apple is not going to relent. they certainly do not look look -- do not want to look like they are going to relent. another big story we are watching -- national security agency scoring a key win in court after a series of setbacks over surveillance program. today, a federal judge in new ruled that the nsa possible collection of telephone data was not only legal but could also prevent future terrorist attacks. the judge writes that the blunt tool only works because it collects everything. the aclu is appealing the ruling. this comes 11 days after another federal judge said the collection probably violates the constitution. our chief washington correspondent has been following this one closely. what can you tell us in terms of how this is being received in washington right now? >> it is not a total surprise. different judge, different outcome here, but we have had several judges weigh in on these surveillance issues, and they had taken different views. the consensus in washington means this will -- the consensus in

he thinks that apple has a beautiful, beautiful chart. check out lange's version of apple.his view the stock is resting at a spectacular 10% run on strong volume. it took place over just eight trading days. now, look at the moving average convergence/divergence indicator. that's the bottom of the chart. this is a tool that technicians use to track changes in momentum or trajectory before they happen. with apple it is in positive terms since the stock broke out in september. it just made a bullish crossover where the black line crosses above the red one. you can see that. black over the red. you see, this bullish mac-d crossover, this thing right here, that's about as close as can you get to a neon sign that says buy, buy, buy. the rsi at the top of the chart is in very positive territory. this is a momentum indicator. it's just the line that apple could be resuming its place as a market leader. once it took out this is when it really started taking off. that's the momentum indicator. apple is only up 6 periods of the we're. it could be time for the stock to play catchup for

we'll start with apple. what can i say about apple?he stock is up less tan 3% for 2013 and the stock is up 25%, but apple bottomed over the summer when it dropped under $400 briefly. and since then the stock has come roaring back. i think apple could be an incredible holiday play for this year. i think the numbers are way too conservative. i think the stock is ridiculously cheap and if you buy it here you're still benefitting from low expectations, too low in my opinion. beating expectations is the quickest way to drive the stock higher. with demands for the iphone 5s or the ipad air all which sport an excellent new operating system and the software is way ahead of the competition and i think the company can give sales a nice boost and despite the fretting, apple hasn't lost its edge in creating high-quality, elegant, functional devices that we'd like to get under our christmas trees, and the software behind the iphone operating system has taken the phone to a whole new level, which you would recognize by the way within five minutes or

they do make the apple devices. apple is their largest investor. apple has only been a client for about one decade. they are investing in this incubator. that is going to be one of the major points, that it is going to be an incubator, so they want to bring in new ideas and grow those ideas, and they want to bring it to taiwan, and they want to be able to offer the technologies. there is a lot of technologies involved in things such as wearable devices. we know they are involved in the google glass project. we want to make sure they have the technologies available to offer them to companies like google or apple or microsoft, and those companies that will be developing in the future, so that will be key, offering extra things to their clients going forward in the future to keep up the profit margins, because in pure manufacturing, the margins are not that high. >> some sort of wearable device, what does this mean for apple? is this a conflict of interest? >> yes, at first, people would think so, and the chairman of foxconn in june this year at the a

it is a great deal for apple. finally, they will be able to get access to china mobile's 759 million subscribers. the problem is, a lot of analyst of the to realize it, only about 20% of their subscribers actually use three g. the vast majority still use the outdated two g service, so it's going to be very difficult for apple and china mobile to convince hundreds of millions of consumers to leapfrog and skip over using three g and go straight to the 4g system. it must work on a 4g. it hasn't really been released yet. they are hoping the technology will come out by the end of the month in the inner ring area. that would be like saying you can have four g services in downtown manhattan. in greenwich village. a lot of consumers will take a wait and see attitude about whether the system is stable because china mobile has been criticized and whether prices on the data packages are reasonable or not. it is good for apple but it's not going to be that 20 million handsets a lot of analysts are estimating. >> he says only

china mobile says it has no deal with apple just yet.g into what is taking so long next. ♪ >> welcome back, i'm emily chang. it turns out apple and china mobile, the largest mobile carrier the world do not have a deal to announce. no deal has been reached and the talks are ongoing to add the iphone to china mobile's service. the deal with china mobile will add 750 million customers. it could mean billions of dollars to apple. i started by asking why is this taking so long? >> certainly, there has been a technology factor, 4g is not available in china until recently. >> but they just got a license. >> users can take full advantage of the iphone service. speculation is that china mobile is the world's largest carrier. they are the largest carrier in china by far. they might've been in portable to deal with. you have a clash of two titans. they're trying to get at this agreement. eventually, the deal will happen. it is a matter of getting to the details. >> what are the details? >> this has to do with the economics. we've seen china mobile
