this is the first time an anne arundel county police officer has been shot in the line of duty since july of 2008. >>> the orange county sheriff is on a bit of the defensive tonight issuing an official response to our investigation into his agency, specifically into missing dashcam audio and to why his deputy threw a driver who had been pulled over a highway. here's our investigative reporter russ ptacek with the new side to this investigation. >> this is the statement issued today from that sheriff and for the first time a reason is offered as to why that deputy threw 53-year-old stuart fitzgerald onto the road. we know officers fumbled with fitzgerald's hands because he didn't release his cell phone. now for the first time the orange county sheriff's office says he was resisting arrest by preventing officers from handcuffing him. in a statement the sheriff also states how the agency claims fitzgerald attacked the officer. he says the deputy took fitzgerald to the ground to complete the handcuffing and this is when fitzgerald bit the deputy. fitzgerald later kicked the other officer
