allie rasmus is live outside the courtroom to explain the ruling just made. allie? >> reporter: well, at issue is whether or not statements mirkarimi's wife made the day day after she was allegedly abused, whether those statements can be admitted, yes, they could. now, the sheriff's attorneys argued that video should not be brought in. and because of that, the attorneys that lopez makes in the video is hearsay. i it's it should be thrown out. you know, trial is not a game of telephone or operator. everybody knows that game. >> reporter: now, judge garrett wong ruled today that under most circumstances it would be hearsay but not in this case. he ruled that the video is add missable. it will be used in the trial. he explained why. he said the evidence shows this is a woman still crying and visibly upset. she's distraught and tearful no questions were asked to prompt her. she goes on to say her remarks don't go on to a staging. now, prosecutors see this as a victory. they believe this will strengthen their case against the sheriff. the other thing that did come up is

allie rasmus is at fso where a red carpet is being rolled out for a group of dogs, allie? >> reporter: you can see at the san francisco dog shelter, there are 17 dogs leaving and boarding a flight. apparently there is an over abundance here of these dogs and you can see the cute little i love new york colors. they are on their way there to find new homes. this is not the first time they have done this and they are holding a friend, buster brown plus he has his own little i love new york color. as you said there is an over abundance here in california and a high demand in new york and they have been providing us with flights, this is our 4th flight where they will move through the shelter system quickly and they move very quickly in new york they want them badly and they go very quickly. it is a great opportunity for these dogs to get out of shelters and into new homes. they have the red car pet and they will find love in new york and on their way there, they will be the ones having cup cakes but they get the cute little red hoodies and colors so it is a good deal for them

allie rasmus joins us from police headquarters, allie?ter: they have cleared this officer involved shooting which all began when officers responded to a report about a robbery in that residential neighborhood. when officers arrived they found two men in a vehicle that they believed was connected to that robbery. let's show you the information we have. one of the men in the car police tried to pull over jumped out and started running away and that's when they discovered that man was armed. we don't know what happened at that point and we don't know if the armed man drew his weapon or if there was some sort of confrontation but the officer shot the man and wounded him. the other man in the car drove off and police are still looking for the second robbery suspect although they did tell people in the immediate area they were not in danger. the suspect had non-life threatening injuries and no police officers were injured in this officer involved shooting. allie rasmus ktvu channel 2 morning news. >>> your time now 6:32, san jose police are inv

allie rasmus joins us live from oakland police headquarters. allie, is there any word what led up to the gunfire? >> reporter: that's one of the things we're trying to find out. our last update from police was over an hour ago. we have reached out since then. we're waiting to hear back. this began with a robbery on 62nd avenue and hall street. that's over in east oakland. let's show you the video. it was around 11:30 last night when police got the call about a robbery. it wasn't at a house or a business. it was possibly someone robbed walking down the street. when police arrived, they saw two men in a vehicle they believed was connected to the robbery. one of the men jumped out and that's when he realized the man was armed. here's not clear -- we don't know if the suspect drew his weapon, but the officer ended up shooting the suspect, wounding him. at that point, the other man still in the car drove off. police are still looking for that second robbery suspect. they have told neighbors in the immediate area they are not in any immediate danger.

allie rasmus will bring us a live report from the fire lines later this hour. >>> back to court for san francisco sheriff ross mirkarimi. his trial on domestic violence charges officially begins today. tara moriarty is in san francisco with what will happen this morning. tara. >> reporter: this morning we should find out exactly who the judge is in this trial and this is a very highly anticipated ones. ones that have media outlets from latin america to cover it. the sheriffs attorney filed a motion asking for a video tape to be thrown out. on the tape mirkarimis wife is crying and pointing to a bruise on her arm. that video is inadmissible because it was made many hours after the alleged incident. also they claim the tape made by lopez's neighbor was meant to be used in a custody trial not a criminal trial. now if the judge tosses that piece of evidence out, legal experts say that could mean the end of the case. the defense is also asking the judge to exclude statements made by madison all together. the sheriff has maintained his innocence. he is charged with three misdemeanors. next we

ktvu allie rasmus is in our newsroom this morning looking over the video and joins us now. >> reporter: the interrogation video dates back to 1999 shortly after loren herzog and wesley shermantine were arrested. this exclusive video shows police questioning herzog. in that interrogation herzog implied that shermantine was the ring leader in their crimes. he calls shermantine the cold blooder killer and it was his friend that killed 24 people and he was along for the time. he described how shermantine killed two men. the victims had been pulled over on the side of the road and he walked up to the car with a gun. >> which did he drive up to first? >> the driver side. >> then what happened? >> he started shooting. >> human times did you think he shot? once he's done shooting, then what happens? >> took them out of the car. >> reporter: herzog said they stole a total of $11 from those victims. the bodies of many victims has never been found. just in the last month shermantine provided this new information in the case. shermantine is on death row. herzog committed suicide last month. over t

bay neighborhood flooded overnight, water gushed out from a main near highway 680 in fremont and allie rasmus is live there this morning, where streets turned into streams. >> reporter: that happened before midnight last night and more than 7 hours later it's still a big mess. this is where this happened, there's still a little bit of water flowing even though they've got the water shut off now. but there's a lot of mud and rocks and dirt, just spread out across the street. it's closed off to traffic this morning and there are two department of water resources trucks on either end of the street. there, and then over on this end of the street. we just talked to one of the representatives from the department of water resources. he says the plan this morning is to bring assessors out to assess some of the damage. they're the agency in charge of cleaning up this mess, because it was one of their water pipes that flooded this neighborhood. now, this is what is looked like after it happened. waters gushed down waters and sidewalks, turning the street into a river. the pipe that was leaking was 72 i

live in san francisco allie rasmus. >>> your time is 5:32. hundreds of human bones have already been found down in a well? san joaquin county. and a search for more remains continues today. investigators say they will keep their focus on wells located near the town of linden. ktvu tara moriarty is at the site right now to tell us when the deputies will resume their digging. good morning. >> reporter: good morning. crews stopped digging around sun down last night and then this morning they are supposed to be back again at 8:00. deputies are keeping guard at the site right now. on saturday they found the skull of a human and then sunday more bones and womens clothing a purse and a ring with someones initials on it. crews found the remains in a 45 feet deep hole where a well had been. investigators sifted through the dirt to find any signs of the possible victims that may have been left here. linked to death row inmate wesley shermantine and loren herzog. herzog hung himself after shermantine provided a map of where the bodies are. >> there was

allie rasmus has more. >> reporter: well, convicted murderer wesley shermantine has revealed the location of another well where more victim remains may be found. he revealed that information in a phone calm he had with leonard padilla, he's a bounty hunter who offered to pay $30,000 to shefermentine for the information. according to padilla, this well is located within a quarter mile of a phone tower near lyndon. this aerial give us a better view of what we're talking about. the bottom line, we don't know which one is exactly the well shermantine was talking about. shermantine and his accomplice herzog, are suspected of killing many people. many of the victims' bodies ha not -- have not been found. >> he should look at the overall picture and do two things. allow them to bring shempentine out and point out where the bodies and -- shempenshermantine out there and have him -- shermantine out there and have him oint out where these -- out where these bodies are. we've contacted the sheriff's department 0 see if -- department to see if any of the searchers will be going out there. they've not

ktvu allie rasmus is live by san quentin where she man tine is -- shermantine is being held. >> reporter: he is on death row here at san quinn ten where -- san quentin where he has been for the last three decades. the latest was discovered yesterday afternoon. a skull and some bones were unearthed near a well in the town of lynn den. that is located nearstock ton -- near stockton. and bones were also discovered buried in the area. lynn den is where shermantine and his friend brew up. they are us a sus -- they are suspected of having 15-20 victims. the digging in the town of linden is supposed to resume later this morning. bounty hunter agreed to pay shermantine $30,000 on where other victims might be buried. >> i'm glad we found remains. at least that keeps the police department interested. hopefully they will stay out here and check the other wells. >> reporter: he is still on death row. shermantine wants that $30,000 to go toward paying his restitution to buy head stones for his deceased parents and candy bars in prison. he committed suicide shortly after he was patrolled after he hear

allie rasmus joins us live from san francisco to explain why some say the ban has been a disaster. >> reporter: proposition 209 was passed by california voters back in 1996. it prevents public institutions and universities to consider race and ethnicity in the admission factor. students from uc berkeley, oakland tech, and berkeley high school came to today's hearing. an organization called by sued to have prop 209 overturned. the plaintiffs say that since prop 209 became law 16 years ago, the enrollment of black, latino, and native american students has decreased. blacks and latinos represent 50% of california's population but make up less than 15% of students in the uc system. >> the university of california has got to be able to use measures that are now barred by prop 209 to be able to create a level playing field in the admission system. >> reporter: proposition 209 supporters argue an admission process that ignores race and ethnicity is the most fair. >> it guarantees everyones right to be treated fairly and not be discriminated against. >> reporter: opponents of prop 209 challen

allie rasmus has more with reaction to what happened in court. allie? >> reporter: it was over a 55 second video of sheriff ross mirkarimi's wife eliana lopez and the question was whether or not that video could be used as evidence in the domestic violence trial. and the sheriff ruled it can be used and shown to the jury in this case. in it you can see eliana lopez crying and she is showing off a bruise she allegedly received at the hands of her husband sheriff ross mirkarimi. the judge ruled it can be used as the evidence even though it was recorded by one of her friends not authorities and it was after the incident took place. >> this is the crux of their case when the victim refuses to testify. the judge in this case was she was still under the stress and excitement of the event. it is a behind win for the prosecution. >> they may be hearing from sheriff ross mirkarimi's wife and they ordered them to bring her here before the judge decides whether or not she can testify against sheriff ross mirkarimi. if she does testify it will be an even bigger set

allie rasmus has more on what the protesters are angry about. allie?porter: protesters are sue supposed to gather here -- are supposed to gather here and the plan is to pack the courtroom to support some of the fellow protesters who were arrested last saturday. some of them have court dates apparently scheduled today. it was january 28th where 400 people were arrested during an occupied demonstration. a group tried to take over a vacant building at the old keizer convention center. that is when police used tear gas to control the raid. they called for a day of action to protest what they say was being a he is a sufficient police force. there is a full day planned at frank ogawa plaza at noon and then they will march back to the courthouse this afternoon something to keep in mind if you live and work in the downtown area. also around noon, a group that called itself, stand for oakland, they are made up of residents and they also plan to have what they are calling a silent rally to counterprotests and occupied oakland demonstrations. ktvu channel 2 news.

allie rasmus is here to tell us what herzog told investigators. >> reporter: the exclusive video you are about to see dates back in to 1999. they were called the speed freak killers because of their methamphetamine use and they are suspected of killing between 20-30 people. many of those victims have never been found. during questioning with detectives herzog detailed many of the killings he and shermantine were involved in. including the murder of 25-year- old cyndi vanderheiden. they were friends with vanderheiden and it was shermantine that killed her. herzog was there but didn't do anything. >>> vanderheiden was killed more than 20 years ago. it wasn't until earlier this month that authorities found her remains in a remote county of calibers are -- calibers are county. they found the remains after shermantine provided authorities of a map where some of the victims are buried. shore maintain said he -- shermantine said he didn't kill the victims herzog did. shermantine is on death row in san quentin. just over the weekend wesley shermantine gave a new interview to the stockton rec
