kpix 5's anne makovec is there now.r was shot in the face. >> reporter: yeah. but shockingly, he is okay. in fact, he has already been released from the hospital. so it was more of a graze. this intersection behind me is now reopened, but it was shut down for about 10 hours overnight. this all started as a carjacking at around 6 p.m. this is a very busy time. it's a very busy intersection. so there were a lot of people around. a man that stole a bmw from a driver at gunpoint, antioch police spotted that stolen car a few minutes later. that's when they chased it here to this intersection in pittsburg, where the driver crashed the car and immediately got out and started firing a shotgun hitting one of the officers. here's a witness. >> i rolled up to the scene. i saw the accident. i heard the pops. just pop, pop, pop, pop, pop, pop. he was just, you know, firing at the officers. and, you know, they just start firing back. >> reporter: and the man was not hit by the officers' gunfire. he did eventually surrender, unharmed.

kpix 5's anne makovec is live where the ground collapsed and a family had reason to panic. what's the latest? >> reporter: the sinkhole is still here. this is mission street between second and new montgomery. that hole is 12 feet by 5 feet wide. it is 9 feet deep. repairs are set to begin again this morning at dawn. the hole opened up at 5:30 last night. and the suv partially fell in. there was a family inside. and rescuers say they had to be strategic about how to get them out. >> people had to stay inside to make sure the weight didn't distribute unevenly where the car would fall further into the hole. >> reporter: it was a very precarious situation but crews eventually got ropes around the vehicle and pulled it out towed it away. they now have to figure out what caused the sinkhole. it looks like it was possibly a broken sewer line. it was a brick sewer line down there that dates back to 1875. live in san francisco, anne makevoc, kpix 5. >> how long will the road be closed? >> reporter: the road is going to be closed through at least today so at least until tomorrow morni

anne makovec is live at the scene in the bayview. anne? >>> we begin with some breaking news. a deadly shooting involving san francisco police. >> anne makovec is live at the scene in the bayview with more. >> a 27-year-old black woman has been shot and killed by san francisco police. they just started re-opening some of the roads here. this is in the bayview in san francisco. this woman was shot one time by one officer who only fired one shot. the confrontation taking place about 9:45 a.m. police were out looking for stolen cars at the time and they found one on elmira street where it dead ends under 280. officers tried to talk to her. they say she tried to drive off. at 100 feet away she hit a truck. officers approached the car and the police chief reports what happened next. >> we have one witness that says that there was a back and forth with the vehicle, with the officers moving about, at some point in this engagement, one officer a sergeant fired one shot striking the suspect. >> reporter: officers got her out of the car. they performed cpr. but she died at san francisco

kpix 5 reporter anne makovec on how one of the biggest property owners in the city went unpoliced for years. anne >>> reporter: the academy of art is a very powerful entity here in san francisco and behind me is one of 22 buildings that the city says the academy has illegally turned into either classrooms or dorms. and that takes housing in san francisco off the market. the university is the largest for-profit art school in the country and one of the largest property owners of the city occupying 40 buildings. the head of the planning department admits that the city has allowed the academy a few breaks when it comes to the permitting process and the city attorney says it has to stop. >> here you have a politically powerful entity, one that has vast economic and political resources at its disposal, that is treated differently than the average homeowner or business owner. >> reporter: now, the fines have been piling up against the university. they have been unpaid for almost 10 years potentially in the millions of dollars. in the meantime the academy is working on environmental impact re

anne makovec reports. >> reporter: we have been talking about a lot of these bills for years.ct, the governor has previously vetoed a couple of them. this morning they are up for a package vote in the senate aiming to tighter already strict gun laws. one bill would require background checks for ammo purchases. another mandating a person to get a state serial number before making a gun. a bill requires the report of a lost or stolen gun within five days and two measures aimed at large capacity magazines prohibiting the possession of any that hold more than 10 rounds. and cracking down on detachable magazines, the so-called bullet button. >> these guns we're talking about, guns like the ar-15 and other assault rifles like it, were designed specifically for modern warfare. they were designed to kill as many people as efficiently as possible in a short a time as possible. >> many of these measures are also included in a gun control initiative that is proposed by lieutenant governor gavin newsom for the ballot in november. and that's where politics could really come into play today

anne makovec has more on the incident and what started it. >> reporter: you can see the bullet holes there in the door where a father and two brothers were shot last night by police. this was the scene just after 9 p.m. last night when three family members were being loaded into ambulances on kingsley drive. >> officers reacted as they were trained. >> reporter: it started with a mother's call to 911 about her 20-year-old son rigoberto gutierrez pointing a gun at family members. those family members were standing behind this locked security screen door when police showed up to confront rigoberto. >> giving commands to show his hands. he did not. he immediately reached for the firearm. >> reporter: they shot at him at least five times hitting him in the leg and through the door accidentally hit his father in the torso and 17-year-old brother in the leg. >> they were struck as a result of his actions. >> reporter: all three are expected to survive, the brother facing charges of assault with a deadly weapon. >> when the suspect is released from the hospital he will be transported to cou

kpix 5's anne makovec joins us live from san francisco to explain why a long dispute has gone a step further. >> reporter: dispute with the academy of art university. this is the civil suit filed today in san francisco superior court. it says that the university was running a, quote, real estate scheme for profit and that it flagrantly ignored and flouted zoning regulations. >> academy of art is an egregious land use scofflaw and its defiance persists at the worst possible time for our residents. >> reporter: it's the largest private art school in the country, occupying 40 san francisco buildings and city attorney dennis herrera says at least 23 of them are being used illegally for things like offices and dorms, violations that have been ongoing for 10 years. >> the scale of aau's defiance has been breathtaking. >> reporter: the planning department admits it's given the university some breaks over the years, most recently to finish an environmental impact report that is already five years behind schedule. >> when you have parties as you do in this case that want this resolved, you do

anne makovec is in san jose with more on the subject. anne. >> reporter: yeah.it was a hit-and-run. the suspect booked this morning here into the santa clara county jail in san jose after a search that went on for three days. this saratoga family is missing two members tonight, dogs sadie and chudley were euthanized after being hit by a truck. 42-year-old christopher was arrested this morning in the hit-and-run of the dogs. >> i don't know how that man or whoever did it could sleep. >> reporter: anne peter was walking her dogs when a truck hit them dragging both dogs and anne as she held the leash. the truck was caught on surveillance video as it left the scene but the license plate was obscured. flyers were posted and a sign asking for clues as anne's husband tried to spread the word to the neighbors. >> then he ended his story with his wife getting hit and her dogs being killed. >> reporter: the dogs were put do

kpix 5 reporter anne makovec on how one of the biggest property owners in the city went unpoliced forrs. anne >>> reporter: the academy of art is a very powerful entity here in san francisco and behind me is one of 22 buildings that the city says the academy has illegally turned into either classrooms or dorms. and that takes housing in san francisco off the market. the university is the largest for-profit art school in the country and one of the largest property owners of the city occupying 40 buildings. the head of the planning department admits that the city has allowed the academy a few breaks when it comes to the permitting process and the city attorney says it has to stop. >> here you have a politically powerful entity, one that has vast economic and

kpix 5's anne makovec on the major sticking point with the measure. >> reporter: right now, signatures are being gathered in an attempt to get this measure on the ballot this november. but its fate is first in the hands of the court. governor jerry brown's plan is meant to reduce the state's prison population. his ballot initiative would relax strict sentencing standards making it easier for nonviolent offenders to get paroled. but challengers say it's the way the governor went about it that could be the measure's undoing. >> the governor has basically hijacked an initiative that had been filed previously. >> reporter: he attached his plan on another initiative, one that would take away a prosecutor's discretion to try teenagers as adults. a lawyer representing a group of california district attorneys sued and in february, a lower court ruled that the initiative had been improperly filed. >> we don't think the voters were given an opportunity to even comment on it in the beginning of the process. >> the amendments were hidden in plain sight. they were posted on the attorney general's w
