people didn't pay attention to, there were two retired fbi agents on the witness table along with andy mccarthy who appears on your show and others. what i was amazed that was the lack of concern by these former fbi agents, one of them peter strzok used to work for and they serve their country and i'm sure they did a great job. i brought up the fact that we probably shouldn't be using counterintelligence capabilities in this country to target a political campaign, they just sat there. it was almost as though they had been coached by the democrats to not say anything bad about the counterintelligence investigation that it occurred. if that's the attitude, i will tell you if that attitude permeated throughout the counterintelligence capabilities and if retired fbi agents think it's okay to use counterintelligence against political campaigns, i think we've gone a long way in this country. that used to be democrats who didn't support the counterintelligence because they thought they were spying on campaigns. they took them over, they corrupted the whole thing and it seems like that is the attitude

>> david: no matter what he says, the biggest hit against mueller, he was respected by andy mccarthy, a critic of what's been going on. no matter what he says, his idea of you, it is the drop of the prosecutor to find you innocent, not to find you guilty. that was what turned people against him in the public eye. we have a basic foundation to our traditional system, you are innocent until proven guilty and if the prosecutor doesn't have evidence that you are guilty, he should shut up. and he didn't. all those points you were mentioning, none of them proved guilty. >> melissa: i agree with what you are saying, they are not supposed to color it in. but i agree with your idea that if we had them there and he can answer questions, it will be beneficial to all sides. i just think you and i looking at the same two points don't see the same thing and it's interesting that in my mind, you think if he sits there and reads the same points that we looked at, it would sway public opinion but you are not saying that. >> jessica: obviously there is going to be more to it but i think it's important

andy mccarthy is a former u.s. attorney and fox news contributor. thank you for coming back here.guing two standards of justice. let's divide them in two. with regard to hillary clinton and these news about these emails, what can we say about that, andy? >> i think he is quite right about that. you have a case there where they had an immense amount of evidence and they bent over backwards to not make the case. they barely used the grand jury. they left charges on the table that i think that were very strong criminal cases on. they cut deals with witnesses in order to limit the amount of information that the agents were able to ask about, to limit the agents' access to information. they wouldn't use grand jury subpoenas. they basically used the attorney/client privilege as a reason not to investigate some of the accomplices who were lawyers and even let those accomplices sit in with mrs. clinton at her interview even though they were her co-conspirators, which is really deeply against the procedures of the f.b.i. >> bill: they exonerated a letter three months prior to. why did that

♪ gerry: back with elizabeth holtzman and andrew mccarthy. andyn 11 actually, grounds of cases of possible obstruction of justice by the president. if this is taken up by congress, how strong do you think those grounds are? i mean, clearly aside from the politics, the grounds that he came up with, what's the case that the president obstructed justice? >> the problem here is that we're leaping back and forth from the legal realm to political realm, right? so if you were to ask me as a strict prosecution matter what would be the outcome of this in the court, that would be one analysis. in an impeachment proceeding, which would be the context the congress would take this up, they don't need to have a sufficient prosecutable case. so there's a a lot that would have to be sorted out in the court case in terms of what the legal standards for obstruction are. i think there's a disagreement, for example, between the attorney general and the special counsel about what those are. there'd be an issue about what the president's intent was. but congress doesn'
