education secretary arnie duncan is threatening to withhold federal education dollars for the state becausethe changeover will leigh the state without test scores for a year which is a violation of requirements. california is one step closer to regulating a controversial way to drill for oil. today, the state assembly passed a bill which would require permits for thrillers who want to frac. this comes after our investigation where we first expose there had's no regulation in this industry. fracking, as you might know, involving breaking up shale rock using a cocktail of highly pressurized water and chemicals. the bill now moves to the state senate. it's expected to make it to the governor's desk within days. the governor's office says, quote, he looks forward to signing it. environmentalists say it doesn't go far enough. >> firefighters in the east bay are still gaining ground against the morgan fire. containment now is 70%. evacuated residents back in their homes tonight. now full containment of the fire is expected on friday. more than 3,000 acres were charred by the flames which broke ou

secretary of education arnie duncan made the statement to the state legislature yesterday. lawmakers proposed replacing the standardized exams with a computerized system. the plan would suspend test scores in public schools for at least a year. during a trial run of the new exams. secretary duncan says letting an entire school year pass without recording test performance is the wrong way to go about this transition. >> this will be a unique move. students could have a seat on berkeley's city council. the council will consider a proposal to create a united student district encompassing areas next to uc-berkeley. if the proposal is approved berkeley would be the first city in the entire country to have a city council district designed solely to represent the interest of college students. students make up about a quarter of berkeley's population so putting power in the hands possibly of students. >> and they are registered to vote. >> watch how it plays out. >> let's see how the forecast is playing out for today. good morning. >> good morning to you, laura and jon. good mornin
