andrew miller was subpoenaed last year to supply testimony to the grand jury. miller had resisted the subpoena and conservative legal organizations had taken up miller's case as their best hope to challenge the existence of the mueller investigation, to basically have the mueller investigation declared illegal and have the whole russia investigation annulled legally. well, today in a unanimous ruling from a three-judge panel on the d.c. circuit court, andrew miller and conservative legal organizations lost that case against the special counsel's office. now they may yet further appeal either to the full on bank d.c. circuit or supreme court, but as of now, they have lost. and it looks like as of now andrew miller is going to have to respond to the grand jury subpoena and we'll find out in the end we expect what exactly that might be leading toward when it comes to andrew miller's testimony. it also means that the mueller investigation is still batting 1,000 in terms of defending its existence against these various legal challenges. also today, the accused russia

they've told andrew miller, you're not off the hook because we still need your testimony and the filing today. what does it add up to you? >> that this isn't wrapping fast and yrbsy that because what not wrapping means, we don't know. but if you look at the indictment itself, one of the things that's interesting is if you're only looking -- if your prosecutor only looking at perjury, witness tampering, obstruction, you don't have to make reference to contact with the trump organization -- with the trump campaign. to make the claim -- now so they're signaling something there because it's not necessary for those indictments. it doesn't mean they're saying they're going to charge something but it's a signal. now we know they have all these records. i mean we had all the swirl around this fbi raid which, from my vantage point, looks libe they want to make sure there wasn't evidence that was destroyed and that they're going to take their time going through the evidence. remember they have rick gates whose sentencing is postponed. >> that's another data point in the delay category. >> and rog

let's bring in our experts to break down what we've just learned from my conversation with andrew mccabe. matt miller, you worked at the justice department, you knew him well in the years past. what have you learned? >> a number of takeaways from that interview. one of the things i find most interesting is the fact that he briefed -- this disclosure, that he briefed the gang of eight on the opening of this investigation. he wouldn't get into the details of what he told them but it was very clear they knew, the day that bob mueller was appointed, that the president was the full subject of the investigation, and there was no complaint at that time. one, public officials know they're not supposed to attack fbi investigations. they've known it for a long time. they know it's kind of a third rail to be pressuring the fbi about what they should and shouldn't do. and it tells you how much things have changed in the nearly two years since that moment happened. >> devin nunes was one of those eight and he had already been going to the white house, trying to undermine the investigation in the early days. >> he
