you are required under federal law to provide some accommodation for their needs and this andout today, which is available at the building department, call us at 558-6205 and we'll send you a copy of this -- can include everything from your work station to your tty telephone. two more things i want to define. one is temporary usage. someone says, oh, no, i'm just selling hot dogs off a stand so i don't have to comply. >> i have heard that occasionally. >> people say that. they have to comply? yeah, they have to make reasonable efforts, they have to meet standards for disabled access even for temporary uses. if people put up a tent they have to provide access for temporary use if it's open to the public, like little portapotties that are of a sufficient size and path of

the part is ada -- park is ada accessible. it is also a natural lake. this is your chance to stroll around the lake and let the kids run free. it also has many birds to watch. it is a place to find and appreciate what you -- a wonderful breath of fresh air. come and experience in this park and enjoy the people, picnics, and sunshine. this is a lovely place to take a stroll with your loved ones. in the middle of pacific heights, on top of these hills, it offers a great square, a peaceful beauty, large trees and grass and greenery. it features tables and benches, a playground, restaurants, and tennis courts. there are plenty of areas for football and picnics. it is very much a couple's park. there are many activities you can experience together. stroll on the pathways, bring your dog, or just picnic at one of the many tables and enjoy all that it has to offer together. many couples find this is a perfect park to throw down a blanket and soak up the sun. it is a majestic place that you can share with someone you chairs. lafayette park is also easily access

the ada is more restrictive than the convention. now, it is true that we can say to the implementing committee we are not listening, we are america, we don't care, but i think inherently when you sign a treaty, you're making a promise in good faith to implement it, which means we are promising to do more than we already do with the ada. there are questions that can arise down the road. his alcoholism and disability? you can go through a whole series of things that we have disputes about. do we want to have the right to decide that entirely for ourselves, or do we want to commit as this treaty would do, that, yes, we will take advice from the implementing committee there. equal renumeration for work of equal value. april 27. that is a big change. we do not have anything like that in the ada. are we going to implement that? the convention has provisions about making sure that laws protecting international -- intellectual property rights do not constitute an unreasonable barrier to access by persons with disabilities, and that to me se

but the disabilities treaty, just like the ada, is a process. and our joining the treaty, followed by very important ingredient. we passed this treaty, i will send a message to every embassy in the world, and we will begin to engage a protocol that will have our people reaching out to every country and every government, and we will use our presence in this treaty to leverage these changes in these other countries, to encourage these changes, to use of voice that you will give us by actually joining it, a voice that we are not able to exercise today for our absence as a member. if we join, we can ensure that vets like dan and a lot of others like him have the same opportunities abroad as other americans. that is why the american legion, our nation's largest wartime veteran services organization, which i am proud to be a lifetime member of, vfw, likewise, many other veterans groups support the ratification of this. if we join, i ask you to think about this. why is the american chamber of commerce supporing this? why is coca-cola, which i think, so

ada is the implementing language some people are saying. we had a case, the von case, and it points out how the supreme courts can in fact take into account treaties to affect domestic law. we saw a woman in pennsylvania was being convicted because of a treaty we had relative to chemical weapons. some stated the reason was congress passed implementing language. but even after the treaty passes, another congress can pass implementing language and that expands the limits of what we have at the federal government relative to federalism and other issues. i will say to the secretary as he begins to testify, i would love to see the advancement of rights for the disabled. i would love to see american play a role in advancing thoseththos those things. but it is important we agree to language that makes sure the treaty will not affect federalism. i hope the hearing will be more about substance and less about cheerleading. and i hope the secretary's testimony will reflect that. i thank you for being hear. and i look forward to the hearing and i appre

support the ada. it was born of a notion were values are grounded in the concept that all men are created equal. whether you were born with one arm, down syndrome, or without site. , you have the right to life, liberty, and the pursuit of happiness. when runt is strongest for, and by, all of its people. some have created inferior, but often -- legislation. other countries have not even attempted to meet our standards. do not know how to do it. part of theat being disability treaty benefits the u.s. and other member nations. this treaty will enhance, not lesson, american sovereignty. it is not bad to export our value system. the u.s. will continue to lead the world in establishing a democratic model. i want to reference a gentleman behind me from georgia. he will tell you that he is --ablished in organization established an organization in his own country. he is working at the national organization of disability. looking atntry is america to validate his presence and economy -- is the quality. i urge y

that's in line with the ada recommendation. this means that the city would make it easier for us to find parking nearby. i've done my own informal surveys around the greater civic area and found a lot of problems with people parking in blue zones or in accessible loading zones and not getting tickets and not displaying the placard. but mta's already [inaudible] add more blue zones. that's something we can do. we don't need state approval, authority or money for this. the next slide to increase enforcement of placard abuse, and here again this doesn't require any state law change, but because we talked to the head of security for mta and they gave us the stats on how long and difficult it is to enforce, they're adding three more pco's to the placard detail. we also want the dmv to find a way to code in to the placard number the photo id of the placard holder. right now most people either have a california id, a california driver's license or for seniors and disabled we also have this photo id card that allows for a discount on t

law, the ada. we passed that in 1990. i remember in 1991, congressman hoyer who was then chairman of u.s. helsinki commission traveled to moscow and became part of the moscow declaration document, which started the international effort to use u.s. law as the model to protect universal -- university the rights of people with disabilities. so the united states has been leadership. the point i would raise, that failed to ratify i think compromises the u.s. ability to advance these standards globally. it weakens our own credibility to participate in the development internationally of the rights of people with disabilities and is the chairman pointed out and as others have pointed out it also compromises very much american citizens who are in other countries and their own protections if we happen to ratify the treaty we're sorting out in the same position as we would for the rights of people in our own country. secretary ridge, your comments, generally. >> i just wanted to respond to a but a very appropriate question from sena

the passage of the ada showed a united america. republicans and democrats standing up together for the right of disabled persons. america's leadership inspired many around the world to seek justice and fairness for disability communities in their own countries. unfortunately, our laws do not follow servicemembers and veterans when they are outside u.s. borders. when they travel abroad they are often jilted by leaving our nation that does everything in the power to support our wounded warriors. i traveled to asia earlier this year. i saw firsthand how even countries are moving forward economically are not keeping pace with the necessary protections for disabled persons. for example, disabilities groups they met with told me about the challenges they face in trying to make public buses wheelchair assessable. it's a sad fact that in many countries around the world that disabled are hidden, committed to be an embarrassment, and not afforded the accommodation they need to lead productive lives. nopes surprising when disabled americans t

partly by virtue of what we've accomplished with the ada. so students with disabilities participate in study abroad programs, unfortunately, less than half as often as those without disabilities. our joining the treaty will help change those numbers. i would just ask you very quickly and then i would wrap up, as consider just a few concrete examples. we're talking about joining a treaty that will strengthen our hand as we push for fire alarms with flashing lights so people who are deaf or hard of hearing know when there's an emergency and they need to evacuate. we're talking about joining a treaty that will give us the leverage we need to push for other countries to have sidewalks with curb cuts so people who use wheelchairs can safely cross the street, or tactile strips on train platforms so people who are blind don't fall into danger. our joining the treaty means that we lead the way for other countries to raise their standards, and it means we lead the way for them to adopt our standards. for all of these things, accessible bathrooms, tac
