anne makovec is in castro valley with the latest. >>> reporter: the intersection is finally reopen. but officers were out here for much of the night. last night our crews ran into a woman who says that the suspect police were chasing is the father of her baby. >> did they shoot him? they did? oh, my god! oh!! oh, my god! >> reporter: here is what happened. an undercover berkeley police officer was in the silver car killing a suspect in the maroon car when officers were on grove way near center street. they decided to arrest him at the stop light. officers say the suspect then backed up his vehicle pinning the berkeley officer between the two cars. other officers then surrounded the cars. one of them armed with an assault rifle who opened fire on the suspect. now, another agency the alameda county sheriff's office is doing the investigating in this case because it happened outside of the city of berkeley. here's what they have to say. >> they were doing a follow-up investigation on a crime that occurred in their city which led them here to castro valley. at that time they wanted to t

anne makovec live at the scene where the robbers tried to jump the food vendor.with the latest. >> reporter: good morning. you mentioned two people injured. one of them is -- one of the robbers, and the other one is the person who was running the taco truck. he was the victim initially in this case. but he had a gun of his own, according to police and he shot back at these men as they tried to rob him here. now, this is a very popular taco truck here in oakland at foothill and fruitvale. they were closing up shop, the man who was running it was closing up shop around 1:30 a.m. when two men tried to rob him. again, a shootout ensued at that point. it looks like at least one of the robbers was shot. that man ended up taking himself to the hospital the vendor was also injured. he is also in the hospital. we don't know his condition. the other robber got away. we doesn't know if he was shot as well or injured. police have been looking for him this morning. we have seen a helicopter flying overhead. not sure if that's related to the case but it could be part of the se

anne makovec is at frank ogawa plaza with the latest. good afternoon. >> reporter: hello. there are new heads of both of those departments. the police department and the fire department. we'll get to that in a minute. but behind me here at oakland city hall you can see a group back there in front of the stairs, these are "occupiers," people who represent the movement. and they are lodging a lot of allegations right now. they are holding a press conference saying that the oakland police department has been involved in brutality, repression and they also have a lot of criticism over a new policy of stay-away orders to keep protestors away from this very area. now, about an hour and a half ago, interim police chief howard jordan was named the city's official police chief. he is a 4-year veteran -- a 24- year veteran of the force, assistant chief before becoming chief. and he has seen the department go through a lot of trouble. there was the "riders" case back in 2003 which now has it under federal scrutiny under threat of a takeover for failing to implement reforms after offi

anne makovec is in castro valley where the busy intersection was closed for hours for this investigation. good morning to you, anne. >> reporter: good morning. good news for morning commute is the intersection is open but officers were here for much of the night. that is after this all happened at around 5:00 yesterday evening. an undercover berkeley police officer was in the silver car that you can see there hailing a suspect in the maroon car when officers were on grove way near center street they decided to arrest him at the stop light. officers say the suspect then backed up his vehicle pinning the berkeley officer between the two cars. other officers then surrounded the cars, one armed with an assault rifle. >> i heard two shots from here. and then i heard two more. so four shots altogether. >> reporter: now, you can see from the doorjamb on the driver's side several bullet holes indicating where the officer was standing when he opened fire. the pinned officer did have leg and hand injuries. both he and the suspect are expected to live. the berkeley police department says they have

anne makovec is at the scene in san rafael with the latest. >> reporter: good morning. the fire is out. firefighters were able to knock to down very quickly. it happened outside of the building here behind me on rafael lumber on anderson. you can see firefighters still on scene after the fire broke out around 2:45 starting near an out building damaging the out building as well as outside storage racks. i'm here with san rafael fire chief chris gray with a little more information. now, you guys got the call after people reported seeing smoke and fire from the highway. >> that's correct. it was about 2:45 a.m. >> reporter: what were your challenges in fighting this fire? we understand you were able to keep it from the main building. >> that's correct. firefighters made an aggressive attack here. it was a second alarm fire. we had 35 firefighters on scene. anytime you receive a call at a lumberyard, you're concerned for a potentially big fire. firefighters again arrived here, they had 40 to 50-foot flame lengths above the building. and obviously some concerns to get a larg

anne makovec in san francisco with why some say there may be no case at all. she'll explain. anne, good morning. >> reporter: yeah. this is the day that a lot of people have been waiting for. at 9 a.m. mirkarimi will be here at the hall of justice, a judge is going to be selected for the trial. that judge will hear several pretrial motions and most notably among them, a filing by mirkarimi's attorney arguing that some of the main evidence in the case not be used at trial. mirkarimi is charged with domestic violence battery, child endangerment and dissuading a witness from an incident on new year's eve when he is accused of bruising his wife's arm in front of their 2- year-old son. his wife, eliana lopez, made statements on video it her neighbor ivory madison after the incident blame the bruise on mirkarimi. the lawyer says it was inadmissible as it was made several hours after the incident and meant to be used for a custody battle not a criminal trial. the filing says madison knitted to not listening very closely to her own conversation with lopez. there are also some statemen

streets are blocked off from the scene on duboce where we find anne makovec in the mission district where pg&e is working to restore power to thousands of customers. good morning, anne. >> reporter: good morning. we have not gotten an estimated time that the lines are going to be fixed. we in there was significant damage from the transformer fire overnight. you can see here on this block of duboce behind me, which is between stevenson and valens yeah, the street lights are out and power to most of the buildings on this block also out right now as pg&e tries to assess the damage and get power restored. tank a look at these pictures from earlier though. we had a transformer that exploded and was burning really like a tiki torch for almost two hours after it blew up about 3:30 in the morning knocking out power to about 2400 people here in san francisco's mission. firefighters just had to stand by and allow that to burn because it would have been dangerous obviously to try to go up and fight that fire not knowing whether or not the lines still had juice to them. so it took pg&e a while to mak

anne makovec is in san bruno with the details. the lawsuit, filed by san francisco city attorney dennis herrera, says the "u-s pipeline and recovering this morning after a car hit a san francisco house. it happened around 9:30 last night at 43-rd and balboa. the plastic wrap shows where the car hit the residence. paramedics transported one person from the scene. no one else was hurt. investigators think it will take at least a month to recover all the remains from a burila site in the san joaquin valley. they've recovered more than one thousand bones and bone fragments from sites in san joaquin and calaveras counties. most of the work is being done near the town of linden. that's where wesley shermantine and loren herzog grew up. they're believed to have been involved in a number of murders in the 1980s and 90s. ... and allegedly dumped murder victims at sites that are now being searched. shermantine provided information leading to the search sites. the remains will be sent to the department of justice crime lab for d-n-a analysis
