kpix 5 reporter anne makovec is live at the scene with the very latest. anne. >> reporter: this fire has been burning for hours. you can see what's left of this building behind me. i'm at adeline and west macarthur. this is the frame of the building that was supposed to eventually be a condo mixed use building. it was under construction. five stories tall, this is very close to the oakland-emeryville border. the fire started at 2:30 this morning and check out the massive flames! drivers reported seeing this fire all over the east bay. it's very close to the macarthur maze. you can see it coming from several bay area freeways. flames were towering into the air. even the construction cranes were on fire. there are other condos and apartments in the area. some of them have been evacuated this morning. firefighters are really fighting this fire in defense mode. they are trying to prevent the fire from spreading. so far, they have been able to do that. but neighbors are without power and water. >> as soon as i realized it was this i knew it was probably going t

kpix 5's anne makovec is live on the phone with more on this five-alarm blaze. anne. >> reporter: firefighters are making progress on this fire. it's been burning since 2:30 this morning in a building under construction. we understand it was a condo building. it was going to be a condo building. but it is destroyed at this point. there are still a lot of hoses up there, ladder crews spraying water on this fire at all angles. the flames were leaping into the sky for several hours. in fact, a lot of our viewers called saying they could see it from several of the bay area freeways. basically this is very close to the macarthur maze close to the oakland-emeryville border. the address is on 40th and san pablo but there are other road closures in the area, as well. there's smoke pouring off the building blowing northeast right now towards berkeley and oakland. we have heard of evacuations but that's unconfirmed. no injuries reported yet. they will have to figure out the cause of the fire. this is one of those things a building under construction and the frame is up but

kpix 5's anne makovec is live in our newsroom to break down the renter protection act heading to the november ballot. >> reporter: the oakland city council approved two proposals this morning that would limit rent hikes. it is the voters who will have the final say in november. but there is widespread support. a lot of the debate is centered around a stronger rent control would actually slow gentrification in oakland. long-time renters say they are being price out under the current rules and need new protections but opponents say the new laws unfairly tie property owners' hands in a city that's now the fourth most expensive rental market in the nation. >> many owners that we talked to on a daily basis are saying we're getting, you know, 20 to 30 to 40 applications on one unit. >> the new rules would require landlords to petition for rent hikes above 10% a year. that's instead of having tenants petition against them. there are also new limits on the amount property owners can charge tenants for capital improvements to a building. the proposal also spells out strict standards under whi
