i am ken cleveland with the building and managers association. i am disappointed to see the small business executives here tonight to side with one set of small businesses against another set of small businesses. i am here supporting the appellants. there are tenants in office buildings and as has since stated earlier tonight, they employ a lot of people, they have been here for many years. and they enhance the value of the properties in the city that are paying about 20% of the entire city's budget. we have to look at the big impact here. i have to disagree with mr. paul who stated that boma was at the table. when this was passed unanimously, they were not involved. this was to bring vitality to underserved areas of the city where there are not restaurants, cafes, sandwich shops. we have a plethora of them downtown. we are not underserved in any sense of the word. if you look at the list of firms that have been applied for, over 50% of them are downtown locations. why? that is where the customers are. we had these constraints around the city of

last week, we had the head of the national telecommunications association on this program. he talked about the telecommunications act. we are going to show that, and i want to get your response. >> we are still in a balkanized bucket. if you use copper wire, you are entitled to telecommunications. if you use another kind of cable, you are a studio provider. almost all regulatory questions now are gray. the act does not provide clarity. the crates jurisdictional disputes and heavy inefficiency in the statute. it is certainly growing. at one point, i think congress has to migrate a little bit. >> the telecommunications act of 1996. >> i think michael is largely right. i think an entire rewrite of that 96 act would take the work of many congresses to get done. that is my experience on the commerce committee. my sense is to fix some of the problems michael is identifying , a rifle shot approach to what is no longer relevant, it is probably a more efficient way for congress to go. but i think he makes some good points. before the ink was dry, that bill had technology around it.

i am also active in the neighborhood association, i have been for years. i am married with two children, my kids go the mckinley school in the neighborhood. i woown a flat. my policy work is quite relative to the area plan and non-profit. i have been on the cac from the beginning and i was involved in crafting the plan and i feel as though we have been carrying out a difficult task of trying to figure out how to actually implement the plans that the city produces. it has never really been done before. other than the redevelopment areas that are kind of a turnkey approach. our planning work in the city has traditionally and that plans. we have an opportunity here to figure out how much more smoothly create the infrastructure to implement them. there are a number of things we have done over the years. i have a thankless benefits of being the chair. it was something that the market octavia cac was very involved in. it is something the financing tool can be put into place. how do you actually do in kind improvements? it was a tremendous -- i was the lead on th

[laughter] i know the cayuga improvement association was born back in the 1930's, 1937. it has been a stalwart group of volunteers in the community. i do not live far away. 10 years ago, i met demi. we did some cleanups here with you. i recall all the wonderful sculptures. i have snuck in here with my kids and visitors to show them how great it is to have these parks with people volunteering to do special things. i want to thank you for your leadership and sacrifices, all of your wonderful years of work. the park's alliance for your wonderful relationship and support, and our arts commission. they will be commencing another great piece of our work here. it just goes to show all the city agencies working together and that we honor our parks in this city. this is a wonderful commitment. we are not leaving this district alone. you know that. we're coming out your for a great purpose. we want to show and demonstrate that every part of the city is worth every investment that we do, a special building strong neighborhoods. we have done that correctly here. this is well worth $
