we have statements from elijah cummings and adam schiff welcoming that testimony. joining me now is the "new york times" washington correspondent charlie savage who is an msnbc contributor. charlie, i want to ask you about, i want to go back to the other topic we're covering. this is the president at the border, threatening that if somebody doesn't end this shutdown soon he's doing, to keeps on saying he'll threaten this national emergency. tell me what this means to you. how do you interpret this? >> well at first blush i think people have the sense that's crazy, he can't do something like that. in fact, legal experts who looked closely at statutes congress has passed over the years granting the president the ability to redirect military funds in any presidentially declared emergency say there are serious arguments that the justice department could offer in defense of trump if he tries to do something like this. doesn't mean he wins. one way of thinking about this is that it is a way out of this impasse that's threatening to become the longest government shutdown

they may not have reopened their investigation whole heartedly, but adam schiff is still working withsubpoenas, what would he have at his disposal to reveal to the american public, how could he potentially circumvent the president or the doj. >> on this issue of executive privilege, he has one technique, to subpoena robert mueller. that is one thing he has, but there is a lot of other avenues they're thinking about pursuing that have not been pursued by them. a block number being called, who was that number? other witnesses, and we mentioned earlier just releasing these transcripts so they can find out if there is any other conflicti conflicting information. >> a little bit. on one hand it is a straightforward move, but for mueller's purposes, it means continued investigative potential. i think there is every reason to think that mueller's immediate agenda has to do with coursy and stone. and he will have to take some time to bring leverage to bear against them. that is just for starters. there is some reason to think that he would open up some new areas, but the few steps left could
