they asked aileen cannon to basically say you can't release them and she said yes without even gettingnse from the doj. if i'm not mistaken, some of the argument, i was just reading, some of them are really wild. like for instance, that immunity means that the report would create like opprobrium or public criticism of donald trump and that the presidential immunity decision means you can't have that, which just struck me as genuinely deranged. what do i know? why can she even have jurisdiction over the jan sixth part of this? >> she has none over jan sixth, which they made clear. when she issued it, she didn't know that they had very wisely separated them out. she probably shouldn't have jurisdiction even over mar-a- lago, because she's dismissed it. but rather than make a big stink about it, doj went straight to the 11th circuit and just said, give us this release. the one thing about the canon order that's way out there, she said you can't do it until the 11th circuit rules and three days thereafter. totally lawless, why three days after, and they did tell the 11th circuit, make sure

trial thanks to some well-timed interventions by trump's allies in the judiciary, including judge aileen cannonified documents case as well. cannon was appointed by trump himself in the waning days of his first term, and at practically every turn, she has tied herself into knots to return the favor. cannon ultimately dropped the documents case using some pretty flimsy reasoning, but she wasn't done there. she then took it upon herself to block jack smith's office from making its report on either case public, even though, of course, cannon had nothing to do with the january 6th trial. the judge then took things a step further and said even if her ruling was overturned, the report still couldn't be made public until at least three days later. judge cannon was indeed overruled by the 11th circuit court of appeals. the court said that the january 6th portion of the report can be made public, and today cannon herself cleared the way for that to happen. we are now waiting to see if the 11th circuit will also overturn her three day waiting period. if so, we could see the report any minute. we will let

we might hear from the trump appointed judge, aileen cannon. there's a lot of unknowns, but there's not going to be a lot of news in this report. we already had the committee investigation into january 6th. there was the trump indictment. there was, of course, this unusual filing back in october where the judge allowed us to see a lot of evidence that you would never see before a trial. so most of the evidence that jack smith has collected is already really in the public square. so we're not looking for news. the way i'm sort of looking at the potential release of this report is whether doj is really going to fight and be aggressive to just at least defend their work and get it out, because the trump team has been so extraordinarily successful in keeping this entire case at bay. if they're able to successfully block the release of the report, something that, again, has no news and is required by regulation, that would really be astonishing. >> well, it's extraordinary because it's the biden administration that is in charge until january 20th. a
