cbs 5 reporter anne makovec is at san francisco's fisherman's wharf where the crab boats are idle. good morning, anne. >> reporter: these things have a way of working themselves out. it is an issue of economics, the law of supply and demand. but boy, i was back here in mid- november, when the season started. this place was alive with enthusiasm and now this strike has all boats docked. no crab are being caught in the san francisco bay as we speak. before the season started, fishermen and wholesalers had agreed to a price of $3 a pound for fresh dungeness crab, a little higher than normal. last year it was $2.25. fishermen said they needed more money because there were fewer crabs in the bay and the higher price of fuel. fish brokers say demand is down so they only want to pay $1.80. now that both are idle supply is down and caught in the middle of all this people who like to eat dungeness crab. some retailers say their tanks are empty. it's the law of economics so i think it will balance out. i don't know how long that will take. it's san francisco bay that is participating in the s

anne makovec in san francisco with what could come down from a high court later today. ann, good morning. >>> good morning, if the u.s. supreme court decides not to take on the prop 8 case, same sex marriages could resume here in california as soon as the u.s. court of appeals says that they should resume. that is the court that said prop 8 was uncon city i -- unconstitutional earlier this year. but today, the supreme court is scheduled to discuss whether or not it will review the constitutionality of prop 8. that is the ban on same sex marriage california voters approved in 2008. so if the court decides to take on the issue, there would be an argument scheduled next year. >> there will then be an argument scheduled sometime in march probably, possibly april. and the case will be decided by the end of june. >> reporter: the court is also taking on several defense of marriage act cases from other parts of the country. if it decides not to take up prop 8, there's a possibility same sex marriages could resume r here in california, within a couple weeks. live in san francisc

cbs 5 reporter anne makovec is along the embarcadero in san francisco watching for today's king tidesod morning, anne. >> reporter: good morning. we have been watching the water levels rise all morning and now it's really starting to rock and roll here. i'm along the embarcadero and you can kind of get a picture of how high it's getting from looking at that post underneath the pier. you can see where it has gotten wet. the water could certainly reach the bottom of that pier by the time we see the highest tides which is going to be about 10:00 this morning. these are the highest seasonal tides of the year. check out this video we shot yesterday on the connector ramp from 101 to highway 1 in marin. that flooded. normally that only happens when there's a storm but this was caused by the king tides. these very high tides could be getting higher as the years progress and the oceans fill up with more water for really a variety of reasons. 8" more in the past century. and you can see the proof in san francisco's sewer system. >> when i came here in 1990, there was never a time where the tide

anne makovec has more on the investigation. good morning. >> reporter: arson investigators are here at this storage unit in campbell around the corner from this apartment building behind me. at 1:00 this morning, somebody reported smoke coming from that storage unit when they got here firefighters put out a small fire and found the body of an adult inside. the police won't say how that person died if it's the fire or during the fire. they are calling it an undetermined death investigation not a murder investigation. >> at this point we don't have specific evidence to call it a homicide. we are look at the different possibilities. once we get questions answered we'll be able to better determine what happened here this morning. >> reporter: unit is 6 by 4 feet detached from the apartment building part of a car pot. there is minimal damage to the unit because the fire department put out the fire very quickly. but arson investigators are here and the police are waiting for more information from the coroner as to who this person was

cbs 5 reporter anne makovec is in the newsroom with more on the impending decision. hi, anne. >> reporter: it was controversial. the cpuc deciding who would pay what for pipeline improvements. pg&e or customers. it turns out both parties will be paying and rates will increase in the aftermath of the deadly san bruno pipeline blast and fire on september 9, 2010, which killed 8 people, injured 66 and destroyed dozens of homes of. the cpuc is ruling on pg&e's enhanced safety guidelines today a plan to improve its pipeline infrastructure. the repairs will cost over $2 billion and require pg&e to test hundreds of miles of pipeline, replace old pipe segments and automate safety valves. the cpuc says of the $2 billion needed for the work, ratepayers will pay $299 million. the mayor of san bruno and several utility watchdog groups say pg&e will be making a profit on this work. >> today you set a precedent. do you allow a utility responsible for the deaths of eight citizens, friends, and family, to profit as a direct result of that tragedy? >> commissioners, i urge you to appr

cbs 5 reporter anne makovec is at the machine shop that burned in fremont. and anne, apparently the building is in danger of collapsing. >> reporter: yeah. major structural damage. they now have the building fenced off as you can see here behind me. a lot of black debris in there. part of the roof collapsed. and investigators are expected to arrive here this morning at first light to try to figure out what started this fire. so far they haven't been able to because there's danger that some of the walls could collapse. here's the video from yesterday when this fire was sending up a giant plume of black smoke. it was visible from all over fremont. fire officials say workers were doing some grinding with metal shavings when the fire broke out at c & h enterprises. the company specializes in welding parts. employees rushed to get out after that fire started at 1:45 in the afternoon. >> jay came running into the office. i could see the smoke billowing over the roof to the front and he said, call 911, we have a fire. and it just started getting worse after that. >>

cbs 5 reporter anne makovec here in san francisco now where crab boats are still sitting in port this morning. >> reporter: good morning. they are docked here at fisherman's wharf. normally they would be very busy out there catching crab. they are on strike right now and this is all over a dispute about the price of dungeness crab. the season opened back in mid- november and the problems started on sunday when crabbers heard that fish brokers were going to drop the price of wholesale crap from $3 a pound, which they had agreed upon, to as low as $1.80. brokers say that after thanksgiving, demand for dungeness dropped and they are trying to balance supply and demand. the crab boats are idle. supply is dropping. some retailers report they have no crab left. so we'll see how long this strike lasts. right now, it is affecting three areas of california. the san francisco bay, half moon bay and bodega bay, as well. live on fisherman's wharf, anne makovec, cbs 5. >>> new this morning, the duchess of cambridge has been discharged from her london hospital after being treated for acute morning

cbs 5 reporter anne makovec is along the embarcadero in san francisco watching for today's king tides. >> reporter: the king tides the highest seasonal tides. right now the water is not that high. but we're waiting for it to come up. the highest it will be this morning is going to be just before 10 a.m. with a 7-foot tied. we are going to see these high tides today and for the next couple of days. now, check out this video from the connector ramp from 101 to highway 1 in marin. yesterday that was flooded. and that normally only happens when there's a storm but this was caused simply by the king tides. the very high tides could be getting higher as the ocean fills up with water for a variety of reasons, 8" in the past century. and you can see the proof in san francisco sewers. >> when i came near 1990, there was never a time where the tide was higher than our sewer. last year we had seven events. that saltwater now is coming into our system. >> reporter: that is break the pipes down. saltwater not very good for metal pipes. now, king tides are caused by gravity not global warming. the

cbs 5 reporter anne makovec is at the machine shop that burned in fremont where it's still too dangerous to get into the building. >> reporter: we are waiting for fire investigators to show up this morning. and they are planning on doing an investigation into the cause of this fire. so far they have not been able to get into the building here behind me. check out this video from yesterday that fire sent up a giant plume of black smoke. you could see it all over fremont. fire officials said they were doing grinding work with metal shavings here at c & h enterprises when the fire broke out. employees rushed to get out after the fire started at 1:45 p.m. >> jake came running into the office. i could see the smoke billowing over the roof to the front. and he said, call 911. we have a fire. and it just started getting worse after that. >> did everyone get out? >> everyone got out safely. >>> reporter: they did issue a "shelter in place" order in the neighborhood because of chemicals in the burning building. again, there is significant structural damage. so once they're sure that the building

the cbs 5 reporter anne makovec shows us the solidarity on the docks is being tested. >> strike last year this boat. >> right. >> well, you got go fishing. nobody is making money. >> you got go fishing. >> reporter: tensions are high on pier 45 where a lone crab boat came in this morning. a strike has all of the others docked. >> we're tied up negotiating with the processors. >> reporter: it's a dispute over the price of fresh dungeness crab. wholesalers and fishermen had agreed on $3 a pound at the start of the season in november. but demand went down after thanksgiving. so wholesalers want to pay a quarter to 75 cents less. the crab boat association says no deal. >> there's not that much crab left out there. we took a big whack out of it. so it should be worth as much or more than we got paid before. >> reporter: this boat which locals call a "scab" came from oregon. >> trying to keep things going. >> reporter: in the meantime things are come to a standstill at local fish markets. >> bad for business. >> reporter: this shop has only frozen crabs in stock. alioto's has an extra tank

cbs 5 reporter anne makovec is san mateo with more. >> reporter: the fire department didn't know what they were dealing with so they did everything by the book. here's where they bagged up sand to try to keep these chemicals safe before they blew it up. this is the house where the chemicals were found in san mateo on parrott drive. the windows boarded up. it was an exercise for all of the emergency responders involved and for the entire neighborhood. the fire department got a call around 4:30 yesterday afternoon saying the person who lives this is house found a cache of chemicals in the basement that had apparently been here for more than 30 years. >> it was acid and ether. we were told they were -- something that needed to be taken care of on site. they couldn't transport it. it's very dangerous. the chance of explosion was real great. >> reporter: so neighbors sheltered in place, there was going to be a big explosion and not to worry and all clear was given at about 9 p.m. the lesson to be learned here is if you see anything suspicious in your household and property don't touch it.

anne makovec has the latest on the investigation. >> reporter: a lot of questions right now.ll and you can see the storm unit there behind me. the fire department was called here at about 1 a.m. after somebody reported smoke coming from that storage unit. when firefighters got here, they found a body inside. now, they are not calling this a murder investigation. they say they don't know how the person died. the coroner removed the body and will try to figure out what happened here at this small apartment complex in campbell. the police department is here and the arson squad will be reporting soon this morningas well, and get a little more information as far as the damage to the storage unit, not significant. it looks like structurally the storage unit is fine. they are taking the stuff out and trying to find more clues into how this person died. anne makovec, cbs 5. >>> a developing story we have been following out of siskiyou county near the oregon border. northbound interstate five remains closed after a 64-car pile-up last night. the series of crashes started around 6:30 l
