joining us now to discuss, former attorney general under president george bush alberto gonzales and white house counsel for the 43rd president. we heard liz cheney say in that speech, republicans cannot both be loyal to donald trump and loyal to the constitution. do you agree? do you see it that way? >> i think that that is a very accurate statement, quite frankly. there's some serious issues here, and i would like to give the benefit of the doubt to president trump, given the fact that this healy is one side of the story. although to call miss hutchinson a whack job, president trump and his allies have the opportunity to come before the committee and present their side of the story. i think they will have an opportunity, because i believe that the department is going to move forward with a more serious investigation now that this new information, and there may be some indictments. we'll have to wait and see. we've never had a former president have a public trial. so to the extent, if the attorney general decides to move forward, and indict and try to prosecute president trump, he has to

bush alberto gonzales, he is now dean of belmont university college of law.udge, great to have you here this morning to talk about this. just on kara's reporting -- >> a lot to talk about, isn't there? >> so much to talk about today indeed. just remind us how high the bar is when we're talking about the possibility of charging former president trump or his allies for fundraising off of these lies. >> well, as with many of the potential charges against donald trump, a lot will depend on whether or not you can prove intent and so there is a lot coming out of this committee that appears very damaging to trump, to trump world, but as to whether or not a successful prosecution can be made is going to depend a lot on the burden -- whether or not the prosecutor can meet the burden of proof. obviously donald trump or his allies in a court of law will have the right of cross-examination, will have the right to put up a defense, and so all this is certainly very interesting. much of it is very alarming. but as to whether or not there's going to be a criminal prosecutio

i'm back with michael mukasey and alberto gonzales.e you to talk about big picture here. we're seeing division. we're also seeing some distrust in our institutions. we're looking at all that is coming out right now, and the way this hearing is being conducted, you say, the testimony is working by virtue that there was somebody to hold the line. i would love to hear what your thoughts are. >> absolutely. i think mike hit it right on. i would say mike pence was brave. he was courageous not to leave the capitol. honestly, what he did, beyond that, he did his job. he took an oath of office to follow the constitution. and that's what he did. that's what the senior leadership did. listening to mr. franken, i think he would throw away donald trump and throw away the key. that's not going to happen. we're going to follow the constitution and do the right thing. >> are you concerned of the singular focus on donald trump, in terms of the committee's focus? >> i am. i think there's larger issues here. i agree with general gonzales. what this fant

a unique perspective, as both the former white house counsel and a former attorney general, alberto gonzaleswelcome to the show. >> it's good to be with you. >> all right. we just heard that bit from liz cheney, where she is reading some of the information, the texts or the emails sent to witnesses. what would you tell anyone, former president or not, who might be trying to convince someone not to cooperate with a congressional investigation? >> oh, i mean, that's a crime. that's obstruction of justice. and so that would be a serious matter. and i would tell them to knock it off. you know, this is really -- given the testimony from ms. hutchinson, i think we've moved a little bit closer where i think there are some high level people facing legal jeopardy. obviously we haven't heard from some key players like pat cipollone. i think the subpoena there is very significant. and, again, it's a serious matter when the white house counsel is asked to testify before congress. there are issues, the separation of powers and executive privilege. obviously that privilege is not absolute. it is qualified

in the meantime joining me on the decision and fallout from the supreme court, alberto gonzales, thegeneral of george w. bush, now the dean of university of law. good to see you. thank you for being here. >> good morning, we're listening in what what javier bass sarah is saying the government is doing now. i do want to ask you in response to the supreme court's decision. in general, what was your reaction to the majority opinion in that 6-3 decision? >> you know, i think like most americans, i believe there should be a constitutional right of privacy. certain decisions could be subject to protection. i think the issue that the majority of the court had, and i think for many americans, myself included, that right should be based upon the constitution. and i think if you read justice alito's opinion, i think it's pretty evident that he felt this is not a right -- constitutional right, this should be borne out of vote on the supreme court. it should be reflected in the will of the people by a constitutional amendment. either at the federal level or the state level. you know. so i think

we talked to alberto gonzales and he seemed to indicate the department of justice would have some interest certainly talking to her. she's talked to arizona legislators, she's talked to eastman, to meadows. do you think the committee should talk to her, chris? >> well, i mean, it is not for me to judge, there is apparently a division inside the committee as to whether or not to pursue this, and i think there seemed to be two points, one is, look, this is supposedly about donald trump and the people around him, you start getting into clarence thomas and the supreme court, are you kind of widening the aperture so wide, so openly that you're reducing some of the focus? and then also some political pushback here, interestingly enough, liz cheney is one of the people who is against this, and, remember, liz cheney is one of the -- almost inspectors pursuing donald trump, also a loyal republican and when it comes to clarence thomas and ginni thomas she's not so interested in that. >> i'm curious to think, to know who you think john bell john is in this. and i would love for you to sing the entire
