anne makovec is in the mission district and ann, we're hearing that a firefighter may have been injured. ann? >> yeah. that is what we are hearing right now. it cannot have been a very serious injury though from everything i understand about the scene right now but for the people that lived in these buildings they were injured. two of them critically. we are closer than we normally can get to fire scenes. you can see these two buildings were on fire. names were shooting from the roof of two apartment buildings, three apartments each a total of six apartments. they were all evacuated and apparently, it was quite a scene this morning because there were no fire alarms in the building. no smoke alarms. the people that i talked to did not hear any alarm. the way that they were able to wake up and get out of the house around 4:30 this morning was by screaming and other people knocking on their doors. now, take a look at this wooden ladder right here. this is where one of the people was rescued. that is leading up to that window. there was a woman trapped in that apartment. firefighters brough

[ yelling ] >> reporter: this youtube video caught one of the incidents likely to be part of that investigation. the man shooting the video says police shot him with a beanbag. during the protest, police also used tear gas and several people were injured in those clashes. many claimed police brutality and excessive use of force. this morning's announcement comes on the heels of a heated city council meeting last night when the council discussed a resolution dealing with the recent port of oakland "occupy" protest. the port was shut down twice in the last two months you may remember because of scenes like this. the resolution would give the city council not the mayor any tool legally necessary to move or stop any future port shutdowns. >> we all have a right to express our views, but we also have

anne makovec is in berkeley where most of the tents are now gone. good morning to you, anne. >> reporter: good morning. there are still several tents though here behind me in civic center plaza in berkeley and that is after police contributed this notice yesterday evening saying that everybody has to clear out by 10 p.m. but several dozen people remain in the plaza and several tents, as well. you can see one guy over there even decorating for christmas. here's some video that "occupiers" streamed on the internet overnight. there were several pop-up confrontations between them and police. this is one of them just after 1 a.m. police did take a few swats with their batons and then backed off. this is posted by a man named spencer on twister. this camp has been here for months and has been growing since other camps were razed in the area there. were 60 to 100 tents earlier this month and there was a lot of infighting also amongst the campers. police say there were growing sanitation concerns, arrests for battery, theft and assault with a deadly weapon.

and anne makovec is in oakland now where community members plan a big march tonight. she joins us with more. good morning, anne. >> reporter: there is a lot of frustration here in oakland and a lack of unity. we have that recall petition against maybe jean quan floating around. a glut of gun violence here increasing over the last five years. and then finally tugging on everybody's heart strings now. the impending death of that toddler almost 2-year-old hiram johnson is going to be honored at a peace march today while the community tries to find solutions to the violence in this city. doctors are preparing to take this little boy off life support at 1:00 this afternoon after tests showed no brain activity. >> initially, the family, of course, you know, thought that maybe there was hope and, you know, we all hoped. we all hoped for miracles. i think at the end of the day, everyone came to the conclusion that the baby was only breathing and that's it. there was nothing else going on. based on that, the baby will be taken off life support. >> reporter: now, hiram was shot

anne makovec is in santa clara with the latest vote on the 49ers big stadium plan. anne, good morning. >> reporter: good morning. yeah, boost it significantly. and now it is in the hands of the nfl owners. they are meeting today to consider a financing agreement that could allow groundbreaking for a new stadium here in santa clara as soon as next year. the stadium would be 68,000 seats and a cost over a billion dollars. the nfl would pay $150,000 -- no, that would be $150 million with the city of santa clara paying 850 million -- you know what? can i get my millions and thousands straight? [ laughter ] it's what it says there on your screen. let's go with that. the portion from the city of santa clara would be mostly through bank loans. anne makovec is at justin herman plaza with what's next. good morning. >>> reporter: a lot of tension at "occupy sf." some people have moved out because of it but as you can see behind me the majority of the encampment remains. some people ready to fight with police. others ready to move to the mission. that's after police advanced on the camp last evening. this was the scene at around 5 p.m. when police began encircling the camp with barricades. some demonstrators tried to shove the barricades back as you can see. police say they were trying to create a safety zone and clear the sidewalks. >> last thing we want is a confrontation. our mission was to create a safety zone. when the officers were attack, it does give us a sense of how violent the people who remain in the camp are. >> reporter: protestors declared victory when police backed down and then several of them walk to the federal reserve building and sat down in the middle of market street. they stayed for a little over an hour and then they came back to camp and had another one of t

anne makovec is in san francisco where dozens of people barely made it out of their burning homes with no time to grab anything. >> reporter: so terrifying and now they are left with nothing. firefighters just did a shift change. they have been keeping guard on the buildings overnight to make sure no fire flares back up. they did deal with a couple of flare-ups earlier in the evening but were able to put it out. it wasn't the structure that was reinnighting, it was some of the -- it wasn't the structure that was reigniting, it was some of the con tents inside of these townhomes and apartments. the victims homeless with nothing. a temporary shelter has been created at the missionary temple church on golden gate avenue. it's run by the red cross and a lot of the people who came there were sent to rooms at local hotels, others went to stay with friends and family. firefighters retrieved some belongings. but most of the people escaped with just the clothes on their backs. >> i wasn't sure what was going on. my door got busted open by the construction workers that are actually working on th

anne makovec is in west oakland, where a new camp has popped up and nearly a dozen tents, as well. ne, good morning. >> reporter: good morning. they are calling it the cypress triangle. one unique thing about this catch is you can't see it. it's behind that fence here behind me. this is in west oakland on peralta street near mandela parkway and there are about a dozen tents right now behind that fence. here's a look behind that fence. we walked in earlier. they moved their tents in yesterday. and they have been encouraging others to join in via their website, occupy california. and also through twitter. oakland as frank said had been "occupy" camp-free for more than a month after police cleared out another camp here in west oakland in november. now, we don't know who owns this plot of land and neither do they. but they say they're in it for the long haul. what if the owner doesn't want you in here? >> then we're "occupying." but we have been down that road, too, at what was that linden? that little lot over there? >> reporter: so would you stay? >> yeah. yes. absolutely, yeah. we ha

anne makovec is on treasure island with details on the closure that's coming up. good morning, anne. >> reporter: good morning. this is all an effort to speed up construction of the new east span. you can see that singular tower here behind me. the project has been coming along very nicely. this closure, though, is expected to cause some traffic nightmares. it is only going to affect the westbound lanes. plans for presidents' day weekend february 18, 19 and 20th. it would last two or three days. but it is all contingent on rain, which could totally derail the plan. construction of the east span has been speeding along ahead of schedule. february's closure will allow crews to reconfigure the road leaving drivers to a temporary westbound detour. they will have to restripe the road which needs to be dry, which is why the closure is contingent on the weather. now, the shutdown is expected to have a major traffic impact. we know this because this has happened twice before. here's a sight you don't see too much. an empty bay bridge. this was labor day weekend 2009. we al

anne makovec is live in san francisco with the very latest. they cleaned out the camp but they just doesn't want to leave, i guess, anne, right? >> reporter: a lot of people say they have nowhere to go. you can see behind me justin herman plaza is cleared out they are sleeping in sleeping bags alongside of the plaza. three dozen campers now wrapped up in sleeping bags outside of the federal reserve. that's the 101 block of market street a block from where i'm standing, the site of the first "occupy" camp here in san francisc that started two months ago. that was cleared out by police several weeks ago. the campers say they don't know how long they are going to stay here. they moved here after the raid last night. they say they are just trying regroup. >> the interim is going to be, you know, a stop-off for some of the "occupiers." but you know, uhm, we're waiting word -- we're not going anywhere. we're waiting word. and i think, you know, uhm, our leadership is just backing up and regrouping and we already have plans, i believe, i heard through

anne makovec is live in oakland with the just-released details of this suit. anne. >> reporter: well, many of these texts were sent late at night and began with the phrase, hey, sexy. it is all outlined here in this lawsuit. it is a civil suit being brought against warriors star monta ellis. the warriors team and several of his managers, also. >> he initiated a pattern of incessant, unwanted harassing sexual texts to my client. >> reporter: that's the lawyer for former warriors staffer erica smith. this morning he briefly showed a picture allegedly of monta ellis' genitalia sent to her from a secret cell phone ellis often used to text her. >> she was embarrassed. she was intimidated. she felt scared and helpless. >> reporter: erica smith used to work in community relations until she was laid off in august. her lawyer says that was as a result of the warriors trying to cover up a scandal involving these suggestive texts. >> i was let go. >> reporter: the alleged text harassment went on from november 2010 to january of this year, for three months during last year

anne makovec reports from san mateo. >> reporter: i have to point out, we don't know if this kmart behind us in san mateo is going to be closing but when it comes to a loss of employment opportunities and shopping opportunities, there is some anxiety surrounding this announcement. >> it's been here for years. everybody knows it's here. >> reporter: shoppers and employees at this kmart in san mateo are among those at 4,000 kmart and sears stores wondering if they are on the chopping block. the sears holding corporation just made the announcement. it plans to shut down between 100 and 120 kmart and sears stores but hasn't decided which ones, leaving a lot of communities with questions. >> it will be a loss for the area, i think. a lot of good bargains here and sears. >> reporter: while the retail industry in general saw positive growth this holiday season, last quarter kmart was down 4.4% and sears was down 6% over last year's figures. sales at both stores are down year it date, as well. kmart down 1.8% and sears 3.3%. while many people still support the chains -- >> easy parking, decent pr

we go live to anne makovec who was in the courtroom. >> reporter: the sentence just came down within the last 45 minutes. you can see a crowd there gathered listening to the defense right now as they react to this sentence. the headline here is that there is no prison time for barry bonds. that was his and his defense team's main concern but he did get probation. let's look at what the judge handed out today. two years' probation, 30 days house arrest, though that is at his house in a large house in beverly hills. also 250 hours of community service and a $4,000 fine which the prosecution actually called laughable considering the size of bonds' bank account. now, the judge stayed this sentence pending appeal. that means it is not officially going to go into effect until that appeal comes in and bonds' lawyers have 10 days to make that appeal. bonds, of course, was convicted of felony obstruction of justice in april for giving evasive testimony during a federal grand jury probe into the balco steroids scandal back in 2003. this is bonds arriving in the courthouse this morning, the fed
