i'm jessica aguirre. we're going to start with that incoming rain. it doesn't look too bad just yet. i want to give you a view of the bay bridge. so far, it's clear, but change is coming in just a short amount of time. i'm going to walk over here, talk to jeff ranieri. what are we talking about in terms of timeline of that rain coming in? >> it looks like late, late tonight and into the overnight hours. the storm system is centered way off to the north. we're getting the largest impacts there. around eureka to the north, 1.5 to 3 inches. nothing close to that for us because of how it's setting up. because of the front here, it's going to be breaking up. by 9:00 p.m. some rain over marin, napa, sonoma counties, around guerneville. should break up by 11:30. then we just undergo these spotty rain chances tomorrow morning from 5:00 to 7:00 a.m. then we get some sunshine by tomorrow afternoon. >> it doesn't look like it's going to be a lot of rain. you keep saying the word breaking up. >> totals for us, trace amounts to about a quarter of an inch with thi

. >> i'm jessica aguirre. volunteers at san jose animal services are coming forward with claims that dogs and cats with major health issues turned into the shelter are not getting the medical care they need and it's led to animals dying in those kennels. nbc bay area's marianne favro joins us. >> reporter: according to the city's dashboard since july 1 srt of this year, 133 cats died at the shelter. that doesn't include cats that were euthanized. >> linguini was just 3 months old when she was brought in as a stray. volunteer jennifer flick says he was extremely dehydrated, lifeless and only weighed a little over a pound when another volunteer brought him to her pound days later. >> the vet said he would never have survived another night. he was on the adoption floor. he was not with the rescues. >> he has a feeding tube and is doing much better. jennifer claims she's seen other cats up for adoption in dire need of medical attention. >> i have rescued cats from there that have had broken bones that they did not

i'm jessica aguirre. >> and i'm janelle wang.day, everyone. >>> what is considered use of force? an independent police auditor contends if an officer draws a gun and points it at someone, that counts. recommendations were delivered today in a new report to the san jose city council. nbc bay area's marianne favro in san jose with a closer look. >> reporter: the 2022 independent police auditor's report was presented to the city council today. and based on one of those recommendations, san jose pd plans to make a change. right now if a san jose police officer points a gun at someone, it's considered procedural, but a report by the independent police auditor recommends a change. they want it tracked as use of force and be listed as part of the department's use of force dashboard. silicon valley debug, a community watchdog group, says they support the change as a way to provide more transparency. >> it's important to know what officers are doing this and how many are doing this. the community should know. is our police department safe

. >> and i'm jessica aguirre. last night the gras prices have gotten worse. today california's average price rose 14 cents overnight. and in some places of the bay area gas prices jumped higher than that. look at san francisco, look at how it went from yesterday to today. same thing for oakland and san jose. about 20 cents difference for oakland and san jose. these prices are from aaa. san francisco's average of 22 cents and as i told you 20 cents for a gallon, per gallon in oakland and san jose. across the board talking san mateo and marin counties and also the only others pass $6 in marin, san francisco, san mateo a gallon. it's pretty shocking. these are really close to $6 as well. the governor maintains we are getting fleeced by big oil and the gas companies here in the golden state are not being fair to us. now he says he has plan to do something about it, potentially setting up a new battle between state legislators and oil companies. scott budman heard from both sides. >> well, this gas station and others here in the bay area up some 60 and 70 cents a
