as you say, ari, this is an unusual situation. we typically see these kinds of clashes or at least we saw these kinds of clashes with the trump administration being inter-branch conflicts, not necessarily intra-branch conflicts. that's quite different. we have to deal with the fact that, although professor katyal has laid out what should happen, this is a situation where the members of congress if they are subpoenaed will not comply. they might light the subpoenas on fire to make a true spectacle of it. what happens when you have that recalcitrance within congress? it's something i think courts will have to take seriously. this kind of negotiation between the branches is what we typically see. we didn't see that during the trump administration. we saw it removed to the courts. we'll likely see that here. there are larger issues at play besides the oversight issue. >> it also brings us to how the courts have to deal with many aspects of this. i wanted to deal with another part of the prosecutions we're seeing, people who trespass v
