kpix 5 reporter anne makovec is in oakland this morning. a bart strike is looking more like a reality now. >> reporter: it really is. a lot of people surprised that it has come to this. they gave that 72-hour warning last night. their contract expires at midnight on sunday. bart and the two unions that work for the bart system were negotiating late into the night when suddenly those talks broke down. sticking points include the usual, wages, benefits and safety measures as well according to the unions. both sides say they don't want -- or they do want to work something out. they don't want to have a strike. negotiations are actually scheduled throughout the weekend so this might be able to be avoided. but right now, neither sideshows signs of backing down. -- neither side shows signs of backing down. >> we don't want to throw the bay area into state of mass confusion. we understand the role bart plays in the bay area. we want a good contract and a good ride for our passengers so we have asked the governor to entertain a cooling-off period.

kpix 5 reporter anne makovec is in san francisco this morning with key issues in a new assessment of how bart police do their jobs. anne. >> reporter: the assessment that he is going to do is going to all focus on this report. this is only part of a report that is 314 pages that came out in 2010. and the question today is, how many of the things in this report have since been implemented in the bart system? former police chief patrick oliver will be the man in charge of this assessment, which begins in july. oliver oversaw the original noble audit report. noble stands for the national organization of black law enforcement executives. and these are the key recommendations oliver will be looking at. organization of the system. community engagement, training, patrol priorities, the selection of personnel, employee performance, use of force, and how much bias comes into play as well as international affairs and discipline. the original report was initiated after the killing of oscar grant captured on this cell phone video which ignited a firestorm of controversy over bart police practices

kpix 5 reporter anne makovec reported from oakland. the union gave its 72-hour strike notice late last night. >> reporter: that was a bombshell that came down at about 10:30 last night. a lot of people not expecting this to come this far. the possibly looms even large they are morning of a bart strike systemwide. that could happen as soon as bart unions' contracts are up which happens at midnight on sunday. it could mean a strike for the monday morning commute. bart and union officials's talk broke down last night over wages, benefits and safety measures according to the union officials. both sides say they want to work something out to avoid a strike and negotiations are scheduled throughout the weekend so there is hope but right now, neither side shows sign of backing down. >> we understand the seriousness and the role that bart plays in the bay area. we want a good contract and a good ride for the passengers so we have asked the governor to entertain a cooling-off period. >> reporter: but bart has asked the governor not to entertain

kpix 5 reporter anne makovec is at the scene in san francisco this morning with the story of the heroho brought that bus to a stop. anne. >> reporter: ultimately, this ended in barely an injury, just the bus driver being injured, which is amazing. it's a busy intersection. it's only 6 a.m., but this was 6 p.m. a lot every drivers on the roadway and -- a lot of drivers at the road and people playing at the park. the big question is why didn't the driver of the bus hit the brake when you look at the pictures from the scene, they are dramatic. and it's hard to believe there were only mine more jurors. the bus t-boned a volkswagen making an illegal turn in front of the bus. the bus just kept going for 100 yards to the next block. passenger frank primus saw the bus driver was conscious but wasn't braking so primus took over moving the driver's foot out of the way and hitting the brake himself. >> there didn't seem to be anything acutely wrong with him. he was in shock. he just wasn't able to physically stop the bus. like he just hadn't made the decision to like put his foot on the brake or

anne makovec tells us it's likely a case of horse play gone wrong. >> reporter: the beware of dog sign outside of this home is a hobbing reminder today of the -- haunting reminder today of the death of the 6-year-old boy, playing with a group of children in the backyard when he was bitten by a pit bull. >> they probably engaged in horse play with the dog. one of them i think was trying to ride the dog like a horse. it's a large dog. and for whatever reason, the dog turned and bit the young boy once on the top of the head. >> reporter: the boy was taken to the hospital where he was pronounced dead four hours later. >> it's shocking to hear that this happened. you know? i'm a little sad for the family right now. >> reporter: this neighbor, also a kpix 5 employee, says the dog often runs around unleashed but never seemed to pose a threat. >> this is a good family. the dogs are nice. the dogs aren't kept to be fighting dogs or anything like that. >> reporter: right after the attack police say the family willingly gave the dog up. they brought it here to tricity animal shelter for rabies te

kpix 5 reporter anne makovec is at the scene in san francisco this morning.ngers are lucky they didn't get hurt or worse. >> reporter: it is pretty amazing. this all started with the car making an illegal turn here at the intersection behind me masonic and oak. at that point, the driver kept going. the driver didn't hit his brakes. he was conscious at the scene. the pictures are dramatic. hard to believe there were only minor injuries out of this. the bus was going 40 miles an hour when it t-boned a volkswagen making an illegal turn in front of the bus. it kept going for 100 yards to the next block driving through part of the panhandle park. >> there was screaming all over the park. there was children around the scene. my heart dropped. i thought that's it, a child was going to get hit. it was terrifying. >> reporter: everything -- it was very busy at this time this happened. it was after 6 p.m. rush hour on the roads. everybody did get out of the way, though. only one person was taken to the hospital, the driver for back pain. the damage to the car was exten

kpix 5 reporter anne makovec joins us live with more on that murder that just happened a few hours ago. anne, good morning. >> reporter: good morning. part of checkers drive is closed downright now. you can see the crime scene tape here behind me and crime scene vehicle where the investigation is focused right now. san jose's 24th homicide of the year. so part of checkers drive is closed off. the nearest intersection here is alum rock. police got the call at around 12:37 this morning. they got a call that a person had been stabbed. when they got here they found a man around 40 years hold stabbed several times. he was in very bad shape taken to the hospital and that's where he died within an hour. at this point, police say they have no suspects, they have no motive in this crime. but the investigation is going on. you can see the roadway closed down which is affecting about 5 neighbors standing out here this morning. >> i'm surprised. this never happened here. wait four to five hours to go home. they didn't really tell me anything. >> some are going crazy. the rest are naked. >> reporte
