apple versus samsung. who has the edge? >> you know, apple has the edge.t is probably, believe it or not, this could be hundreds of billions of dollars at stake. if they win this and not a patent attorney, but neither are the jury members. they would then go after all phone makers. gerri: watch out google, here comes to if nobody could compete with them on price either -- that is really where it's coming in, if they had to pay a 40 or 50-dollar fee to apple that said that they wanted it originally, their prices would never be lower than the apple ipod or iphone. at that point, people wouldn't pick them and it would be -- apple could be well over 8 billion-dollar company. the number one area in desktops and laptops and ipods and iphone. gerri: just adding, this is going to go on forever because everybody is expecting it to. this case will not be done, even when it is done. i want to bring in an attorney and expert on these issues. i know you are watching this closely. tommy, what is your intuition here. who has the edge in this? everybody is suing everybody

apple obviously helping yet again. go more to apple. cnbc shining a light on america's favorite stocks. we crunched the numbers for the top performing and widely held stocks in the u.s. this hour we're looking at the new market cap king apple, which just became the most valuable stock to ever have traded. brian marshall analyst spoke to apple cfo and joins us on fast line. welcome to the show. >> thanks. >> you must be in the know if you talked to the cfo. a lot of optimism about what's coming down the pike. what can you tell us? >> obviously apple is a secretive company. we definitely expect the iphone 5 to be coming out in a month or so. i think it's rumored we'll get the launch or introduction on september 12th. my view it probably launches on that last weekend september 28th. obviously they are going to be penetrating the tv market as well as perhaps top spot. there's a lot going on and i think the company feels confident in its position today. >> apple gets the iphone's 70% of profits is what theim phone accounts for. you cannot di

for apple? >> we look at apple tv like a long-term call option on the company. it's more important for us in the short term what iphone and ipad units do. apple has done a fantastic job of disintermediating and making it larger and larger. if they can partner with cable providers or media content guys much in the same way they did with the record labels, we think it can help the company longer term. but short term, we're more focused on ipads, iphones and their continue to take market share there. >> what would be a more richly valued option? >> if you think about it thematically, we like to think apple's done a good job of getting into these channels much like they did in the record industry saying they want to provide a new way to do old things. i've never met anybody who likes their set-top boxes and the interface therein. at ridgeworth management, we look for those companies who can really find ways that disrupt their markets and get pricing. so apple probably -- they've always had the apple

lawsuit against samsung which apple won.will talk about that later in the show. but it was managing to pull the entire nasdaq sector positive although that might go down. who other stocks was -- what other stocks was it pulling positive? >> nokia most actively traded stock here at the new york stock exchange but also saw research in motion surge, google of course and its android rival operating system definitely with down arrows today. tracy: we've been talking about all day about tropical storm isaac shutting down 78% of oil output in the gulf. >> we're seeing a mixed reaction among the refiners. valero also got hit with with the explosion in venezuela over the weekend still continuing into today, that stock surging to an annual high today. david: and usually when oil is up, the

apple is the greatest example of. this they have $117 billion as you said and by the way, they make a billion dollars more every week. >> gee. >> now you can see this is a glass half empty issue, a glass half full issue, but at some point you have to decide what are you going to do with all of this money? are you going to give it back to shareholders? are you going to buyback shares and by the way, they are doing both of those things and still have all of this money lying around, and so the question becomes, is there something that apple made need to do in the future with the money to try to help iterate and innovate at that company and by the way people think of internally inventive and that is just that they are not, but historically they have gone outside of the company to buy many of the most interesting, innovations, the question is, should they own their own network? >> this could become, if the thy did it right, they buy sprint for 13, $14 billion today and that sound expensive but cheap on a relative basis whe
