andrew mccarthy joins us tonight. are interested in the story, but it's a complex sprawling story with more innuendo than fact. what should we be looking for? >> i think the main thing that has really confused people about the discussion over the last week is the idea that pressure and obstruction of justice are the same thing. they are clearly not. actually, if you look at what former director comey said in his testimony, the case that there was obstruction of justice is much worse today than it was yesterday. and i actually didn't think there was any case yesterday. what people need to understand is putting pressure on a subordinate is not obstruction of justice. the key element of obstruction of justice is corruption, so if you don't have pressure that is motivated by corruption, there is no obstruction. the president has as much authority or more to exercise. prosecutorial discretion as any of the subordinates he has who are u.s. attorneys are fbi agents across the country. i think the extent to which these two co

joining me now, former federal prosecutor, andrew mccarthy.ditor of "national review." is it clear to you what james today?was trying to accomplish it looked to me that he was lashing out to the president, but he kept indicting himself. >> i think the impulse to go to war with somebody whos whose testimony is 80% helpful is not way i would go. with respect to the legal matters we have been wrangling about the last six months, comey's testimony is a home run. professor turley parsed the statute connectly. there is no obstruction of justice and there is no collaboration with the putin regime. that's what it was supposed to be. his testimony was exculpatory on trump with respect to those important matters. i would be running with that. i think what comey did and i sort of suspected this before the testimony comparing it to the hillary clinton situation. he didn't need to come in and accuse trump of committing a crime to dirty him up and hurt him politically. because as we know he bent over backyards not to accuse hillary clinton of a crime. but b

attorney andrew mccarthy says he should not have been hired in the first place. has gone ahead and he has staffed up with experts in criminal law. do you think the president is taking his cue from conservative media on this particular issue? >> i think he takes his cue from newt gingrich who went on a rampage on mueller. that's my hunch. mueller is there. he is there to stay. he is competent and honorable and workmanlike. he is a prosecutor's prosecutor. i worked with him a long time ago. i admire the heck out of him. i think he will do a great job and there's no chance trump will fire him. >> what do you say to the charge that bob mueller has gone ahead and hired some top investigators as well that have links and associations to the democrats particularly the clinton, not the campaign, but the clinton empire and that tanints his ability to be a neutral instigator? i don't think much of that. if you go through the list, you will find donations on either side. bob mueller is a real independent person and i have great faith in him as do -- nobody cares i have great
