let's bring in andrew napolitano. how unusual is this? >> well, it's very unusual to register as a foreign agent retroactively. the law does permit that. there's certain kinds of personalities you have to pay. it's not a criminal offense to do that. what is fascinating is that mr. manafort has agreed to testify publicly before the house intelligence committee, one of six committees conducts an investigation. but that's a political stunt. republicans will try to make manafort and the president look good. the democrats are going to try to trip him up. the real investigation that he needs to be concerned about is bob mueller's investigation. he has fbi agents, subpoena power, search warrants and the ability to seek an indictment before a grand jury. that's part of the big large investigation of russia, their efforts to hack, successful hacking, efforts to influence the election now beyond dispute. >> shepard: we know they did that. the question is did they get help. >> correct. that would be the crime for which mueller is looking. if it happ

all rise, judge andrew napolitano is here with us. >> well, a lot of people are.can't predict which way they're going to go. there's a number of avenues available for them. first, you should know, they don't like cases like this this time of year. this is literally the busiest time of year for them. they have two remaining mondays on which to dispose of about 15 or 16 opinions. so, most of the justices and their clerks are probably working 17, 18-hour days as we speak. in the middle of that, tomorrow they will stop, they'll review the government's applications, appeal from the 9th circuit court of appeals in california, the 4th circuit court of appeals in virginia both of which upheld lower courts which prevented the president from enforcing the travel ban. the 9th circuit for one reason and the 4th for another. the supreme court generally doesn't like to rule in a preliminary way. they like to rule when it's over worth below. there will be trials in maryland for the virginia case, the appellate court, the trial courts in maryland and there will be a trial in hono

judge andrew napolitano said that sessions could be in a lot of trouble here because he could get the president in trouble or himself in trouble because he wasn't testifying as the attorney general. is that an explanation for why he invoked executive privilege? gregg: he was obligate to invoke a privilege, not executive privilege. for 30 years since the supreme court ruled on executive privilege. it's only the president can invoke it. not sessions. there is a procedure that you follow. if you have a conversation with the president and you think it might be executive privilege, you decline to answer it. if congress wants it they move to compel, then the president can invoke it or not. and if they still disagree, it goes to a federal judge. sessions was following the law. in particular ron wyden came across as a legal blockhead for not understanding that when sessions tried to explain it to him. kennedy: i wanted to get back to comey. sessions' explanation ways comey has been f.b.i. director for a number of years and he knows his way around the presidential suite and he knows the rules

let's bring in judge andrew napolitano. good to see you, judge. you said yesterday this was a dangerous position for him to be in testifying under oath and in open setting now. how do you feel today? >> i feel the same way today because he is not testifying as the person in charge of these criminal investigations and intelligence investigations. he is testifying as a witness. and he has three issues to concern himself with. the president of the united states who appointed him, the justice department which he still heads even though he is not responsible for these investigations, and himself. because the democrats are going to come out very hard and strong and accuse him of perjury because of what i think was honest misunderstanding of the nature of a question about his relationship with ambassador kislyak which in my view was harmless and routine. nevertheless the answer he gave about how many times he met or was acquainted with or came across ambassador kislyak, he gave the answer under oath and it is inconsistent with the factual record. right o
