with the new year new steps to protect the privacy fastrak and clipper card users, let's go to anne makovec. she is at the san mateo bridge to explain. anne, good morning. >> reporter: good morning, sydnie. there is the obvious benefit to using fastrak. i'm here on the san mateo bridge and you can see it right there. traffic whizzing through the toll plaza. but when you look at the cash lanes, a little bit of a backup there. so fastrak has modernized the commute for a lot of people and now fastrak itself is getting a bit of an upgrade. new safeguards going into place on january 1 for fastrak and the clipper card system. they have all your personal information if you have a transponder. the metropolitan transportation commission is under orders by the legislature to destroy that information after an account has been inactive for 4.5 years. they are also supposed to be scouting for security breaches and making all of their policies more explicit. right now they have all that personal information and they say they are not sharing it with third parties but there have been some reported cases wh

let's go to anne makovec, she is in south san francisco hearing from the family of two of the victims. anne, good morning. >> reporter: good morning, sydnie. right now i'm at the police department and a lot of the officers investigating this case left very early this morning. they had worked through the night trying to find the shooter or shooters in this case. two people were killed outright. four people were sent to the hospital. the suspects still on the loose. this happened at 7157 last night in south -- at 7:15 last night in south san francisco. the shootings happened at 7:15 also night here in south san francisco near linden avenue and 8th lane. several shots were fired. someone called 911 and by the time police got there, two men were already dead, one as i mentioned severely injured. and three others were hurt. we did speak with one young woman who says two of her brothers were among the people who were shot. a 15-year-old hit in the leg and another teenager who died in the street. >> my second brother, he is 19 years old. the cops are always after him since he was 14 years ol

anne makovec is in san francisco, where a new transbay terminal is being built. anne, good morning. >>> reporter: good morning. the demolition starts at 10 a.m., sydnie. it starts in four hours. here's the wrecking ball behind me that red machine that you're looking at. a lot of san francisco history has gone on in this building. it's 71 years old. you know that final the pursuit of happiness that was filmed partially inside of that terminal. today is the beginning of the end for the transbay terminal. the last bus departed here august 7th. so it's been closed since then. the crews have been gutting the inside of this building, getting rid of the hazardous materials and selling off anything of value. the wrecking ball is going to be slammed into the building several times over the next two or three months until all the debris is piled into the basement. they say they are going to use that basement like a bathtub to gather the material and recycle much of it. here's what the new transbay terminal center will look like in 2017. a new financial center in the district

anne makovec is live in pacifica with the details. i'm glad you're not wearing a hat this morning, anne. >> reporter: i know. , you know, i should be because then my hair might have some hope of looking decent at some point today but it's just not the case. it is extremely windy out here along the coastline and it's going to be all day. but the good news is they just opened highway 1 in pacifica. it was closed for a few miles after a rockslide in devil's slide. let's look at some of the video that we shot at about 4:30 this morning. this was crews cleaning up the last bit of that mud slide and it was mainly mud at that point. they were making sure all the mud was off the road so cars weren't slipping around but there were a lot of rocks involved and they cleaned those up overnight. crews were out there for several hours. and this is the opening this morning was very good news for commuters because when that is closed which does happen from time to time, that can make a 10-minute commute last up to an hour.

our anne makovec is in pacifica with more on the road closure. anne, hang on to your microphone out there. >> reporter: whoo! it is so windy out here, elizabeth. it is windy and cold. and that is not the only problem weather-wise. the mud slide behind me you can see highway 1, i'm in linda mar right now at pacifica, highway 1 is closed at this point because of a mud slide in devil's slide. let me show you some of the pictures that we shot just a few minutes ago up towards the slide. crews just trying to get rid of the mud on highway 101. overnight, some rocks tumbled down buckling the pavement closing the road. now, they have been working on making a tunnel through san pedro mountain. they have been working on that since 2007 and crews broke through in october. so that's going to be the saving grace because this does happen from time to time. for commuters it can make a 10- minute commute up to an hour. and that is the wind, gale warning all day today until midnight tonight. we had some gusts over 50 miles an hour overnight. that did not stop some

anne makovec is in petaluma with who police are looking for and why. anne, good morning. >> reporter: yeah. now, no crime was committed here, sydnie, but police are a little concerned after a report from a 9-year-old girl yesterday morning. look at the map here. i'm in petaluma near grand elementary school. a 9-year-old girl and her brother were walking near the school, a few blocks from their house on mcnear avenue. they noticed a strange van, they said across from their house. they went to their house anyway and they say a man got out of the van and appeared to be coming after them, ringing the doorbell. they did not answer the door and then he eventually left. according to the girl's mother, the man was making constant eye contact with the little girl and just kind of creeped them all out. here's the description of the man. short, with gray hair, he was wearing a blue jacket and jeans. police say the van was a gray older model box style van. so if you have any information on this man, any background on this petaluma police would like you to call them

that is where our anne makovec is in oakland where two agencies, we understand, are investigating this one. hi, anne. >> reporter: that is because i'm on 109th avenue and bancroft. very close to the border of san leandro and oakland. we do know that one person was shot by police and that person died. witnesses say that person was a woman. this happened at around 11:00 last night. the witness that i spoke with, his car was actually hit during this incident. he says that he saw san leandro police chasing this jaguar. he says they nicked the car to stop it. the jaguar spun around and hit his car. then the witness says that police surrounded the jaguar yelling for the driver to get out and then started shooting. again, one person died. we also know that there were two people in the car at the time. now, it sounds as if the san leandro police are the ones that fired the shot. but technically it happened in oakland. so oakland police are doing the investigation. right now, they say they have some of the witnesses down at the station and they have not made any official comment yet. we are hop

anne makovec is in san bruno where today we're seeing the first steps to sort it all out. ning to you, anne. >>> reporter: good morning. a lot of numbers involved. take a moment to check out the sign of the season among all the empty lots in san bruno, where this blasting happened on september 9. somebody put up a christmas tree. it has solar powered lights and it is a sign that eventually this neighborhood will be back to normal. but in the meantime, the lawyers are having their way with all of this. the loss of homes here and the emotional and physical damage to those who used to live here. attorneys for pg&e and those representing the more than 100 san bruno residents will start planning court proceedings in the case. the examiner is reporting those lawyers are expected to decide when to meet with the san mateo county judge who has been assigned to the lawsuit stemming from that explosion. almost all of the suits accuse pg&e of neglecting the pipeline that exploded failing to properly maintain or inspect t two of the cases were filed in san francisco county and pg&e want

despite the damage, anne makovec tells us that the family got some good news today. >> i didn't think it was that old that it would fall down. >> reporter: but this 100-foot- tall pine tree did come down at 5 a.m. right under the roof of the torres family home. >> i thought it was an earthquake because when it hit the house, it was just a big bang. and then i ran out towards the front. i looked out and i saw something and i turned around and looked in the kitchen area and it was just -- oh, no. >> reporter: he came into the kitchen to find it full of insulation and sheetrock. the family got one piece of good news today. the city inspector came this morning and said they can still live in the house while it's being repaired. they just need to stay out of the kitchen. as for the fence, ripped out of the ground and the roof damaged to an unknown extent, eric says it will all be fix the once he hears from his insurance company and in the future, he may invest a bit more in landscaping. >> we were going to have it cut down this summer but it never happened. and then, no... now we're having

anne makovec in oakland with more on the lawsuit filed today. >> reporter: and here are three lawsuits against three local hotels here in oakland. so-called no-tell motels according to the city attorney. he is looking to close down the motels. one of them is right here behind me. the economy inn. there is also the national lodge. both located along the track as it is called. it is an area around international boulevard known for prostitution. and the third lawsuit is against the sage motel on macarthur boulevard. a long time california law, the red light abatement act, allows oakland to sue to close the hotel and seek civil penalties of $25,000. now oakland does have a long- running prostitution and human trafficking problem. it was identified by the fbi as the hub. these motels were identified by police as the most outrageous locations. and the city attorney says other motels should take note because they're planning on busting more. >> if they refuse to take even the most rudimentary and basic steps to prevent their businesses from becoming a magnet for crime and a danger to the comm

anne makovec is in berkeley. the suspect allegedly tried to run over a police officer. >> reporter: there were several events that led up to what you see here behind me. that white car crashed. this is on a frontage road off 80 and 580. and officers from the highway patrol and oakland pd are still investigating. but the crash happened at 5:00 this morning. they are trying to figure out what caused the crash that killed wanted man in that car. >> guy in the car looked like he was still moving. he was slumped over the wheel. so, you know, it's -- it's pretty terrible. >> reporter: the 38-year-old man in the car lost control on 80 eastbound in berkeley. police say he was a parolee and had a warrant out for his arrest. >> the driver was critically injured. he is transported to a local hospital where he was pronounced dead. >> reporter: there were two incidents that led to this crash. the first at around 8:30 last night when police saw the car in the middle of the street on 35th and west. >> the driver's agitated, was

anne makovec now live with what they found. >> reporter: they have been working on this investigation for weeks. they are not even close. this was an intermediate report but the most interesting thing to come of it was just discussed with congresswoman jackie speier and the mayor of san bruno and that was that pg&e isn't even aware of what kind of pipes it has underground. that is of course one of many points in this particular report that came out. we're expecting many more reports. but a lot of eyebrows raised by that concern. and jackie speier made a lot of comments about that because if they don't know what kind of pipes they have underground how can they be properly inspected? that's something that people have been certainly thinking about and will more so after this report. >> i think we all know a lot more about pipeline safety today than we did three months ago. i think pg&e had a horrific wake-up call. >> reporter: that's when the explosion and fire wiped out the san bruno neighborhood on september 9. eight people were killed, 37 homes destroyed. the cause is still undetermin

but we begin with anne makovec in marin county where contractors are standing by, just in case there are problems. ann? >> that's right. but the good news, ann, no drama. it certainly was a wet holiday. but no extreme problems on the roadways. we haven't heard of a lot of power outages. and that whole sewage spill fix seems to have helped. a pelting rainstorm, soaked christmas day, all over the bay area. >> a beautiful day. >> but not the spirit. >> the weather is great right now. if you take it for what it is. >> this mountain biker came to check out the white capped waves in the marin headlands. holiday drivers splashed through wet roadways in a multicounty area where an urban small stream and flood watch was in effect for most of the afternoon. the creek stayed within its banks in marin county but a dozen contractors were out near the scene of a huge sewage spill earlier this week, watching to make sure there were no toxic creeks flowing. >> we're out here trying to make sure people don't hit our pipes and keep them up and running so the sewage system doesn't erupt again. >> the wo

anne makovec is there with what neighbors say happened. >> reporter: we have the neighbors' story. still waiting for the police side the story and they are not going to be talking until later on this afternoon, i was just told by a spokesman at the hayward police department. this happened on depot road in hayward. i spoke with one of the neighbors, who was awakened by a gunshot. >> when i went out to the door, i see all these cops around randy's place. and when they let me out, there was randy laying by his camper, by his trailer. >> wow. >> reporter: he says police were called to the property after a fight between a man and a woman. according to the people who live on the property, one man owns it and then rents out four trailers to other people. they say that the other than was in a fight with one of the tenants when police came and killed him. now, the police say that the man came at them with a knife. but the neighbors say it was use of excessive force. again we'll have to hear more from the police on this coming up this afternoon. and you can check that out at 5:00 here on cbs

anne makovec in san leandro to explain, the second time in two weeks that strangers have stepped in to stop an alleged attacker. ann? >> reporter: we were just talking about a sexual assault that happened in union city a couple of weeks ago, where a 2- year-old girl was assaulted. right in the middle of the store. and it happened on friday night here at the walmart. the victim was an 8-year-old girl. and i'm on davis road in san leandro. here is what happened. >> this whole incident took a matter of seconds. not minutes. not hours. it was seconds. the best thing that i can say is when you're taking your children to the store, keep them close to you. >> reporter: it was 7:00 on friday evening, an 8-year-old girl was shopping in walmart's toy section with her mom when she walked away to find her brother and seconds later police say she was assaulted by this man, carlyle veozone. >> the suspect approached our victim, came up from behind her and kind of grabbed her and put his hans down her pants. >> he says he put the girl down and ran back to her mother crying and told her what happened.

in san bruno, anne makovec shows us one home other than has a huge mess on his hands. >> i didn't think it was that old that it would fall. >> reporter: but this 100-foot- tall pine tree came down at 5 a.m. right under the roof of the torres family home. >> i thought it was an earthquake because when it hit the house, it was just a big bang. and then i ran out towards the front. i looked out and i saw something and i turned around and looked in the kitchen area and it was just oh, no. >> reporter: he found the kitchen full of insulation and sheetrock. the family got one piece of good news today. the city inspector came this morning and said they can still live in the house while it's being repaired. they just need to stay out of the kitchen. as for the fence, ripped out of the ground and the roof damaged to an unknown extent, eric says it will all be fixed once he hears from his insurance company and in the future, he may invest a bit more in landscaping. >> we were going to have it cut down this summer but it just never happened. and then -- no. now we're having it cut. >> reporter: in

anne makovec reports, the latest was a bold takeover robbery at a fast-food restaurant this morning.porter: it was just after 5:00 this morning and before the restaurant opened, when a man with a gun and a ski mask ordered employees into a freezer inside this mcdonald's on san pablo avenue and got away with some cold, hard cash. one of the employees was slightly injured. the robber left a trail of money as he ran away but is still on the loose. >> i think people just need to be more aware of what's going on. >> reporter: it's one of severed robberies in north berkeley recently. in the past week two people were held up in separate robberies here near the north berkeley bart station. that's on top of about a half dozen other robberies in the city in the last month. >> i can't really make anything out of it. i think we all need to be care. and hope they find a better way. >> reporter: the best advice from police right now, pay attention to your surroundings. a lot of folks were either talking on the phone or had ipods in when they were robbed. so far, nobody has been arrested in this re

federal investigators released findings from test on the ruptured pipe and as anne makovec shows us, at least one finding did not match pg&e's records. >> i think we'll all know more about pipeline safe than three months ago. and i think pg&e had a -- a horrific wake-up call. >> reporter: that's when this pipeline explosion and fire wiped out the san bruno neighborhood on september 11th 9th. 8 people were killed, 37 homes destroyed on september 9. the cause is still undetermined. today congresswoman jackie speier and the san bruno mayor spoke out about a report from the ntsb. >> it is a process of elimination. >> reporter: they have been examining a 28-foot piece of the pipe that flew out of the ground and landed on the street. it's been at a lab in washington, d.c. since a week after the blast as the ntsb, which provided these pictures, has been inspecting it. it turns out the record presented by the pg&e didn't add up. pg&e had long reported this was a seamless pipe. the ntsb says it found a patchwork of seams. welded from the outside but not the inside. >> i do believe and we will

now we're having it cut. >> reporter: in san bruno, anne makovec, cbs 5. >>> i'm sharon chin in castro valley. heavy wind and rain triggered mud slides all around the bay area. crews stayed busy in castro valley and the biggest mess a giant boulder blocked palomares road. in san mateo county, devil's slide re-opened by 5:30 this morning. caltrans used boulders to clear a 100-foot-wide mass of mud that closed a road. mud wasn't the only problem. high winds toppled trees. in san francisco, a tree crashed on a car on the 3900 block of sacramento street at cherry. no one was injured. crews chipped away at the debris as police closed the street to traffic. and in brings babe, a wind whipped tree hit a power line and plunged across the parking lot at brisbane elementary school. no one got hurt. school was out for winter break. in alameda county, sharon chin, cbs 5. >>> stay out. that was the message protestors in marin county had today for pg&e's smartmeters program. in the town of inverness, critics say don't know enough about the devices to allow installations. simon perez shows us how far
