areva, good morning. what can you tell us about the suit?personal injury lawsuit. this woman is claiming on her very first time of going to soulcycle which is this high intensity cycling class, that she suffered very serious injuries. she is claiming the instructor knew it was her first time, but despite that, he increased the intensity on her bike. she became ill, had to be hospitalized for one week, and now she is claiming permanent muscular injuries, and she is seeking personal injury damages. >> so she says she was permanently injured. does she have a case or just a case of people need to know their own limits and when to dial it back? >> this is going to be a very difficult case for her to prove. first, there's the issue of causation. she has to prove that her injuries are related to that high intensity workout, and next there's the issue of waiver. in most cases when you go to a gym or you take one of these classes you sign a release of liability, a waiver which prohibits you from suing the gym. so very important lesson for anyone taki

areva, how unusual is this courtroom scenario?ause you have a federal capital murder case, very complicated case, even for lawyers, particularly lawyers that don't have specific experience in capital murder cases. so to have an individual with no legal training, no expertise, representing himself is highly unusual and you hit on one of the salient points here, that this shooter, this murderer will further humiliate, demean these family members, the survivors who will have to give testimony during this trial and not just face roof as a defendant sitting at a table, but actually have to be questioned by him and have to confront him to discuss the most painful thing y can ever imagine that has happened to them. this is going to be an incredibly emotional situation for the family. >> karen, the judge said that dylann roof, he found him to be, quote, highly intelligent as -- is he intelligent enough to be his own attorney? >> absolutely not. people who are autistic are highly intelligent, that doesn't mean they should be attorneys and

legal analyst, areva martin joins us. and areva, incomprehensible.tem was caffeine. >> this is such an unusual case you have this driver on a freeway and this officer saying he was allegedly swerving in and out of trarveg. he gets arrested. he is charged. there's a breathalyzer that's negative. he has two toxicology tests, both that are negative for alcohol and any controlled substance. yet he's arrested and he's charged. he faced a pretty substantial bail and now he has to face trial for these charges. and the only thing found in one of these tests is caffeine was in his system. so this is going to be a really difficult case for a district attorney to prosecute because the vehicular code doesn't include caffeine as a controlled substance. >> i wanted to pick up on that. we don't need to weorry about driving with coffee? because paula would be a repeat offender. >> i would be in jail. >> yes. >> which he might enjoy. >> we don't have to worry about this. >> no, i don't think anyone has to worry about having their fifth, sixth or even tenth cup of cof
