joining me now, former fbi deputy director andrew mccabe. good to see you. see this potentially leading to reinvestigating current death penalty cases? >> well i'm not sure if would lead to a reinvestigation of any individual cases but it is definitely leading to a reevaluation of the efficacy of this policy. the doj is in a tough spot here because on the one hand, executions are lawful at the federal level, right. you have about 46 to 50 people who are currently sitting on death row. so doj has some obligation to carry out the sentences that were lawfully handed down by juries across the country. on the other hand, i think the attorney general aacknowledging that many, many legal scholars and academics have acknowledged that there is significant data that indicates that as a policy, strictly as a policy, the death penalty unfairly is applied against people -- against mino minorities and people from black and brown communities and it is not perfect. we've exonerated a lot of people in the last years. so the fact that we've been executing people has to -- >>

let's discuss with cnn senior law enforcement analyst andrew mccabe. andrew, i'm glad you're here.ask you. between learning about trump's alleged comments and you now a gop congresswoman continuing to equate coronavirus measures with the holocaust, there are some people who are hearing this and all of that with very open ears. does that concern you? >> sure, it does, laura. on many, many levels. the idea that we would have a former president of the united states and a sitting member of congress consistently reaching towards the nazis to provide examples, to kind of charge their rhetoric about whatever point it is they're trying to make is just -- it's so confounding, it's hard to even get your mind around that. but it's beyond being ignorant and insensitive and offensive certainly to people who are relatives of, you know, folks who were victimized by the nazis or jewish people in this country and around the world. beyond all that, it is dangerous. particularly in the case of marjorie taylor greene, the sort of things that she's saying are not just inappropriate references to the ho

want to get perspective now from andrew mccabe, and laura coates, former federal prosecutor, and cnn at the sentence in the case was significantly below the guidelines of one to two years, what does that tell you? >> you know, it's got to be a really concerning sign for prosecutors and agents working the rest of these cases, anderson. because it's -- there is no doubt that this sentence will have an impact on other cases that judge moss sentences. but also, other cases that other judges review. be -- there's a -- there's a strong desire, within the federal bench, to sentence similar defendants to similar punishment. it makes perfect sense. so, this case, in some very important ways, could set a benchmark that other defendants, who are charged with similar conduct, could -- could use to kind of expect what sort of sentence they can expect a judge to give them. >> laura, i mean, this particular defendant. he said, in court, he was remorseful. but then, his attorney, according to our reporting, made a kind of rambling 30-minute presentation. he quoted abraham lincoln, japanese internment

i also want to bring in our chief legal analyst jeffrey toobin and andrew mccabe.author of the book "the threat: the fbi protects america in the age of trump." how serious are these felony counts laid out in this indictment today? >> what's clear is that allen weisselberg himself is in a world of trouble. it will be very hard to defend how the trump organization paid his grandchildren's tuition at a private school and somehow he didn't pay taxes on it. maybe he could argue the company car was actually a company benefit. maybe he could say the apartment was a corporate benefit. but the idea of a company paying for your grandchildren's education, it seems to me pretty close to an open and shut case. as for the trump organization and the former president himself, they're suggestive -- the charges of suggestive of illegal conduct, but it is a lot less clear, and it's not identified in the indictment who unindicted cocon spore tor is. it could be donald trump. it is also not clear who authorized these payments, which designed to be to avoid taxes. >> the lawyers represe

i want to bring in andrew mccabe, cnn senior law enforcement analyst and also former deputy directorrganized crime, counterterrorism and extremism and ran a terror task force focussed specifically on the northern virginia where this bible study was located. i say that with air quotes, bible study, that's not obviously what this really was. but what does this tell you about not just the threat we have seen of extremist groups but of the continued threat? >> well, brianna, it tells you it's a great view into the type of people that are drawn to these fantastic and ridiculous conspiracies but who can take that belief and turn it into a desire to actually commit violence. as i was reading the documents in this case, it reads just like many, many of the cases i was involved in during my time in the fbi in which we were investigating people who tried to conceal their activities with bogus claims of being prayer groups or religious bible study meetings but who were actually plotting individual acts of violence. no matter what philosophy or group they were inspired by or following, whether t

. >> let's discuss this now with andrew mccabe, cnn commentator, former fbi director who had his own trump that has been well covered. what was your reaction when you saw these hand-written notes today? >> it's extraordinary. hand-minute contemporaneous notes are some of the best evidence you can come across when you're trying to make a case or big a prosecution. that's of course not happening here. but i think the accuracy and the fact that they were captured in the heat of the moment on this incredibly controversial phone call is really moving. >> and now, according to these notes, rosen, who was then the acting attorney general, told then president trump to understand that the justice department, quote, can't and won't snap its fingers and change the outcome of the election, unquote. he added, it doesn't work that way. what does this tell you about how trump viewed the department of justice in his final days in office? >> it's absolutely clear, jake, how he views the department of justice. and that is as a tool for him to use for his personal, political benefit. we talk about the

i want to go to andrew mcelderry g -- mccabe. when you look ato tom barrack, some of the people in trump's or bit came through tom barrack. barrack charged with the illegal foreign lobbying over the time period of 2016 to 2018. when you look at this, how serious do you think it could be? >> well, erin, it's pretty serious. i mean, this is an indictment over 40 pages. there are just page after page after page of very damming allegations, almost all of which are based on direct quotes from barrack and his associates. email messages and text messages. that means that investigators all most invariably had warrants for electronic surveillance collection of those messages so barrack may have been the subject of a title three or pfizer warrant during this three hoof year investigation, it's very thick detailed indictment. it's clearly a very well presented case that's taken the government a long time to put together and they have a lot of evidence. >> so a spokesperson evan was just laying out for tom barrack said mr. barrack made himse
