education department as well as our department of labor and arne duncan and others are working aggressively on trying to implement many of the ideas that you've put forth. so i guess the bottom line is this: and as you've pointed out some of the recommendations contained in the joint council require legislative action, and these things don't move as quickly through congress as we would like. but, there are certain ideas that are contained in the job council reports that historic we have received bipartisan support and the election is 14 months away or 13 months away. we can't wait until another election before we start acting on those ideas. the american jobs act in putting forward obviously contains many ideas like infrastructure investment that should be pretty straightforward, and our hope is we are able to get those passed in the next couple of months. but we are not going to wait for congress. am i of this suggestion to jeff and gene and valleys and the advisers around the table is scour this report, identify all those areas in which we can act administratively without additional congr

and again now arne duncan says no more studies. let's do some action so what are some of the action to see including involving unions? >> the range of schools that we looked at, there really diverse and a lot of different organizational structures there. for many of the district schools, for example part of the massachusetts extended learning time, those schools all participated or those districts all participated in the negotiations with the union around new contracts for teachers to cover the additional time. those were sometimes complicated today go she but it has been a very strong relationship in those areas and as the secretary mentioned, the president of the teachers union in massachusetts is very enthusiastic about what that has meant. for the teachers. so, we have evidence of where it is possible to have those strong relationships to have the additional time, and again in other areas of the country, we see teachers who are very satisfied, very excited about their experience in the schools. >> if you look at the data on tea

arne duncan, the secretary of education, said something really profound. he said that a sixth grade teacher takes a kid from a third grade level of reading to a fifth grade level is a success, is a great teacher, but under no child left behind, the way it is now, that teacher is a failure. that makes no sense whatsoever. we have to measure growth. that's what the senator from colorado was talking about. we need to measure growth. and that's no mystery. i go around schools, and i remember being in a school in st. cloud, minnesota. i was introduced by the principal to the teacher who won teacher of the year, a math teacher. and i met the math teacher and the math teacher said growth. this is not a mystery. we have had hearings on this and we know this. we need to be measuring how much kids grow. and that will help kids that are from poor schools because they are starting on a lower level, but if the school is good and they are increasing their growth, they will be rewarded. my daughter graduated from college. i'm looking at the pages now who are juniors in h

education czar or if we were to have the chairman of a national education school board, secretary arne duncan would be a good one. but i don't think we want one in the united states of america. so i think we should act before christmas in order to avoid creating a waiver-granting education czar and we should act before christmas in a way that does not create a national school board. mr. president, there's one other suggestion i would make to the authors of this bill. in our earlier meetings with the president, congress an george miller of california, who was a key leader in developing no child left behind, said this bill to fix no child left behind ought to be a lean bill. i agree with congressman miller. the legislation that the republican -- we republicans introduced a few weeks ago totaled 221 pages in its five bills. the comparable section of the harkin-enzi draft are 517 pages. i would urge that we follow congressman miller's advice in the final result and be much more succinct than that. so, mr. president, despite these concerns, i will vote on wednesday or thursday -- whenever we finis
