it's an honor to be here to celebrate arbor day with you. this is an okay to celebrate our trees, in 4,000 open acres of our city we are able to enjoy and benefit from over 140,000 trees and a couple interesting facts on arbor day, there are trees and responsible for the creation and monterey pine and different types of trees which you can find in the panhandle which was a laboratory to find what best trees can grow and they settled on those three specific trees. what i would like to say and i can thank another partner mohammed a friend of the forest who cares for the city so well. i also want to give a big shout out to the men and women who take care of our trees, the gardeners, laborers. mary, i would like to end, did you read the book about a tree that gives and gives to a person who started out as a young boy and all throughout life he came to visit that tree and took a little bit from that tree until the tree had nothing left to give. i think you and your sister have given so much to this city and have contributed to its spirit that the

i stand before you as the vice president of the arbor association and the issue i want to talk about is the premature of the fees as a result of the ordinance passed by the board of supervisors. it clearly states that the marina increase in rent will not go up until the project is declared complete and i have a copy of the ordinance if the commission would like to see it. the language is clear and states "the west harbor in the year 2012 [inaudible] completion of the renovation as certified by the general manager whichever occurs later." now, when i asked certification in writing the best that the plark -- or that they could produce is a statement march 13 which it is declaring substantial completion. anybody familiar with construction knows that is not complete. the anticipated completion date is march 31. however, this one document and i am happy to provide this as evidence as well doesn't certify as complete by the general manager. it's a premature application of the rates and for my berkt it is $500 more and under the ordinance. i would like to bring your attention to that and re

we did have a concern about taking him to the mount arbor hospital because the victim police officer was there. it would have presented a major security concern for us. i think that played a role in the decision. but they detoured not too far over. >> the decision not to read him his miranda rights even though at one point you see him getting out of the boat, in that picture he is conscience. how did that decision come about? >> this is a federal case involving a terrorism situation and i was not aware that in the federal system there can be a removal or a discontinuation of miranda rights in emergency situations. so that's exactly what happened. the united states attorney's office advised us not to administer miranda rights. we gave that information out to our officers and i think all law enforcement was operating under those rules of engagement. >> back to the apartment real quickly. there were devices found in the apartment but you can't comment on what? >> no, i didn't say that. i can't comment on any evidence that was found there. sglp anything that was found in the apartment. a
