perspective now, from maggie haberman, white house correspondent for "the new york times" and andrew mccabermer deputy director of the fbi and cnn contributor. thanks so much to both of you, tonight. andrew, so, cnn has confirmed the existence of the investigation, as first reported by "the new york times." and it's also cnn's reporting that barr, then-attorney general, was briefed on this multiple times. based on your experience, years in the fbi, if you have an investigation like this under way for that period of time. and the attorney general is briefed on it. it -- it's substantial investigation? >> it is, jim, it's substantial. it's very serious. you know, 21 years of opening and overseeing, conducting investigations. i can tell you that nobody opens a sex-trafficking investigation, in which the subject is a sitting member of congress, without having a significant, you know, degree of information. in this case, it's likely that some of that information came from the prosecution of this associate of congressman gaetz, joel greenberg. but that's -- that's hard to tell, at this point. but

andrew mccabe is here. n with this very separate allegation against congressman gaetz that lauren just reported on. sources telling cnn he showed nude photos, videos of women he said he slept with to some of his fellow lawmakers. what immediate concerns does that raise to you? >> it raises a lot of concerns. it's another bizarre chapter in this bizarre story. it would seem to be a matter for the ethics committee to look into. in terms of the investigation of the congressman's potential involvement in sex trafficking and prostitution, those sorts of things, there's no question that for the investigators this is going to provide a host of new leads. part of the danger of being the subject of an investigation like this is the initial predication, which sounds like here was the allegation of human trafficking or sex trafficking, opens the door to all sorts of other investigative inquiries. i can't imagine that the investigators involved here won't be interested to try to identify and locate and determine the age

here to help us unpack it is former-deputy fbi director, andrew mccabe. friday night and we are going to flip it. tell me why i care about this. i still think, if they can't connect gaetz to paying for sex, with an underaged person. florida, the age is 18. the federal statute is 18. how are they going to get him on this money-travel-friends thing? >> yeah, it's going to be tough. i think with all the things we have heard, he is being investigated for the sex-trafficking issue, is to me, by far, the most significant. and -- and perilous for the congressman. the public-corruption bribery issue that we have heard about with cnn's reporting today. is a very -- these are very, very hard cases to make. the bribery statute, essentially, says when someone gives something of value to someone, in a position of -- to a public official, in return for the execution of an official act. then, that qualifies as bribery. >> but, there are buts that people need to know, right? you got the mcdonald case that you are about to refer to. the link between money and favors has to

let's get some analysis from andrew mccabe. there any doubt in your mind that this is only the first of what will be many guilty pleas to come? >> no doubt whatsoever, wolf. it's not only the first of many guilty pleas, but it is likely the first of many guilty pleas with cooperation. i would assume the vast majority of folks arrested at this riot are not hardened criminals with prior time in federal prison. these are people who are going to want to limit their possible prison exposure as much as they can. the best way to do that in the federal system is by providing information to the prosecutors the prosecutors can use to investigate and prosecute people at higher levels of culpability. >> does it surprise you that this suspect not only is cooperating, is not only pleading guilty but also cooperating with authorities? >> yeah. it doesn't surprise me at all. the fact that the guilty plea went through today tells me that this individual has already been meeting with prosecutors and agents and providing information over the last

andrew mccabe.od to see you, chris. >> now, first, you ever heard of a member of congress being attached to anything like any of the things we have heard on the investigative side? >> no, no, this is a new low, and it's an incredibly bizarre story, with so many facets to it. i never heard one quite like this. >> it went from an inquiry to an investigation from someone who is under age, that person is under 18 for sexual purposes. 18, federally. if she is 17, it triggers it. and this other guy, greenberg, is put in the mix. the former texas solicitor in florida, he is arrested, charged, with a trafficking scheme, and someone said, gaetz was here on a weekend night looking at videos with him. how deep with the waters get? >> not only does the witness say gaetz is seen on video, but greenberg texted the witness and confirmed it. that seems pretty credible to me, and it's an allegation that was brought to the authorities as early as january 2020. this is very, very serious. sex trafficking from a relati

chief political correspondent dana bash and cnn law enforcement analyst and former fbi director andrew mccabe. first two, andrew. again, bizarre. you've got the investigation going on. but with this letter how impactful could it be? what do you do with it? >> you know, it's interesting victor, it doesn't add much to the story. niece are the same allegations we heard from the beginning. but it could be significant in two ways. first, it's a statement that greenberg made before he started cooperating with the authorities. so one of their challenges right now is to try to verify or corroborate the things that he is telling them. having made this statement before he was in a cooperation agreement with them corroborates some of the claims. it's not a new story that he made up just to get their attention. it's something he has been saying a while. that's one thing. the second thing, it casts a whole bunch of characters in a very negative light if there is ever a trial about these matters. you could likely get that statement admitted into evidence. and it would have the effect of really making gaetz

. >>> let's discuss now with former deputy fbi director andrew mccabe. he's also the author of the memoir, the threat. how the fbi protects america in the age of terror and trump. it's an important read. andrew, good to have you on. you've been involved in plea deals in your position in the fbi and the justice department. what kind of cooperation do prosecutors require to reduce sentence and charges in a case like this? >> yeah, sure. so, jim, there's a couple of things to be aware of. first, there's only two reasons a defendant would ever plead guilty in the federal system. and the incredibly rare instance people come in and plead guilty to an entire indictment, they put on no defense and just admit the charges. that hardly ever happens. in almost all circumstances, if you are pleading guilty, it's because you're cooperating. it's also true that the -- in my experience, with many organized crime cases, working as an agent in new york, having gone through this process many times, the defendant usually has submitted to several proffers before the plea deal

andrew mccabe, the former deputy director of the fbi so the fbi has new material to take us through and us through, andrew, your reaction to what we just learned from evan. >> you know, wolf, it's -- it's incredibly sad. it's tragic, but it's not unique. it's not unfamiliar to us, right? we've seen these sorts of issues, what seems, at least at first blush, to be struggles with mental illness and paranoia and, you know, delusion result in violence. i think it is important to point out though that even if that turns out to be the primary kind of motivating factor for this person, it's -- i think it's significant to note the roll of the capitol as the kind of symbolic kind of focus of his anger with the government or, you know, the focus of his paranoia or what have you. i think what you're seeing is kind of one of the -- one of the follow-on impacts of the massive attack on the capitol on january 6th and the way that we all viewed that attack, the way it was seen by the world, the way that those videos have been shown again and -- over and over on television. you've elevated the profile

also, andrew mccabe. and cnn law enforcement analyst, charles ramsey. chief ramsey, just from a policing standpoint, can you explain how this could have happened? and how officers are trained to avoid a tragic mistake like this? >> well, first of all, this shouldn't have happened. the taser -- in fact, if you go back to 2009, fruitville station in oakland. bart officers that shot. from that point on, every department i am aware of now, they require officers to wear the taser, on the opposite side, the weak side, away from the gun. so it's a cross-draw. making it very, very difficult, if not impossible, to make that kind of mistake. what happened here, i have no idea. the taser was on the opposite side, as it should be. she drew it, or at least drew a firearm thinking -- at least that's what wshe is saying. that it was the taser fired the shot. it should not happen. it was negligence, no dquestion about it. training and everything else should have kicked in. she's a veteran. not a rookie. it just should not have happened. >> it's so interesting because a

and know eli hoenig, and andrew mccabe. >> andrew, let's start with you. what does a raid like this one today say about this investigation and where it's headed? >> alisyn, it says a lot. it delivers a very strong and concerning message to mr. giuliani. i'm sure he's receiving it loud and clear. what the search warrant at the residence signifies is the shift in an investigation from what may have been a very quiet, subtle covert effort to maybe identify witnesses, maybe talk to cooperators, to assemble facts to build toward a probable cause determination for a search want. now we're past that. we have taken a very overt and very public step. prosecutors and agents ultimately -- not right away because of the attorney-client privilege issues -- but ultiult ultimately will have a lot of material to go through and will put a fine point on this investigation. it becomes hand-to-hand combat for the prosecutors and the attorneys for mr. giuliani. >> talk to us about the foreign agent registration act. potentially what could this mean for charges for rudy giuliani

joining me now to discuss the senior law enforcement analyst and former deputy director, andrew mccabek you for joining. so capitol police inspector general bolton telling officers to hold back use of force. five people died that day including an officer. two more officers committed suicide afterwards. who was being protected by that order? >> well, don, it's really troubling. you take that order and you consider it with the other statement by the i.g. he basically said that those civil defense units lacked any sort of organization or training or preparation or even adequate rosters to know who was present at any given time. it's possible that order was the result of the disorder that led tom condition. so it seemed as if he was saying that the officers in charge held back those heavier more effective weapons because they weren't confident in their own officers' ability to deploy them effectively or to deploy them the way they're supposed to be used. so just a really, really troubling important trail of that service. >> got a lot of ground to cover. i want to move to sanctions against

just last night, andrew mccabe, our senior law enforcement analyst and a former top fbi official said this about some of the frankly baffling responses he has seen so far from some officials, most notably the county sheriff. it really defies logic, he said. the way they've handled this situation locally. this comes as another new video comes to light. last night we saw a clip of the immediate aftermath. tonight's footage, according to our source, shows county deputies arriving to serve an arrest warrant on brown. what the two videos have in common is neither come from the body cam of any of the deputies involved. despite repeated promise of transparency and accountability, officials have shown precisely none of that footage to the public. it only asks for a court order to do so yesterday. something our legal analysts tell us they could have easily done on an expedited basis days ago. brown's family and members of the legal team did get to see a 20-second snippet of it yesterday which was enough for one of the lawyers to call it, a, quote, an execution, which might explain why the offi

joining me right now is andrew mccabe, senior law enforcement anl. g analyst.t do they have to provide to a judge to get a search warrant? what can we glean from this? >> you can glean that they not only satisfied what you have to present to the judge which is basically, you have to show the judge that you have probable cause to believe that there is evidence of a crime in the location that you are searching. clearly, the judge agreed that there was probable cause to believe that and sign a warrant. but even before they could go get the warrant signed, they had to have some very tough conversations in the department of justice. to show the highest levels of the justice department that it was worth searching an attorney's home and office to find criminal evidence -- evidence of criminal conduct. >> that's what i was going do ask you. the fact they took this step against an attorney let alone a president's -- the former president's attorney is significant here. can you explain why? >> it really is. you know, the justice system has great respect for the relationsh
