now to discuss, we have cnn senior law enforcement analyst andrew mccabe and defense attorney misty marris. let's begin though with cnn's kaitlin polantz, kaitlan, this hearing that has been going on for quite some time, tell us what's happening. >> yeah, it's been two hours and 20 minutes since this hearing was supposed to start in court in florida, we have no word on what has happened so far in court because there's no cameras there and there's such heavy security around that building know in and out. nobody can be coming out to tell us what's happening, what's going on in that hearing, though as far as we know, is prosecutors are trying to convince a magistrate judge sitting in this federal court that ryan ruth should stay behind bars right now. he's facing two charges around possession of a firearm, but they haven't taken the additional evidence through the grand jury to indict him and all they've done so far this morning is file a this ten page report of other evidence that they're gathering. they say it's not everything that they have, but what they think should be enough off to keep

here you go you know, it's interesting also, andrew mccabe that prosecutors have until september 26 to submit the evidence for judge chutkan to review. >> what kind of factors do you think she will have? reviewing whether to make this specific evidence all of it or some of it, public, will that decision essentially letting the prosecutors go first was a core one to the fight that we saw play out in court today. >> trump's team quite reasonably wants to slow this down. what's that? >> put discussions and motions and possible avenues of appeal in front of that part of the case, where will be deciding, sorting through the evidence and deciding what charges stay on, what charges don't the decision by the judge today was one it's sending a clear signal that no, she's going to go right to the evidence and that will likely compress those issues in a way that they all get appeal that once, which again, is consistent with what the problem i securities are seeking that she's making it clear that the upcoming election is not going to have an impact on her decision. that's absolutely right. and i

and andrew mccabe, you're the former deputy director of the fbi. the fbi special agent in charge of this current investigation says they're sending evidence to quantico. there interviewing suspects, friends, and families, and investigating his quote, active online presence. how does all of this come together to understand the suspect's actual motive? >> so wolf, what you heard from fbi special agent in charge, jeff veltri today was basically fbi big case, one-on-one. this is how the fbi does it. there's not another law enforcement entity in the world that does it quite as well. you see intense focus on the crime scene, rendering every piece of evidence that they can find wherever they're cutting leads to other field offices like charlotte and honolulu to interview family members and associates. this is exactly what you would expect to find. ultimately, if all of that information will come back to fbi miami, they are the what we call the office of origin or the lead office on the case. they will piece together each one of those facts, each one of th

environment all right, let's bring in cnn, senior law enforcement analyst, former fbi director andrew mccabel to see you. thank you so much for being here. we're actually talking in the break about what exactly is the solution here? obviously there's bipartisan calls for more money for the secret service what should that additional money by for them in your view? >> i mean, how do you do a better job of honestly having the imagination to prevent things like this? sure so just to clarify one thing from that, peace you're playing just before we came in contrary to what the congressman was saying, the fbi doesn't have anything to do with determining what sort of protections secret service protectees receive. the fbi doesn't do protective work. >> what they do do is support the secret service by providing intelligence of threats. and that's super important because it gets right to the heart of your question what the service needs to do is rethink their methodology to adapt a more nimble approach to designing a package for each protecting no matter who they are or what position they currently occ
