these were the cornerstones that we presented to you in april. this is the lens we look at when we are talking about examining the project. sustainability is key in the project. it has been recognized for sustainability. parks and recreation, there is a host of new parks to smaller neighborhood parks that we thin are -- think are key to making this a vibrant community. and the creation of new jobs, both permanent and construction. the development program has not changed. this is primarily a new residential neighborhood with a thousand new homes, -- 8,000 new homes. 500 hotel rooms, 450,000 square feet of new retail in existing buildings. the process we have gone through has been long. congress and the president selected ti for closure in 1993. it is basically a single-use development agency. 2000 and 2002, and we selected our development partners that have been instrumental in developing this plan. in 2006, we got an initial term sheet and development plan to improve the board of supervisors. in 2010, basically as a response to the economy, we is

those i anticipate will come to you for approval at the board meeting in april. the report on page three also has an analysis of prop k allocations to date which i find rather fascinating. as you recall, we went through an exercise of prioritizing what should be programmed in prop k over the next 5-10 years. so we came up with a programming capacity of about $412 million for fiscal years 2010-2011 and 2009-2010. of that $412 million, only $288 million has come in and been allocated. in other words, eligible departments have left $123 million of prop k capacity on the table. so, our allocation records so far on average is about 70% of our capacity. i am not sure how much more to say about this right now, but my initial conclusion is that we may be looking at perhaps a delay in the date when we need to issue debt because of this dynamic. a couple of final things. a very, very important announcement, commissioners. the president's draft budget, which was released yesterday essentially on the transportation side includes $30 million for the bus rapid transit project.

the problem i have with that letter is it was addressed at the police commission on april 28 as well as may 12. i printed the abstracts from the police commission's website of both of those meetings, and have extra copies available for the board and for them to review if they desire. the primary concern there is that the letter issued by the then-captain of the police station raises significant concerns regarding public safety. unfortunately, those are not based on statistics or facts that were presented to the police commission. they do not bear out when that information is analyzed. if you look at the police commission abstracts, it is clear from the face of them what is going on. in this situation, i think the best thing for the board of appeals to do is to not adopt the findings in front of it and to reopen the hearing before it so you can actually analyze the corporate evidence and go forward from there. i believe you have had submitted to you a letter from police commissioner petra de jesus. there is a member from the public that will read it to the board. commissioner peterson
