i'm hallie jackson in washington along with julia ainsley, nbc news senior political editor mark murray, former u.s. attorney and msnbc legal analyst barbara mcquaid joins us as well. julia, let's start with the law out of texas, the most restrictive abortion law in the country. here's what it can you see, not just bans abortions after the fetal heartbeat or roughly six weeks which is before many women know they're pregnant, only a couple weeks after a missed period and has no exceptions for rape and incest and gives private citizens the power to sue anyone who helps somebody who is going to get the procedure, that means somebody who pays for it, somebody who drives the patient to a clinic, they could face a lawsuit for "abetting" an abortion. julia, talk about the significance not just of the law but the supreme court taking no action on it before this deadline at midnight. >> the law is extreme as you point out, even a driver could be sued for 10,000. the women themselves would not be sued but a private citizen who has absolutely no connection to the abortion at all could stand to win

joining us here in washington is nbc news national security and justice correspondent julia ainsley.ulia, we'll talk about the border patrol enforcement strategy in a second. but you've got these deteriorating conditions, mass deportations, the image that we just showed. how did the situation get so bad, so quickly? >> it did get very bad, very quickly. in the past when we've been talking about caravans coming from places like honduras, el salvador, there's usually a two- to three-week lead time. we're able to watch people come up and dhs has intelligence officers tracking who's coming and where they're going. in this case it exploded, we went from 5,000 on wednesday to 15,000 under the bridge on sunday. the reason is buses. a lot of these immigrants took buses in mexico, once they got to the border they were getting on buses by cartels who were paying for them. and mexico basically didn't do as much on the enforcement side as the u.s. would have hoped, in large part because they were maxed out on capacity, this group was so large. they were able to make their way to the u.s. border

joining us now is julia ainsley. thank you for being here.situation, the timeline of the deportations and negotiations between the u.s. and the haitian governments? >> hey, good morning, jonathan. so, we know that at its peak there were almost 15,000 haitian migrants under that bridge in del rio, texas. it's hard to imagine you can think about what conditions were like there. i heard there were really only about 22 portable toilets there for that number of people. so it was a humanitarian and health crisis right there at our southern border and in a sector that's not used to seeing traffic anywhere like that. so the biden administration very quickly responded we were reporting on friday that they would begin to ramp up deportations and we saw that over the weekend. just yesterday, there were three flights that left san antonio. we expect the number of flights to start ramping up. but flights only hold about 130 to 150 people when they're going back to port-au-prince. so this could take some time. we also know there's an effort just to move pe

julia ainsley joins me now. julia, what do we expect to hear?t to hear a legal challenge and one that was probably scrambled together. it is not clear the justice department even knew what their challenge would be 24 hours ago, but now because this texas law went into effect and there's been such pressure to stop this law, the justice department is responding, but they don't have many options, andrea. it's a really tough law the way it is written and some people call it challenge proof and we know the justice department will be filing a civil lawsuit against it. not criminal. some had suggested they take the criminal route and say there was a criminal violation that texas was performing of people with civil rights and they hope to challenge the law and one way they might do this is say that the state of texas does not have the authority itself to ban abortion at six weeks because that would be a violation of roe versus wade and how can they then give that authority to its citizens to allow them to seek damages connected to a woman's abortion and

nbc's julia ainsley is covering the news conference and raph sanchez is in doha.alk about what you're listening for on this operation from the homeland security secretary and latest on progress about getting the people stuck in afghanistan out soon. >> we can imagine the secretary mayorkas will want to focus on the afghan allies evacuated to the united states and the efforts that are under way to not only process them but also to test them for covid, all of that happens on the state side and any quarantining happening on u.s. military bases but also important and ngos asked for this from the administration that they commit to allowing these people to work, a lot of these people left with absolutely nothing. the afghan banks are closed, coming here with the clothes on their backs many times with families they need to take care of. there's usually a month's long heads up, the u.s. gets before they have refugees saying they're ready to be resettled. these were quickly dropped overnight. so it's not always likely the resettlement agencies will be ready for them. ngos

let me bring in julia ainsley to break down what we're learning. >> good morning, halle. let me explain the watchdogs and who they are. when you think of a descent decree, that usually happens after a police department has been found to have a systematic problem often showing excessive force sometimes tied to issues of race and then what happens is the court comes in and establishes a monitor to come in and clean up the department and the justice department gets involved to trigger the process in the first place. what we're hearing just today in this moment from merit garland is they will have guard rails on the monitors and the reason is because of the long investigation review that found that for a lot of these cities, while they did appreciate the reform in the end, it costs them sometimes millions, almost a billion dollars to their taxpayers because they were paying for these people for so long. there wasn't a limit on when it might end. they found that sometimes they didn't have the training to properly work with these people. the monitors the

i want to bring in julia ainsley that covers the justice department for nbc. also victoria defran chis cosoto. thanks to you both. when garland is exploring all options, do we know exactly what he is talking about? >> well, in short at least a simple thing he can do, he laid it out in a statement yesterday, he can use something called the face act and protect women seeking abortion and abortion providers from any physical harm or damage, if someone is doing damage to an abortion clinic, he is reiterating the justice department has that tool to protect those people. what's more complicated is what they can do in court. garland said he put all u.s. attorneys on watch to try to explore all options, see what they can do to go against the law to challenge it, but right now it is complicated because there's not been a lawsuit, a civil lawsuit that uses the new texas abortion law to sue a clinic or anyone that might be affiliated with a woman's abortion after six weeks. in part, that's because most abortion clinics stopped, they complied with the law, didn't want to

joining us is the justice correspondent julia ainsley and assistant professor at the university of baltimoreruesell who is attorney for planned parenthood. so when the president said he looked at the law, he said that he was not clear if the d.o.j. could do anything with it, so tell us about the argument that the doj could do here, and what are the federal interests that the law could be interfering with. >> well, all we understand now, geoff, is that this is a civil case, and there is a empty space waiting in the western district docket where it can be filed shortly, and this is a civil case challenging the lawsuit, and not criminal, but there are a number of federal interests at stake here, and they could argue that it is violating the civil rights which the justice department has to uphold for all american citizens and that it is within their interests to make sure that roe v. wade is upheld, and in short, they may be looking at the law is not lawful because it gives, it allows texas to give an ability to their citizens, that texas, itself, the government does not have. in other words, fo

let's go to correspondent julia ainsley. reporting that there is a new group of 20,000 migrants gathering in columbia that may make a similar trip to the border. what do you know about this group? >> they are monitoring this group. they have a massed in columbia with the intent to potentially come to the united states. that's normally what happens when we see a large group. there is a caravan in the past in places like central america, and then it can take a long time to come to the united states. but, jeff, as you and i have talked about before, this group of haitians got here much more quickly than dhs was expecting or prepared for, mainly because so many of them took buses through mexico. now dhs is trying to do a better job monitoring these groups and figuring out who might be next. but what it means is that for people who are assembled in columbia, there are also smaller groups in peru and canada, they may be the migrants who left haiti, oftentimes years ago, but feel they have no place to go back to, their economic opp

joining me now nbc news justice correspondent julia ainsley, cecil richards and the co-chair of americanst century and the former president of planted parenthood, and joyce vance. joyce, first to you. chief justice john roberts calling the empowerment of private citizens as enforcers of the law unprecedented and the editorial board of the wall street journal saying the law sets an all of precedent that conservatives could hate. it could allow individuals to sue for hate speech or new york depp ties private lawsuits against gun owners. the president called this part of the law un-american. the white house is looking at whether there are federal provisions that could block this part of the law that seems to be a reach. i don't know, joyce, do you think there is a federal option for the doj? >> so that will certainly be a question that folks at doj would have to look at from a variety of different directions, andrea, to see when they can challenge the law or find ways around it, but this is the evil genius, this notion that they would use private enforcement in an effort to prevent the cour

julia ainsley covers the justice department. help me understand this.ervene in the case, so does the department of justice have a leg to stand on at this point? >> reporter: yeah, stephanie, new day, new challenge. what the supreme court did not intervene on was a challenge from advocates, abortion rights advocates in texas that challenged s.b. 8 and when the supreme court ruled, they said they would consider future challenges if they answered certain procedural questions. now it's the justice department's turn. as we know, last week they started their own civil lawsuit in the western district of texas challenging the law. now they're asking that same district for an emergency stay to try to stop this law right where it is, allow these providers to provide these procedures for women while the courts decide whether or not this law should stand, and let it play out through the system. now, this is known to be a very conservative court. it would then get kicked up to the fifth circuit, a conservative circuit, probably the most so in the country. so if it d
