i'm ashleigh banfield and this is "legal view." breaking news. at any moment, we are expected to hear from the mother of tamir rice who was the 12-year-old boy who was shot to death by police in cleveland, ohio, nearly 11 months ago. we are waiting for the news conference to begin. samaria rice is expected to call for an independent prosecutor but called in this case. this case drew attention nationally because he was so young, just 12 years old, but also, because he had a gun that looked very much like a real handgun, although it was not. it was an air soft pellet gun with the identifying tab removed. it happened outside of a recreation scenter in cleveland ohio, on november 22nd, last year, and when you look at the pictures, you can see tamir sitting at a picnic table underneath a gazebo, and somebody called the police reporting that there was a guy with a pistol adding that it was probably fake. and then you can see that the police car pulls up on the snowy grass and within two seconds of exiting that police cruiser, timothy lowman, an officer

i'm ashleigh banfield and welcome to legal view. will he or won't he? is he in or out? and america wants to know and we are not talking about joe biden, but we are now talk paul ryan, and paul ryan is not saying. paul ryan, yes, and joe biden, no. he is not the only politician keeping everybody guessing on the plans of the higher office, and instead, this wisconsin congressman and very reluck tant candidate for speaker of the house has now put the onus on his fellow republicans, touche, declaring he is going to stand for election as long as a few major conditions can be met, and they are this. he says that every house republican has to support him, moderates all of the way to the ultraconservatives, and he says that he wants to make it much harder to bring a so-called vacate the chair motion which is a sort of the no-confidence vote which threatened to oust john boehner and still having young kids at work, and he says, i am not going to be working, and traveling and fund-raising everyday as a modern house speaker is obliged to do, and i want some work/life balance here.

ashleigh banfield is live in roseburg, oregon, with more. ashleigh? >> poppy, i think perhaps one of the bomb shells from this news conference was something we have not been able to clear up and that's how this gunman died. in fact, he died by suicide. there was been discrepancies whether he was taken down by the deputies that responded to this tragedy or whether he killed himself, and the m.e., medical examiner, through the sheriff, you know, concluded that the killer died by his own hand. there were some other details of interest, as well. there was an additional gun that was discovered upon further search of the campus. there is a lot of question as to why so much investigating, why this is still a crime scene behind me on this campus and why so little information when reporters are asking about the details of the writings or some kind of package of some sort that had been reportedly handed by the killer to one of the survivors, and the sheriff just wasn't prepared to clear it up. unbeknownst to us, there's no due process here, no one to prosecute,

i'm ashleigh banfield, welcome to the program. keeping a close watch on the united nations where israeli prime minister benjamin netanyahu is set to address the general assembly this hour, any moment, in fact, and no doubt he's probably got a lot to say in light of the latest comments from the palestinian president, as well as the iran nuclear deal, and of course these most recent russian air strikes that have happened in syria in the last 48 hours. but we're going to begin with this breaking news. that is hurricane joaquin raging as a category 3 storm, potentially headed into a category 4. right now, it is circulating over the bahamas with maximum sustained winds of 125 miles per hour. its current track, current track, puts it hauntingly close to where hurricane sandy made landfall in 2012. new jersey's governor chris christie has just declared a state of emergency in that state. on twitter, he stressed, quote, we are prepared. i need everyone not to panic. and at a news conference just last hour, governor christie wreck niszed r

and also my colleague, ashleigh banfield, who is on the campus of umpqua community college. hleigh, we want to start off with you first. because clearly the focus needs to be on the most important folks in this story, and those really are the people who lost their lives, the victims. those nine people who went to the campus that day, never expected anything, and never came home. what are we learning about those people? >> reporter: yeah, in a place like this, too, suzanne, i can't stress it enough. it's just so peaceful and serene and beautiful here. and to think that just less than a mile up this road, and this is still a crime scene even right here, that massacre played out. to the end of what those nine suffered and their surrounding community is suffering now, they have decided to close the campus to classes for all of next week. it was just supposed to be until monday, but now they've thought better of it and the campus will be shut down all next week, as this community remembers people like lucas eibel, who was just 18 years old. he'd been studying chemistry at ucc here

stay with us, ashleigh banfield, to you. you were on the ground right away after the shooting there. let's hear about some of the league responses to what we know now. >> you can see behind me the sheriff's are still in place here and it is still an active forensics scene. nay won't let anyone within .8 of a mile. it is a very large crime scene. we don't have someone to prosecute. he is dead. and the medical examiner said he is dead by suicide. why all of this forensic collection? what do we really need to know. the sheriff was really only able to to iterate that this is for future prevention. they shared details about what this means for or departments and law enforcement agencies across the country. that is effectively what they're trying to establish with the investigation which leading to bewilderment like did the shooter deliver a box to one of the victims and insist that the victim give that box to the authorities? and the sheriff said that is still under investigation and we're not prepared to make a statement on that
