to andy mccarthy right now, fox contributor. don't know if these charges stick, these nine additional ones, tax evasion, but i know they potentially carry a lot of prison time if they do. could you elaborate on that? >> yeah. there's nine charges in all, neil, so it's a combined 17 statutory years; that is, if you combined all the statutes that are at issue, they provide for a penalty of 17 years. the sentencing guidelines would apply if he were to be convicted of one or more of the charges. so he would do less time than that, but these are serious offenses. it's a lot of money. so it's likely that a prison sentence would come out of it if he's convicted. neil: now the question becomes because from his defense team, hunter biden's defense team, they say these are just pile on here where you have a republican prosecutor who faces enormous pressure to do what he did. what do you think of that? >> well,, i think it's a preposterous argument. i heard abby lowell, the lawyer, say yesterday if this defendant were not named biden, this

. >> martha: but, you know, let's bring in andy mccarthy, former assistant u.s. attorney joining us as well today. fox news contributor. andy, thanks very much for being here. as you warm up with your initial reaction to this, i want to put this poll up. this is a poll of the confidence in the country in the supreme court. this is back from the summer. it's a june poll, 2023. the most recent one that we have on this question. look at this move. in 2017, 83% said they had confidence in the supreme court. now that number is at 48%. so they have a lot on their plate in terms of how they're perceived. a lot of people who are questioning many of the institutions in the u.s. government these days. what do you make of their decision in this regard? >> i would echo what john said. they don't want to be in the position of deciding the election. they know, martha, i think that it's highly likely that they're going to be throwing out the colorado decision, you know, in short order. that's on a timetable where it really has to be done by early january. they don't want to be -

let's go to andy mccarthy, the former u.s. assistant attorney. where is this going now? let's say they get enough votes to proceed. then what? >> well, i think the wise thing for them to do at that point would be to reissue the subpoena to hunter biden. i know there's been some talk that they'll move ahead with contempt without having that happen, neil. but i think hunter will take the position that the inquiry was not authorized at the time that he was subpoenaed and didn't appear. therefore it will illegitimate. he will argue that they knew it was illegitimate, that's why on that very day they tried to vote it and get it approved. chad says they think they have the votes. we'll see what happens with that. to nail that down, just to be on the safe side, there's an argument technically that this subpoena is inforcible anyway because it was issued by the judiciary committee and the oversight committee and they have subpoena power. the wise thing since we're talking the president's son and contempt is there, they would be better off reissuing the subpoena once they get the
