amy hollyfield joins us live from city hall with more on that >> reporter: good morning. -- mayor lee has said the city can't have a top law enforcement official who is engaging in beating of his wife. suspended sheriff ross mirkarimi says the mayor is engaging in sensationalism and smear tactics. inside the hearing the two did not face off. mirkarimi got applauded. he received applause by his supporters when he walked into the hearing room. mirkarimi has not been allowed to see his wife since the case started she is visiting venezuela while mirkarimi fights to keep his job. some of his supporters said they don't think he's getting a fair shake and the courts are trying to break up this family. the commission spent a lot of time on this first day determining what part of written statements from witnesses will be allowed. the commission did toss out significant portions of statements from key witnesses. two main players who will be testifying is ross mirkarimi, scheduled to testify next thursday. right after him will be mayor ed lee. that should be when it gets very interesting. the co

let's begin with amy hollyfield. the one silver lining is the damage to bart may not be as bad as first thought? >> reporter: jim is right here with bart, he's talking the damage. what they've figured out so far. >> the main issue now is electrical. until we can determine when it is safe to reenergize the system and provide electricity to the trains, there's no bart service across the bay right now. >> we can see there is some damage to that covering. that covering of the third rail from what i understand? >> there's a cover board that covers the third rail, the third rail provides power to the trains. a half mile of that is damaged. you can run trains with a damaged third rail that is not the big issue. the big issue is 35, 40 insulators that hold up the third rail that are damaged and a question as to whether the power supply that guess to the third rail can be safely -- that guess to the third rail can be safely reenergized. a question of do you turn it on very quickly and risk further damaging it? or do we need t

amy hollyfield joins us outside city hall with today's testimony. mirkarimi was on the stand again today. >> reporter: yes, he's been on all morning. ross mirkarimi publicly said he didn't think domestic violence was a public matter he thought it was a private family matter advocates for domestic violence victims took him to task for that they got a billboard saying isn't a private matter. today on the stand he admitted that he does not think it is a private family matter. but, most of the morning was focused on whether ross mirkarimi and his wife tried to cover-up this incident. attorneys spent a lot of attention on calls and text messages between mere peer's wife, campaign manager and next door neighbor and calls and texts placed to mirkarimi. it was a flurry of activity. at one point eliana lopez tells the neighbor ivory madison she has changed her mind, she wants to tkro talk to a doctor. today mirkarimi says he wasn't part of any of those conversations. it want until late in the day he spoke to his wife and learned she made a video with the nei

amy hollyfield is live at pier 29. we were able to drive up the embarcadero this morning. >> reporter: you can drive on the embarcadero this morning. but, there's a good chance people are going to slow to look at what is left. they have fenced off the area. there are still huge chunks of the facade lying on the sidewalk they roped that off during the fire and called it the collapsed zone. today firefighters will concentrate on what is left looking for the fire's cause. the fire was huge, pier 29 has 115,000 square feet of warehouse space. firefighters used every water source that was available, including water from the bay to knock this down as quickly as they could. the building was empty, no one was hurt during this fire. several tourists and a lot of locals gathered to watch and take pictures of the fire. the embarcadero was shutdown in both directions which caused a huge traffic problem in the area. firefighters dealt with this four alarm fire. >> crews did a phenomenal job containing the fire to the front building

amy hollyfield is there live. what is the latest? >> reporter: it happened at a karaoke bar a crowded one we've seen groups of witnesses gathered around police cars as officers try to talk to them. behind me the scene is still very active. officers with thrash lights out, looks like they are searching for something in this -- parking lot. there are several police cars here. we've seen them trying to talk to groups of witnesses. this happened about 2:30 in the morning. a 24-year-old man was shot and killed. police don't know why. this is in the 2100 block of center road in san jose. police are trying to talk to the witnesses about what happened. a lot of them scattered. looked like it was a bit of a chaotic scene after the shooting happen. many did not want to talk to us. police tell us they are not releasing the name of the victim. they are still trying to work on notifying his relatives. looks like this is going to be an active scene truth the morning. we will be here. stay with us for updates. amy hollyfield, abc7 news. >>> we also

amy hollyfield was there. she joins us live. >> reporter: fire investigators tell me they got a tip they would find illegal fireworks in these homes it was a good tip they feel like they've made a significant dent in the amount of illegal fireworks that will be available this 4th of july. with guns drawn, officers from the contra costa county fire department barged into a pacheco home around 8:30 this morning, looking for illegal fireworks. they handcuffed the six people who live here on temple drive then started hauling out explosives. >> this is the most amount of illegal fireworks that i've ever seen and even rivalled some of the pro al shows. >> reporter: inside a first-aid box office -- officers found several m-80s like holding a quarter stick of dynamite. >> last summer a juvenile in pittsburg lost most of his hand with some of these devices unfortunate they are so easily obtained. >> reporter: fire investigators are trying to get illegal fireworks off the streets before the 4th of july. last year many o

amy hollyfield is live at city hall. >> reporter: good morning. the commission is still trying to figure out key issues. such as, whether mirkarimi's wife will come here to testify in person or whether she will be allowed to testify via skype from venezuela this is unprecedented, unchartered territory. still key issues to figure out. take a look at what happened when the suspended sheriff walked into the commission hearing he was applauded by his supporters. he believes that mayor ed lee is undermining the will of the voters by trying to throw him out of officers. the suspended sheriff mirkarimi and his wife got in a fight on new year's which led to domestic violence charges. when ended a guilty plea to one misdemeanor charge the mayor suspended him from his job. the ethics commission will recommend whether mirkarimi should be reinstated. mirkarimi took aim at the mayor as the hearing got underway. >> resorting to -- [ inaudible ] >> reporter: the commission has not decided whether this video of mirkarimi's wife crying and showing a bruise on her

amy hollyfield joins us outside city hall with today's testimony. mirkarimi was on the stand again today. >> reporter: yes, he's been on all morning. ross mirkarimi publicly said he didn't think domestic violence was a public matter he thought it was a private family matter advocates for domestic violence victims took him to task for that they got a billboard saying isn't a private matter. today on the stand he admitted that he does not think it is a private family matter. but, most of the morning was focused on whether ross mirkarimi and his wife tried to cover-up this incident. attorneys spent a lot of attention on calls and text messages between mere peer's wife, campaign manager and next door neighbor and calls and texts placed to mirkarimi. it was a flurry of activity. at one point eliana lopez tells the neighbor ivory madison she has changed her mind, she wants to tkro talk to a doctor. today mirkarimi says he wasn't part of any of those conversations. it want until late in the day he spoke to his wife and learned she made a video with the nei

amy hollyfield, abc7 news. >>> abc7 news legal analyst dean johnson joins us with more on this decision. does this come as a surprise from a legal standpoint? >> i would use the word revolution. the big headline today the pillar of the conservative wing of the supreme court john roberts coming over to the liberal wing. this is not a liberal opinion by any means. the analysis is very conservative. most of the opinion is taken up by discussing what we thought didn't exist before the limits of federal power under the commerce clause. then we get into medicaid provisions. there's this long treatise on states' rights for decades we've been saying there's no thing or nothing left of states' rights. now john roberts saying there is. i think as a precedent, this case is going to come back and it may come back to hawn the liberal wing of the supreme court and maybe -- to haunt the liberal wing of the supreme court and maybe the weapon conservatives will use in litigation for a generation to come. >>> it is the tax question that was central to achieve -- to chief justice roberts' decision, right?

amy hollyfield is live on linden street. >> reporter: they did call investigators out to this one it look a little suspicious, firefighters have turned the case over to police. take a look at why they have concerns two cars caught on fire, close to being the same time, far enough apart from each other they wouldn't have caused the other one to catch fire, 15 yard as part one in a driveway and one out on the street. a weird coincidence they would catch fire around the same time but aren't next to each other. two weeks ago there was another car fire also in redwood city, also in the overnight hours. that one caused more damage it spread to the apartmenting building where the cars were parked -- parked next two, sent 25 people running out of their home, two units destroyed, eight damaged, no one was hurt this morning's fire did not spread to any buildings. firefighters got the fire out in five minutes, no one was hurt. they wonder if these were set on purpose, they are looking into that. police have the case and an officer on the scene says they will be putting out a press release later

amy hollyfield continues our live team coverage. >> reporter: good morning. investigators say they don't know why anyone would want to set this building on fire. but they do think arson is a possibility. a security guard who was hired to watch over this building that was under construction said three young men were harassing him and trying to attack him and this was right before the fire started. authorities said the fire spread very quickly which makes them wonder if some type of accelerant was used. fire officials brought in federal investigators to help them on the case. >> atf does investigate suspicious fires. one of the areas we look at is the complexity of the fire, the impact of property damage or loss of life. >> reporter: this is going to be an apartment building for low income seniors it was under construction, it was going to be a four story building and it was destroyed. fire the electrical sis the bart tracks. the fire destroyed some construction equipment, it melted cars and street signs. it caused a tremendous amount of damage. huge number of

amy hollyfield is live in san francisco with more.including video you will see only on 7. >> reporter: the coast guard had to pull that helicopter out of air because the crew had been searching all night long they needed to give that crew a break. the helicopters on the ground now getting refueled waiting for a new crew to come in. we have pictures of its last lap around the bay around 4:30 this morning one last attempt to find this man, no sign of him. the coast guard does have its cutter out there. the san francisco fire boat has been out there and police walking along the shoreline. no one has seen him he was reported missing before 11:00 last night. his friend saw him on the end of pier 32, the friend looked away, when he glanced back he says the man was gone. he says he was drunk they had been at giants game. no one saw him in the water that. is where they are presuming that he is. that is why they called in the coast guard police officers and the fire department. police officers who have been searching have just pulled out they

amy hollyfield is live outside the san mateo county courthouse. >> reporter: he's due here in court to face seven counts of embezzlement. he's currently out on bail. investigators believe tim hanretty started stealing months after he was appointed as superintendent for the portola valley school district he's been there two years. authorities say hanretty was using money for himself, that was supposed to be set aside for the district's solar panels. >> what they found was that six of the invoices were not devoted to solar panels for school, they were devoted to recent at his home -- renovation at his home yes the school district money was charged. >> reporter: pictures of his home and description of the renovations can be found posted online. the work includes work on his foundation, basement and the kitchen. hanretty and his attorney are not commenting. if he is convicted, he could go to jail for eight years. some of the parents that we spoke with say they are very disappointed, since lay-offs and other cuts are being considered because of money problems. amy hollyfield, abc7 news. >>>
