we should approach health care reform in the same way. we must specifically target reforms at what ails our system. do no harm to what is right about it. in fact, p about our health care system is in very good shape and we should make sure those aspects are strengthsened, not eliminated. currently $250 million americans have health he insurance, the majority through private insurance and polls show they are overwhelmingly pleased with their current coverage. second, america is home to the high of the quality and most innovative health care in the world. now, you don't have to take my word for it. ask the saudis receiving care at johns hopkins, the canadians at the mayo clinic or the british at mass general. or ask the committee that awards the nobel prize for medicine. over the past 25 years, the vast majority of honored researchers have been americans. so what is the diagnosis for what ails our health care system? the problem for which we must provide a remedy. in a word -- cost. we spend a colossal amount on health dare. over 15% of our

we need to talk about a comprehensive approach but it seems to me that any kind of comprehensive approachis going to have a combination of carrots and sticks. senators have asked for a plan, asking for concrete progress. they called for benchmarks. they have asked the administration not to rule out further punitive actions, more muscular steps in our approach to the national government. what is your response? >> i will give you example. we have 12 areas where we have major goals in implementation of the comprehensive agreement. we started with 12 hours a day meetings in washington. we expanded to the final two. we have agreements on those 12 except for the senses and i talked to the leadership on both sides and resolve that at a political level. there are benchmarks, timetables and i would be happy to share with you all of those agreements that were made not because of us but because we created the environment so that the two parties could make the agreements. that is the way i see our role, to be able to create the environment, to help push in areas that we can push, to use the leverage

can you explain what the difference is between their approach and your approach? >> there are a group of charter school operators who figure out a way to get young people who are 3 years behind, four years behind academically and catch those kids up over time. they do heroic work. if you if visit any of those schools you walk out and said those are heroes and you would be 100% correct. what i am trying to do in our schools is eliminate the need to be a hero. if we know the communities, the zip codes, the census tracts where kids, for the last 50 years, have been three or four years behind by the time they enter a great, wide to get them four years behind, why don't we get an early, get those kids on grade level and never let those kids get behind? that to me is the way we ought to be approaching this issue so that there will always be a need for these heroic programs. but it shouldn't be a neat that outstrips our ability to provide the solution. achievement first, and commons schools, this serving 1-100, some kids getting help but the vast majority of kids are not

your approach to being on the bench? >> senator leahy, yesterday many of the senators emphasized that the values they thought were important for judging. and essential to many of their comments was the fact that a judge had to come to the process understanding the importance and respect the constitution must receive in the judging process and understanding that that respect is guided by and should be guided be a full appreciation of the limited jurisdiction of the court in our system of government, but understanding its importance as well. that is the central part of judging. what my experiences on the trial court and the appellate court has reinforced for me is that the process of judging is the process of keeping an open mind. it's the process of not coming to a decision with a prejudgment ever of an outcome. and that reaching a conclusion has to start with understand in what the parties are arguing, but examining in all situations carefully the facts as they prove them or not prove them, the record as they create it,

and in the past, that has not been the way we approached it. it's always been piecemeal. from both republicans and democrats, and i think i applaud the president with the desire to do this. my concern is the rush to do it. too fast, too much, too soon. we are not going to get this done effectively and well in the next 10 days. i don't think anyone in this room believes that and i know the people out in america don't believe it. and what will the bill look like? what kind of health or do you get for something that's done in 10 days? when it took a year and a half for them to put the medicare system in place in the 1960s. a year and a half to put medicare in place, and were going to revamp the entire nation's health care system, one fifth of our economy, in 10 days. in 10 days. amazing. and so i think we all need to stop and get serious about what we are confronting here, and stop playing this washington game of russian roulette, if you will, with the livelihood and businesses and health care of our communities. >> wasn't as all dedicated in the last election and your side

to the strategic approach to the u.s.diplomacy, does it depend on all the money and the budget you all you know all put forward and give these countries in there but especially in the middle east, people after the great speech of president obama, that what secretary clinton has mentioned this morning about engaging other countries that don't agree with you, that -- that success of this diplomacy would depend a lot on how much the u.s. administration is going to depend on the value of america and the principles of america and the international legitimacy. so how much of that is going to be part of the new strategic approach of diplomacy of the united states when it comes to implementing these principles and values in the middle east and not that the dependence on only the alliances with israel that is bothering and igniting the trend of violence in the middle east? >> well, i think the question of how we intergrate the values we embrace and we champion and what we do when concrete policies, both diplomatically and developm

. >> it is and that's john robert's approach and style and i think you and i talked about this a couple of terms ago when he was wanting to take a more cautious approach and decide the case on a narrow basis, he was going to do that. a great example of that. the court ruled narrowly, 8-1, saying that the small towns and municipalities mainly in the south could try to get out from under some of the restrictions of the voting rights act, 40-year-old act, things changed obviously, but they didn't declare it unconstitutional, they got eight votes for that. and that proposition, roberts took a more narrow approach in that case ands a result, as the court spoke with the more unanimous voice and the main person who wasn't really deciding that case was justice kennedy. you know, if you're 5-4, anthony kennedy is going to be deciding on the cases, but if you do it on a more narrow way, you're not going to have that swing vote casting every decisive vote and have an outcome like the voting rights case like john roberts got eight justices to degree and with the result that i think conservatives ar

>> well there are two approaches we can try to amend the current bills that are in congress and that is a possibility, or there are other approaches that are completely bipartisan and introduced and actually score well according to the congressional budget office. they save money and they cover everyone. one of these is called the healthy americans act introduced by ron widen and bob bennett, another approach is the one sat former senate leader tom daschle came up with bob dole so there are other alternative approaches that congress should be allowed to consider but if we are just amending the current legislation it is important we get into the details and make sure they work in every state in this great country and there are ways to do that because there are excellent models of healthcare delivery all over the country, places like the mayo clinic that do a superb job almost each one of these states has an outstanding model and if we just allowed them to grow more and as the president says repeatedly if we can just make health insurance more available for everybody i think it is goin

this time, they chose an approach that thought would be more effective. the problem is, when you get into the details of any sort of plan, people will start to pick at it and have concerns about it. the thing is, people understand this has to happen now. the timing of things with the next election coming up, this is one of the best opportunities they will have. there is a great amount determination to get it done, even if it means pushing into the august recess. >> are
