in arkansas, it was not a driving factor in the polls. >> it wasn't in arkansas. in the republican party on this issue -- and even you have expressed a certain viewpoint that would -- you know, personally, it sounds like you have supported the idea that exceptions should be placed around cases of rape and incest, even though when you had an opportunity as governor to prevent it, you did. you signed a snap back bill. how do you look back at that decision now, especially given how mobilizing this issue seems to be, you know, broadly? >> it is challenging, and the debate will be state by state of what the exceptions are. in arkansas, it's the life of the mother is the exception. that does not include rape and incest as exceptions. i disagree with that. i think that rape and incest are appropriate to be accepted from abortion prohibitions. i did sign the law because i sign pro-life laws, and in arkansas, it's one of those unique states where a governor's veto can be overwritten by a majority. it passed overwhelmingly. i signed into law to protect the unborn. in the fu

the state of arkansas would restrict it as well. getting a lot of opposition from people who say the government has no business meddling in the medical affairs of individuals. what do you say to that? >> well, the government has a responsibility to protect the citizens of our state. and in this instance, we are protecting the children of our state. you are spot on that these other countries have already blocked those. fda, president biden's own fda would not approve these. and so it's important that again, we focus on the children, we make sure they are getting whatever mental health treatment they need, other issues that they may be combatting such as anxiety or depression, all the medications are available to that. what is not available is for these adults to help these children and facilitate a permanent life altering decision they may live to regret. at 18, if the same child wants to make the decision they are allowed to do so under the law in arkansas. >> john: we will continue to watch this court case, 8th circuit court of app

and it's allowed in arkansas. so, that standard is out there, based upon a constitutional principle. so the federal legislation made it clear, perhaps, and so it wouldn't -- it's not going to change what we have at arkansas and i certainly support the continuation of the recognizing of that constitutional right. >> but that's what people said about abortion and then there was dobbs. you're a lawyer, you have a j.d. and this court, alito's decision said the substantive due process right isn't there. and that brings into question whether all of these substantive due process right isn't there. so couldn't that same theory be used to try to overturn -- >> perhaps but judge alito also said don't read into this that you're going to overturn the other decisions related to same-sex marriages. >> except that wasn't the law, right? that was just dicta. >> he said it in a decision certainly. certainly, again, theoretically. so the legislation was passed in the senate yesterday. i have no issue with that. they wanted to ensur

we see it, some in arkansas as well. we get a lot of red . >> you will be moving to northwest arkansas. does that mean that pennsylvania, which is already hard for a republican to win statewide, does that michigan, wisconsin, does it make it that much harder if the people that are more conservative are leaving in droves because in the case of michigan, you know, draconian lockdown's and high taxes? >> well, i don't think those states are beyond our grasp. we certainly have some disappointments in those midwestern states this weekend. but as president trump showed in 2016, as some of the gubernatorial candidates showed in the twenty teens as well, we can still win those states even if they are having some outmigration. the sunbelt states , i think the republican party, as we broaden our coalition, as we attract more working class americans, more americans are fed up with the cultural and social radicalism of the democratic party are going to continue to give the republican party more looks . and i think we can win those e

guest: yes, arkansas is one of the states with a marijuana measure. there is also states asking legislatures, asking voters to allow them to call themselves into a special session. so a lot of states let that power only reside with the government. because of the 2020 pandemic and responses to it, some legislatures wanted to take action and cannot call themselves into special session. so we are seeing, i think, three measures related to that this year. kind of interesting for voters to weigh in on. host: one final thought, you mentioned voters in alabama voting to approve a new state constitution. how often is it that amendments to state constitutions through this referendums sort of call for a state to really revisit their constitution more broadly, saying instead of this process of amending it every two years, we need to look at the constitution itself? and is guest: florida has a measure related to a constitutional review commission on whether or not it should be abolished. i think that meets every 20 years to propose eminence to the constitution. m

we also passed a hate law in arkansas.e shouldn't be targeting anyone because of their race or their gender. we also have to speak in a compassionate way and to have an understanding heart. so these are difficult issues that we're dealing with as a society. it's fair to debate and discuss. >> what about the timing there? >> that's a fair question, but it happens to be in the middle of an election, and you can't hardly pull everything down. that's a fair question. but the substantive issue is one that's on the hearts and minds of people, and you've got to be able to talk about it, state your position on it, and you've got to recognize these sensitive issues have to be dealt with by parents, by school officials, by employers as well. and what happened in that nightclub is a human tragedy. we all have to be able to express ourselves with compassion toward that, understanding and we need to work through this as a society. these are challenging issues, and what happened is just simply wrong. >> governor asa hutchinson of arkans
