aly myles wyff news 4 live in greenville's west end. geoff: 5:35 now. and update now to the coal ash dispute in pickens county. an upstate judge has ruled against the north carolina company. mrr is suing pickens county for $25 million, saying the county can not prevent it from using the landfill for coal ash. in the meantime, the company filed a motion to stop pickens from delaying its plans. a judge denied the motion yesterday and ruled mrr could not dump any coal ash while the case goes forward. county officials say the landfill is for construction debris only. permission from d-hec to dump coal ash. allyson: two development projects are one step closer to coming to downtown spartanburg. last night, spartanburg city council approved the first reading of a plan that would sell two pieces of city-owned land to developers for a dollar each. the plan has to undergo one more reading. one developer is proposing retail space and 30 apartments at the corner of daniel morgan and west main. another developer is proposing 50,000 square feet of office space in th

aly: aly myles wyff news 4 in greenville. gabrielle: the fire is still under investigation. to an update now in the low was shot overnight. the incident began in goose creek in berkeley county and ended with a standoff in goose creek. she got into a scuffle with the suspect and was shot twice. she is doing well and in good spirits after surgery but it will take time to recover. the suspect was later involved in a standoff with police before officials found him dead of an apparent self-inflicted gunshot wound. he has not been identified. in greenville county, a lawsuit has been filed against the greenville county sheriff's office and sheriff steve loftis. it spawns from an incident that happened in december. deputies responded to a report of a robbery at spring grove apartments in taylors. charles rosemond was shot and killed. the sheriff said rosemond was standing inside the apartment when deputy dave dempsy was shot in the head. another deputy then returned fire. greenville attorney fletcher smith filed the lawsuit on behalf of rosemond's estate. the suit says deputies brok

allyson: wyff news 4's aly myles joins us from jones gap state park with more. we're here at jones gap state park where we barely have any cell signal, making it tough to extremely difficul to call for help if necessary. so imagine getting separated from a group and dealing with some pretty tough terrain. that's what happened to 12-year-old john quay here saturday afternoon. officials say he was alone for roughly 18 hours. he was found sunday on old camp creek road hungry, cold and in wet clothes. we're told john crossed creeks and went through some rough terrain in below freezing temperatures. >> the crew that found him said he just come up and gave them a big hug like thank you. it was pretty overwhelming. aly: john is part of boy scout troop 210 out of powdersville. troop leaders say they teach the boys survival skills at a young age, including using the buddy system. they say they aren't sure how he got separated. officials say john is now home with his parents and resting. aly myles, wyff news 4, live at jones gap state park. geoff: thank you. quite a story
