and i want to get to -- i don't think anyone is talking about the aia so i want to raise an interesting point about that. as randy mentioned in his opening remarks, the anti-injunction act could punt this issue until the individual mandate goes into effect in 2014 and the tax or penalty or whatever you want to call it is paid on your tax return in 2015. so if the court does that and decides that the anti-injunction act applies, i think that's a pretty big endorsement that it thinks that the mandate is a constitutional tax. so even though the obama administration might not have won on the merits if the court applies the anti-injunction act, i think it will go a long way toward saying that the supreme court will eventually say that it is a constitutional tax. >> i don't want to get into the aia. there's an op-ed that i wrote in your packets on that. but interestingly enough in a development only lawyers can love, this could be a tax for anti-injunction act purposes but not for constitutional purposes and vice versa. the fourth circuit, which is the court that ruled applying the anti-injun

selling is part of its stake in aia group. that money will be used to help them pay part of its u.s. government bailout. aig is looking to place some . $1.7 aia shares to institutional investors. and there is a common theme in this week's economic calendar. we're talking about jobs all weeklong. today we'll start off with the ism nonmanufacturing and factory orders. on wednesday we get the employment report, productivity and cost and consumer credit. on thursday we look at the weekly jobless claims and friday that is the biggie. the monthly payroll report and there's a lot riding on this because the trend has been for improvement in jobs. if you looked at the philly index, it showed a much bigger drop-off. but most people at this point are betting on a strong number once again. >> what was your number? >> i don't have one yet. is the consensus like 260,000? >> i think 250,000, 260,000 in that range. >> yeah, i think that -- >> you want to bet on monday or after some adp snums? >> let's do it towards the end of the day. >> at t

a stake in aia listed in hong kong. that seems to be the big story there. the shanghai composite down 1.4%. once again concerns about china and growth there not to mention key cpi data later in the week. that's keeping investors on the sidelines. ross, how is the heat map looking? i hope it's better than mine. >> not really. we're one hour into the trading day. more than 9-1 decliners outpacing advancers. this is where we were this time yesterday, down on the session low. the ftse 100 off half a percent. the cac down 0.7. ftse mib down 0.7. we did finish lower yesterday although we were up from the levels of this time yesterday. helped late in the session by that nonmanufacturing data out of the united states. it will be about growth. as far as the bond markets are concerned today you see the 1.8 marks, yields on ten-year btp is where we were this time yesterday. gilt yield slightly higher. treasury yields today as we go to super tuesday just below that key 2% mark. we talked about the rba. certainly we've seen more pressure on commodity currencies. euro up
