amy hollyfield is live at the hayward courthouse, where the woman suspected of murdering lee is set to appear this morning. amy? >> reporter: investigators are hoping to at least figure out the gender of the person whose remains were found this weekend. i would help the prosecutor's case in court. there is no indication that remains do or do not belong to michelle le. nothing of course like jewelry. remains were found from volunteers on an organized search for le. the remains were found near niles canyon and the hope is they belong to le but police say it could belong to anybody. >> there are some homeless people that come around here. you've got, we've had many, many scenarios where we have found bodies not reported missing persons. >> esteban zest charged with le's murder. she is expected to enter a plea in court today. esteban earlier told abc7 news she openly hated le for interfering with her relationship with the father of her 5-year-old child but she didn't have anything to do with the disappearance of le who hasn't been seen since may. the two women knew each other because they

abc7's amy hollyfield is live at children hospital oakland. amy? >> reporter: 800 nurses at children's hospital will be walking off the job today. the hospital says they have trained replacement nurses to take care of the patients. this is a massive strike that is going to start at 7:00 this morning but preparations have been going on for days. 23,000 nurses are expected to strike in northern and california from kaiser permanente home, some sutter medical center and childrens in oakland. it will affect a total of 34 hospitals. the main issue is a proposal to get nurses to pay for more healthcare. as in any contract dispute, each side has the talking points ready. >> i'm very concerned about the california nurses association agenda. i think they talk a lot about, that they are here for the patients, for the patient safety. it's very clear they're not. any organization that relieves a state to have 34 hospitals on strike at the same time doesn't care about patients. >> it's always about the patient. i come to work with a back injury because it's abou

amy hollyfield is live in belmont with the story. we have one construction crew that came out with a surprise. >> reporter: a big surprise, eric. this is the construction project that is now on old. crew said the map said one thing but they started digging and found something else. they have placed a big piece of the wood over it for now. residents say it was fully exposed for more than a month. some complained. city officials say according to the map they thought the line would be about three feet underground, instead they found it 12 inches down. the city of belmont and its contractors were relying on maps from pg&e. residents say after a condominium caught fire in cupertino because the plastic gas line ruptured there and, of course, what happened in san bruno all makes them very nervous but the city engineer says maps are sometimes wrong. >> it's not an uncommon thing for us to have inaccurate information. these pipes were put in years ago and sometimes they weren't recorded correctly. >> a very big concern. we don't want another

the other story from the morning comes from amy hollyfield. >> reporter: good morning.n san bruno. there is going a press conference here this morning. mayor will be here, assembly jerry hill and survivors of that explosion from one year ago. they all want to see a new law passed that will try and prevent this from ever happening again. this pipeline explosion killed 89 people one year ago. it's largely blamed on negligence by pg&e but the new law will try to hold pg&e more accountable. it has several requirements, one would go after pg&e's bottom line. if the utility is fined for a safety violation it would require that the money used to pay the penalty come from shareholders not rate payers. another requirement, the utility would need to look into an automatic shut-off valve. they couldn't shut down the gas until 90 minutes after the explosion. officials couldn't get to the valve to shut it down. they want to look to getting an automatic shut-off valve. they want it passed you by friday and signed into law. this friday is the one-year anniversary of the san bruno expl

abc7's amy hollyfield is live on campus with the latest. amy? >> yeah, according to the protesters' blog, they will be back at it this morning. it all came to an end last night around 9:00 last night. protesters were not pleased with the way it ended. they did share with us some of their own personal video to show you inside pullman hall. that the hall that the students decided to occupy last night. u.c. berkeley police decided they wanted to shut it down at 9:00. that was closing time when they closed down all the buildings. dozens of protesters who were occupying the classrooms say the officers shut the doors moved in on them as they were trying to get out. and prevented them from leaving. they say at least four officers pinned one protester to the floor. that protester was arrested[ we were trying to leave and then the police attacked him. he didn't do anything. he didn't do anything. this is injustice and people should know about it. >> it seems like people on the outside tried to force their way in or come in after the doors were closed. th

amy hollyfield is live at the headquarters. >> reporter: the district isn't commenting. officials tell us this is a personnel matter so they can't talk to us about it. they are not reaching out to the mother who contacted the district two weeks ago. she is concerned because the teacher say he would be docking the students 25 point force sneezing or saying bless you. >> i haven't heard from anybody yet. i'm still waiting. i guess they haven't made a decision. i wish somebody would e-mail, call, something. how big a deduct hunt is this? are they failing the class and not graduating because of this? are they having to retake the class later on? what is going on? is this really something that is allowed to go on? are other teachers able to do this too? >> reporter: this is happening in vacaville. a teacher told students a sneeze and saying bless a distraction and he would be deducting 25 points off their grades and took issue with the words "bless you." >> i sneezed and somebody said bless you and he said do you think that girl is evil? do you think evil spirits are coming o

amy hollyfield is live in belmont. how was this discovered? >> reporter: by surprise. construction crew started digging for a project they were working on and found the pipeline, it was not where it was supposed to be. it's making the people who live out here very nervous. now it's covered with a piece of wood but it was exposed. people were worried that a car would drive over it. the project is now just sitting here. the city of belmont says it was relying on maps from pg&e and map said the line was three feet underground. crews found it 12 inches under ground. city engineer says maps can be wrong, pipes that were put in years ago sometimes weren't recorded correctly. the question is how safe is that. >> knowing the general location of them we are very careful around all of our utility lines. >> reporter: pg&e spokesperson told "abc 7 news" that pg&e maps can't guarantee depth but we provide a range because land is scaping grading and other work can change the depth of pipes over time. after the explosion and condominium fire in cupertino and the blast in san bruno, p

"oakland tribune" reports that they say the members of the orcano gang are responsible for criminal acts. injunction forbids them from carrying guns associating together or being on the street after 10:00 p.m. meanwhile, the oakland city council expected to hear a proposal for similar injunctions in west and east oakland when it meets on october 4. >>> public safety officials in fremont are using twitter today to give the public a rare look at their typical day. starting at 11:00 this morning through 2:00 a.m. tomorrow, member of fremont police and fire department will tweet all public safety calls coming in the 911 center. in the 15-hour period they expect 200 calls for service and encourage the public to follow the calls and ask questions@fremont question

amy hollyfield is live at the courthouse. amy?: her family has been so dedicated in finding her that even one of lieutenants called it one of the most impressive examples of mobilizing in a crisis. family will be here to watch 27-year-old giselle esteban face the charge against her. there is a chance she will enter a plea this morning. she told "abc 7 news" she openly hated michelle le but didn't have anything to do with her disappearance le was last seen on may 27. the two women went to high school together and may have had a dispute over a man. he is the father of esteban's five-year-old child and unborn child. esteban blamed michelle le for ruining her relationship with him. her family is planning the eighth search for her this saturday. relatives say they are dedicated to bringing her home and won't rest until she is found. even though police haven't found le's body they charged esteban with murder, based on dna evidence, cellphone evidence and surveillance video. >>> one final check on weather and traffic and just looking at
