my predecessors or the fact that several of the regulations that we have done, the cross state air pollution role was a result of court decisions that remanneded and found previous versions of those regulations illegal and the last i would offer is that those regulations, mercury and air toxics is a great example of $10 of health savings for every dollar invested in our economy. so the american people get health protection in savings in terms of what they pay to keep themselves healthy. >> i don't believe when you mandate a company to employ more people to meet a regulation, that they otherwise would not be employing, that that is really a job creator. because it reduces their wealth, reduces their ability to hire people to do productive items. the question is whether or not the regulation justifies the cost. i believe my time is up. so that's the kind of thing -- and as to your statement about the health impact epas numbers with regard to health benefits or widely exaggerated in my view and i'd be glad to see the documents that would justify that number. >> they are part of the analysis of

of air pollution on health. their subjects? 5,000 school-aged children living in 12 southern california communities, from atascadero to alpine. john peters: we decided to look at children primarily because we can find them more easily. we can go to schools, and if they're young enough, they don't smoke yet. they don't have hazardous occupations, so that there are some things about them that are amenable to study, maybe not the least of which is-- at least thought by some-- that the growing lung in a young person is more susceptible to the effects of air pollution as well. plus the fact that children spend more time outdoors and they exercise more so that they would be breathing more of the ambient air and when they're exercising, even more. children in the study are periodically tested to determine if there are any long-term effects from air pollution. researchers measure each child's lung development and function in relation to the air quality at home and in school, as well as the outside environment. so if we

there is a well developed body of science and scientific research around the air pollution impacts on public health. it is probably that part of pollution that is best studied from an economics perspective. and what happens is that we look at two main drivers, and these are peer reviewed studies. they are based on the work of scientists who first look at hospital emissions and track those controlling for other factors. and they also do clinical tests where they expose people to levels of pollution. the correlation between soot and smog and premature death and asthma is not speculative. it's not a possibility. it is quite real. it has been estimated in the case of the mercury and air toxic standards to save up to 11,000 premature deaths a year. that has real cost to the american people. they have real benefits to americans. i don't -- we, unfortunately have to put a price on life so we can monetize it, but there's also the cost of lost work days, of sickness, of children missing school and their caregivers with them. all that goes into our economic analysis. they are peer-reviewed and

over the past year, epa has set new clean air standards that will cut toxic air pollution from power cilities. unfortunately, there are now efforts in this senate, we hear it, to block new mercury and air toxic standards. how many severe illnesses and even deaths will be prevented by epa's new pollution limits, please? >> the mercury and air toxic standards benefits are estimated to be up to 11,000 avoided premature deaths a year, once fully implemented, 130,000 asthma attacks or symptoms, cases that require attention, 2500 fewer cases of bronchitis, and i don't have the number of heart attacks here as well. but the numbers are quite significant. >> that's how it is with you bleeding hearts. what about the money? come on. like arsenic and acid gas, this will protect millions of families from harmful and costly air pollution and pry the american people where health benefits that far outweigh the cost of compliance. it must be noted that the epa worked extensively with stakeholders, including industry, and others to minimize costs and maximize flexibility before finalizing the standards. as you predicted, madam administrator, some companies are scaling back their cost as a result of the rule. while other regulations have been blamed for potentially causing wide scale plant retirements, upon careful notice, we see the limited facilities that are indeed being retired, are among the oldest and the dirtiest and the most inefficient facilities, that are no longer economically feasible. so, madam administrator, i strongly support the work that you are doing and i look forward to your testimony and i congratulate you for being at the helm of one of the better agencies in the government and for the work that your agency does. thank you. i yield back my time. >> you'll notice that our clock is not working up on the
