so wasn't wal-mart already on notice that it has an affirmative duty to protect customers and secure ely. i'm appalled by the circumstance of what i've seen in terms of the different incidents. wal-mart, nine so far. they were on notice. they knew that this is the type of thing that happens. they encourage the customers to come. why didn't they have adequate protections in place, the right amount of security to insure that shoppers would be able to have safe passage in and outside of the store and make sure no one would be injured? a woman pepper spraying? she was able to pepper spray 20 people before she was even stopped. >> gregg: wal-mart and other stores have these advertising campaigns, black friday specials. we're going to open our doors at a special hour. they know that crowds will gather there. in a way, isn't it foreseeable that a dangerous condition would be created and doesn't that impose a liability on them for failing to protect? >> here is my problem. if we shopped on-line, we'd be all right. >> that's cyber monday. >> here is the point, gregg, i have two things to same
