alex savidge is live from the stole-- is live from the home. alex, any update on the condition of the men? >> reporter: those two men pulled from the house fire. both of theming very critical condition still this morning. they were both found unconscious inside this house. as you take a live look inside. you can see this house was just gutted by fire early on this morning. flames race through the place and that trapped two men up on the second floor of this house. we'll show you video. this fire broke out around 4:30. crews could be seen giving cpr before those men were transferred to highlands hospital. the fire started in this house on the 2900 block of kingsland avenue. flames were shooting out when the first fire crews arrived here on the scene. they knocked the fire down. investigators are trying to figure out why those two men didn't wake up and get out of the house and they are checking to see if smoke detectors are working inside. >> firefighters are reporting they didn't report any smoke alarms going off. that doesn't necessarily mean t

in san francisco, alex savidge, ktvu news. >>> a remarkable development in the today's ruling is that chief justice john roberts, a conservative, joined with the four more liberal justices to mostly uphold the health care legislation. roberts wrote in the majority ruling -- >>> legal experts say this ruling will be picked apart, examined and analyzed for years. hastings law professor levine talked to us this morning about the significance of chief roberts' role in the 5-4 decision. the conservative justice wrote the majority opinion. there are hints he doesn't like this bill. there are hints in the beginning, at the end, that if the american people want to change this they should change congress. and get something different but that is not his job. his job is to assess the constitutionality. professor levine says there will be a lot of social welfare cases that will use this decision in the future and says the almost 200 printed pages of opinions will be picked apart by legal scholars. as for what is next he says it's all about the november election now and how this case will be used

alex savidge is live there with more on what happened. >> reporter: good morning. yes, this girl's family grieving after the three-year- old wondered away from her apartment in the complex and drowned in this lagoon. this morning you can see here a memorial has been set up here. it was last night when neighbors gathered to hold a candle light vigil. the girl's family called 911 to report her missing just after 4:00 in the afternoon. san mateo police came here and launched a search. we are told it was a neighbor that found the girl floating unresponsive in this lagoon that is ajay isn't -- adjacent to the apartment complex. they did cpr but they could not revive this little girl. neighbors say they feel awful. >> three-year-old kid they are gone in a minute. you can't blame the parents for that. oh my god. the rest of their life will be hell. >> reporter: we did talk last night with the girl's father off camera. ktvu crew did. he did not want to speak on camera about what happened. only saying his daughter had a beautiful smile. the san mateo county coroners office
