aetna's ceo bertolini's deposition aetna's counsel stated that if aetna was not happy with the resultsf an upcoming meeting regarding the merger, we're just going to pull out of all of the exchanges." the judge pointed to a smoking-gun letter from aetna's ceo to the justice department antitrust division. quoting the aetna ceo "we believe it is very likely we would need to leave the public exchange business entirely and plan for additional business efficiencies should our deal ultimately be blocked." now, it's also true aetna had been losing money in the new exchanges, but it must have been expecting that to change. as late as july 19, 2016, the company was still planning to expand its footprint to as many as 20 states. but, after the justice department sued aetna to block thmergerith humana, aetna announced it would cut its participation in the exchanges from 15 states to four. and that's when its ceo subsequently unleashed the death spiral remark. joining me now, congresswoman karen bass of california. congresswoman, your colleagues across the aisle have been making a lot of the death

aetna dropped out of 11 states and exchanges. however, a federal judge ruled they did so because the federal government wouldn't let them merge with humana. so the judge also ruled that aetna lied about why they quit. t republicans are so interested in ving health care for all, why is there such a problem with the insurance companies? >> well, because there's no competition. that's the problem. you know, the genius of this bill was that it's lated high-risk people and people with expensive pre-existing conditions with a $100 billion fund to take care of them so that the underwriting for everybody else could be nor in the hash marks level range of risks that would be more affo affordable for everybody. the obamacare wants to do it by somehow making everybody buy insurance so the young people offset the old and the sick. i like the idea in this bill of isolate the highest risk, most expensive people so that everybody else has a more stable underwriting platform, the insurance companies can compete, lower premiums, and people get mo

how do you change things for the insurer so you don't have aetna saying we pulled out because we saw $430 million losses in this since 2014. >> i think you have to evaluate what does this bill actually do. it does a come things. it instantly drives the cost up by an additional 15 to 20% by taking away some of the things that drove the healthy people into the market in the first place. it sends it the wrong direction. as a result of that, 14 million people will lose coverage, scheduled to go to 24 million. on top of that, you have the basic program that covers seniors, people with disabilities, people with low incomes slash by about 25% to pay for a tax cut. it's hard to figure out how to get some place better from those starting points. i think the insurers look at that and say you're taking away the major protection, the individual mandate that's causing people to get into the market and drive more healthy people into the market, this is not going to head in the right direction. >> i hear you, but that doesn't answer my question as to how does this plan -- how do you believe, andy,

and others have brought up this whole idea that obamacare is in a death spiral because of what the aetna ceo said but his company wasn't able to successfully manage the cost ofç care. they pulled out of florida, but florida blue cross is in it and making money. they've screened other patients it may have 800,000 customers. this is now, they will get to sell what they want, and it's not going to cover benefits and charge what they want. that's not going to change. >> there's a phrase inside the beltway called car valves. this is a work in progress, it may change, but does this concern you? >> not so much. in any bill you will have interest try to weigh in. the key thing is you have more flexibility in the market and less of discrimination between young people and old people, young people have to subsidize old people, that goes down a bit. to get the c- but it is a step in the right direction. >> john you are no fan of crony capitalism. what do you think. >> i'm not, but at the same time, anything that's good for insurance companies and drug companies is probably pretty good for consumers.
