in a rare move, justice anthony kennedy incorporated black-and- white photographs into his written opinion the images of crammed sleeping quarters and walkways depicted what he referred to as "violent, unsanitary, and chaotic conditions" in california prisons. marcia coyle of the "national law journal" was in the courtroom, and joins us now. marcia, this is an old case. what was the original complaint and what were the petitioners asking of the state of california? >> well, ray, this case stems from two class action lawsuits. one filed in 1990 involving substandard care for prisoners suffering from serious mental illnesses. the second lawsuit filed in 2001 generally for deficient medical care for prisoners. the lawsuits claim that these conditions in the prisons violated the 8th amendment's prohibition on cruel and unusual punishment. >> suarez: justice anthony kennedy was the lead writer on the majority opinion. what did he and the other justices conclude? >> well, the issue before the court was whether a special three-judge court, lower court here, correctly applied the federal prison re

it was a 5-4 decision written by justice anthony kennedy who joined the court's four liberals in sayingy was necessary because the overcrowding was causing needless suffering and death. kennedy wrote a prison that deprives prisoners of basic sustenance including adequate medical care has no place in civilized society. now, this case produced an extraordinarily heated debate between the conservatives and liberal justices, and dissent justice samuel alito said the court was, quote, game building the safety of the people of california. he added, i fear that today's decision, like prior prisoner release orders, will lead to a grim roster of victims. now justice alito referenced a smaller release in philadelphia back in the 1990's that resulted in thousands of rearrests and almost 10,000 new crimes. but justice kennedy downplayed that threat to the public, he said that was overblown and suggested that the state of california could take up to five years to cut the prison population and could also decide which inmates they were going to let go. kennedy acknowledged that even doing those things

monday's 5-4 ruling comes with disturbing details of inhuman conditions, and as anthony kennedy put ito in the "big breakdown" we wanted to give you perspective on the complicated issue. california has the nation's largest prisons. the state prisons were built to hold 80,000 inmates, but the prison population has increased by 70% in the last seven di cades, so according to the numbers of the state department of corrections more than 152,000 inmates are in state prisons. officials say this is typical, and open spaces meant to be gymnasiums and clinics were transformed into crowded encampments stacked high with bunks like you see there, but the prisoners are stacked three deep in 6 by 9 cells designed to hold one. and so "the new york times" says that justice kennedy talked about prisoners held in telephone-sized cages without toilets. the state has a two-year window to shrink the population by more than 30,000 inmates. state officials have two weeks to submit a schedule to do that. so how does california go from here to minus 33,000? well, the officials have not fully explained how thei
